THIS AGREEMENT made this day of September,
1987, by and between the Colorado Division of Wildlife (here-
inafter "DOW"), and the County of Eagle, State of Colorado,
hereinafter "the County."
WHEREAS, the DOW represents unto the County that they are
in the process of acquiring Lots 1-B and Lot 2 of Zoellick
Subdivision, Eagle County, Colorado, and as part of their
agreement have permission and authority, to conduct work on
said property at this time; and
WHEREAS, the DOW desires for the County, by its Public
Works Department, to perform work on the property.
THEREFORE, in consideration of the County's agreeing to
work on Lot 2 and Lot 1-B, DOW agrees to hold the County
harmless and defend the County from any and all claims against
it by the owner of any interest in said Lot 2 and Lot 1-B, or
anyone purporting to be the owner of said property.
FURTHER, the undersigned representative of the Division
of Wildlife represents unto the County that he is authorized
to sign this agreement.
