Fritze NO. 1005 Type Lessee's LAST NAME First SAFE DEPOSIT BOX LEASE TYPE OF LEASE ❑ Joint ❑ Corporation ❑ Individual ❑ Partnership ❑ Association ❑ Trade Name Alpine Bank, Eagle , Colorado (herein called "Bank") does hereby lease to the below named (herein sometimes called "lessee," whether one or more), from year to year, the above numbered safe deposit box (herein called "box") in the safe deposit vault of Bank. Upon the death of the Lessee, or any person having authorized access to the Box, Bank shall have the right to notify the proper tax authorities and to sus- pend all access to the Box leased hereby until said Bank be properly released from all liability by such tax authority. Nothing herein contained obligates Bank to notify any taxing authority of the death of the lessee. Any Lessee hereunder shall have authority, as agent for the other Lessees, to continue or terminate this lease and to add, substitute or surrender space hereunder, to add one or more additional lessees, and it is understood that the possession and control of the properties deposited in the Box leased hereunder is vested in each of the parties hereto and each shall have access thereto, in person or by deputy. In case Bank is served with any legal process which, in its opinion affects or may affect property deposited in the Box leased hereby, Bank, without incur- ring any liability therefor, may suspend all right of access to said space until it is advised by counsel of its rights and obligations. Bank shall not be liable for any property taken from the Box by virtue of any writ, court order or process or taken from the Box by any officer of the law, and Bank may and is hereby authorized to assume that any such act, writ, court order or process is valid and it shall be under no duty to resist or contest the same. Lessee agrees to save and hold Bank free and harmless from and to indemnify and reimburse it for all disbursements, including reasonable attorneys' fees, payments, damages, costs or expenses by it sustained, paid out or incurred by reason of any actions, suit, garnishment or levy relating to the contents of said Box or by reason of any liability imposed pursuant to law. The word "Lessee" as used herein, shall include (a) the individual Lessee, where there is only one Lessee; (b) each of the individual Lessees, where there is more than one Lessee; (c) the deputy appointed by one Lessee, or by one or more than one Lessee, where there is more than one Lessee; (d) the officers, employees, agents or representatives of the Lessee corporation or association duly authorized by such Lessee to have access to the Box; (e) the partners, em- ployees, agents or representatives of the Lessee partnership duly authorized by such Lessee to have access to the Box; (f) the personal representative of a deceased individual Lessee where there is only one Lessee at the time of the death of such Lessee. The Lessee acknowledges receipt, in n ssaled envelope, of two keys to the Box. The Lessee further acknowledges receipt of a copy of this lease.
