C)l- In the event contractor has agreed to payment on a monthly basis pursuant to "draws" to be submitted by him to the, owner, he shall submit and deliver to the owner a written monthly,bills "draws" for all labor, materials, time charged on equipment, and any other incidental 'costs incurred `by the contractor by reason of the work to tie performed; which draws shall include all accrued and unpaid costs of the work prior to the date reflected on such draw; and the owner shall pay the sum total amount reflected on such draw or draws on or before the 15th day of the month next succeeding the month in which such draw is applicable. In the event owner fails or refuses to timely pay such draws, or any portion thereof, as the same falls due, such amount remaining unpaid shall bear interest at the rate of two (2) percent per month until paid. In the further event that the owner shall fail or refuse to pay draw monies to the contractor on or before the elapse of thirty (30) days next succeeding the due date for payment of same as provided above, the contractor, at its option may close down the work it contracted for, abandon the job site premises, and terminate all agreements with the owner, without waiver of its rights to reimbursement of draw monies accrued and unpaid and for payment ,of profits that it would be ,entitled to were the contract to be fully performed. 2. In the event the contractor shall be caused to retain the services of an attorney to enforce its rights under this agreement, or to collect any draw monies due from the owner, it shall be entitled to reimbursement for reasonable attorney's fees necessitated by contractor for such enforcement and/or collection, together with such other costs as allowed by law. To further perfect contractor's lien for unpaid draw monies upon the above described real property, and provided that such draw monies remain unpaid after the elapse of sixty (60) days next succeeding that date when the same are due, contractor shall be entitled and accordingly authorized to file a copy of this agreement in the office of the Clerk and Recorder of the County where the subject,real,property is situated, and to subsequently foreclose such lien in the manner as if the same were a Mechanic's Lien filed pursuant to CRS 1973 S 38-22-101 et seq, notwithstanding the limitation of any right of contractor to file a Mechanic's Lien pursuant to said statute.
