AMENDMENT TO AGREEMENT
BETWEEN
THE COUNTY OF EAGLE, STATE OF COLORADO
AND
I. H. DELATTE
THIS AMENDMENT, made and entered into this
day of '1988, by and between I. H. DeLatte,
d b a DeLatte Gravel ("DeLatte"), and the County of
Eagle, State of Colorado, by and through its Board of
County Commissioners ("County").
W I T N E S S E T H:
WHEREAS, the parties hereto entered into an
Agreement on the 4th day of May, 1987, concerning the
removal by the County of 25,000 tons of crushed rock
aggregate stockpile owned by DeLatte from property as
more particularly described in the Agreement; and
WHEREAS, paragraph 4 of said Agreement provides
that the County shall have one year from the date of the
Agreement to remove said rock from the property, i.e., by
May 4, 1988, unless the term of the Agreement is extended
by mutual agreement of the parties; and
WHEREAS, it is the desire of the parties to
extend the term of the Agreement.
NOW, THEREFORE, the parties hereto agree to
extend the term of that certain Agreement dated May 4,
1987 by and between I. H. DeLatte, d/b/a DeLatte Gravel
and the County of Eagle, State of Colorado, for a term of
month-to-month. Either party may terminate said
Agreement by giving thirty (30) days written notice.
All other terms and conditions of the Agreement
shall remain of full force and effect.
IN WITNESS WHEREOF, the parties hereto have set
their hands and seals this �_ day of 1988.
