AGREEMENT 38
BETWEEN
THE COUNTY OF EAGLE, STATE OF COLORADO
W.R. GRIFFITH AND WENDY GRIFFITH
THI AGREEMENT, made and entered into this3Is-r day
of 4 1987, by and between the County of Eagle,
State of Colorado, by and through its Board of County
Commissioners ("County"), and W.R. Griffith and Wendy Griffith
(hereinafter collectively referred to as Griffiths).
W I T N E S S E T H:
WHEREAS, the County desires to construct improvements to
County Road No. P-307, hereinafter referred to as Brush Creek
Road;
WHEREAS, Griffiths are owners of property located adjacent
to a portion of the Brush Creek Road Improvement Project; and
WHEREAS, Griffiths currently own a fence in the existing
right-of-way adjacent to their property; and
WHEREAS, for the purpose of upgrading and realigning Brush
Creek Road, it is necessary to remove the existing fence and
place a new fence 6 inches onto the Griffiths' side of the
common right-of-way/property line; and
NOW, THEREFORE, for and in consideration of mutual
covenants, promises, and conditions herein contained; the
parties hereto agree as follows:
a. The new fence shall be CDOH Standard M-607-1 Barbed
Wire Fence With Steel Posts except that five strands of
barbed wire shall be used instead of four and stays
shall be wood instead of metal. A 20 foot Barbed Wire
Gate shall be placed in the new fence line and centered
15 feet westerly from the northeast property corner.
b. The County shall preserve and blend in existing
driveways to the improved Brush Creek Road by adding
roadbase to the driveways as necessary. In addition,
two feet of pavement width shall be added at the
location of the Barbed Wire Gate discussed above.

C. The Griffiths', or their successors in interest, shall
be solely responsible for the ownership and maintenance
of the new fence.
