HomeMy WebLinkAboutC87-023 IGA with Gypsum Fire Protection District for AirportI z I -d3 -1 -1 Mi�YY' : .� �' : ►lul:+l►ii : ' s1u1�1►M THIS AGREEMENT is entered into as of the day of November, 1986, by and between GYPSUM FIRE PROTECTION DISTRICT, a quasi -municipal corporation ("District"), and the BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO ("County"). WHEREAS, District administers fire protection for all the properties included within the boundaries of the Town'of Gypsum ("Town") and other properties outside the boundaries of the Town, including the Eagle County Airport; and WHEREAS, County is the owner of the Eagle County Airport and desires greater fire protection services to the Airport than those being provided by the District within its presently existing capabilities ("desired services"); and and WHEREAS, District is willing to provide desired services; WHEREAS, County is willing to pay for desired services; NOW, THEREFORE, IT IS AGREED: 1. County shall specify in writing to District the desired services in detail. 2. District, within thirty (30) days of receipt of County's notice provided in Paragraph 1, shall determine the estimated cost of desired services, facilities and equipment (hereinafter referred to as "Costs") and furnish County with a written copy of District's computation of estimated. Costs. 3. If the estimated Costs of desired services shall be acceptable to County, County within thirty (30) days of receipt of computation provided in Paragraph 2, shall notify District inaswriting of its acceptance of such Costs. 4.,''District, within thirty (30) days of receipt of County's acceptance provided in Paragraph 3, shall commence necessary actions to provide desired services. 5. District shall bill County within ten (10) days after the end of each month for the Costs of desired services provided the previous month. Said actual Costs is to be determined in accordance with generally accepted accounting principles. 6. County shall pay District such Costs determined in accordance with Paragraph 5. by the end of the month in which the bill is presented. 7. `This 'Agreement shall automatically be renewed the first day of January each year hereafter. County shall have the right to cancel this Agreement, with or without cause, upon ninety (90) days written notice to District, provided, however, that upon cancellation County shall purchase, in cash, from District, at District's depreciated costs such additional equipment costing in excess of $10,000, or fire station provided by District pursuant-to.this Agreement. 8. County and District shall meet as required to adjust desired services as need -for services may change. 9. In the event that County shall cancel this Agreement and shall purchase equipment or fire station, upon petition by County for exclusion from District, District shall permit such exclusion. 10. County shall have no obligation or liability to provide fire protection services and District's liability under this Agreement shall be the same as District's liability in the remainder of its service areas. Pursuant to the terms of said Agreement, the county will be providing to the District, in writing, the desired services it wishes the District to perform in providing fire protection service to the Eagle County Airport.
