OF THE COLORADO DEPARTMENT OF SOCIAL SERVICES JULY 1, 1987 through JUNE 30, 1988 We, the undersigned, hereby agree that each of the following assurances will be met in relation to the Home and Community Based Services Program of the Colorado State Department of Social Services. We understand that these assurances constitute the contractual terms of certification, against which performance will be monitored, authorized services will be reimbursed, and future recertification will be considered. A. The case management agency designate has developed and submitted to the State a plan for local operations and program implementation for FY 87-88 or has indicated to the State in writing that the plan for FY 86-87 will be continued'with no significant changes. The local operational plan conforms to a State -prescribed format and outlines the process by which the following assurances will be met. The agency can document that at least the following entities were invited to participate in the public input process which preceded the development of the plan or the decision to continue the FY 86-87 plan for FY 87-88: the board of county commissioners, the field supervisor of CDSS, the district health department, the area agency on aging, county department(s) of social services, nursing home(s), hospital(s), city and town government(s), and the general public. Co. Comm. CMA B. The CMA assures that clients will have appropriate and timely access to Home and Community Based Services. The CMA will facilitate the application process for potentially eligible individuals. The CMA will respond in a timely manner to all referrals of eligible clients. The CMA will assure quality of assessments, which shall include appropriate long term care program targeting. Co. Comm. CMA V C. The CMA assures that clients' rights will be protected within the HCBS program. Clients have the right to apply for services, to have their eligibility for services determined, to receive an adequate quantity and quality of the services for which they are eligible, to appeal denials of service, and to have their communications with the agency dealt with confidentially. The CMA will notify each client of his/her rights to appeal, and will facilitate appropriate access to advocacy services from the Colorado Long Term Care Ombudsman, Adult Protective and Supportive Services, and the Area Agency on Aging/Title III OAA Advocacy Services. Co. Comm. CMA D. The CMA assures compliance with current regulations of Federal and State Medicaid and HCBS programs, as amended and revised. The CMA will ( provide monitoring at a frequency that assures quality of service provision. The CMA will process paperwork in a timely and accurate manner to promote prompt service to clients and prompt payment of provider claims. The CMA will assure adequate documentation to support all Medicaid claims. The CMA and the Board of County Commissioners acknowledge that certification may be revoked by the State for material failure to comply with HCBS regulations and assurances. Co. Comm. CMA' E. The CMA assures competent and professional operation of the agency and of the Home and Community Based Services Program. Case managers and their support staff will be qualified, both by education and experience, to carry out their assigned duties. The CMA will provide them with adequate training and supervision to maintain ongoing quality of service. Co. Comm. CMA F. The CMA assures that deinstitutionalization of Medicai long -term -care clients will be a major program objective for the agency in FY 87-88. Co. Comm. CMA G. The CMA assures that it will assume a lead responsibil-ty for developing a local continuum of care for the elderly, blind and disabled. The CMA will make ongoing efforts toward development of new resources, enhancement of existing resources and coordination of resources. Coordination responsibilities include the initiation of regular and adequate communications with providers, potential providers, physicians and the other entities cited in Assurance A above. Coordination also includes responding to inquiries and providing referral assistance to persons seeking long term care, without regard to program or income eligibility. Co. Comm. CMA H. The CMA assures that HCBS provider certification will be extended only to individuals who are qualified to perform their assigned duties. The CMA will maintain documentation that all certified individual providers meet all applicable certification standards. The agency will provide adequate monitoring and assure that adequate training takes place to maintain adequate quality of service and client safety. Co. Comm. CMA o I. The CMA assures a system of data collection that will assist in the evaluation of the HCBS program and of CMA performance. The CMA will complete reports as requested by the State and will cooperate with all program monitoring and evaluation efforts by the State. Co. Comm.
