THIS INDENTURE made this 0 day of 1987,
by and between ADAM'S RIB RANCH CORPORATION, & Delaware
corporation, of the County of St. Louis and State of Missouri,
of the first part; and THE COUNTY OF EAGLE, STATE OF COLORADO,
by and through its BOARD OF COUNTY COMMISSIONERS, whose legal
address is P.O. Box 850, Eagle, Colorado, 81631, of the second
part:
WITNESSETH, That the said party of the first part, for
and in consideration of the sum of SEVENTEEN THOUSAND AND
N0/100 DOLLARS ($17,000.00) and other good and valuable
consideration, the receipt whereof is hereby confessed and
acknowledged, has granted, bargained, sold and conveyed, and
by these presents does grant, bargain, sell, convey and
confirm unto the said party of the second part, an easement
and right-of-way in gross over and across the following
described tracts or parcels of land, situate, lying and being
in the County of Eagle, State of Colorado; said right-of-way
being more particularly described as follows, to -wit:
A tract of land located in Tract 69, Township 5
South, Range 84 West of the 6th Principal Meridian,
Eagle County, Colorado, being more particularly
described as follows:
Considering the East line of said Tract 69 as
bearing north 0°01130" East and with all bearing
contained herein relative thereto:
Commencing at the Southeast Corner of said Tract
69; thence, North 0001130" East along said East line,
909.14 feet to a point on the South Right-of-way line
of Brush Creek Road, said point being the Point of
Beginning; thence, along said South -and Westerly
right-of-way line, North 45100100" West, 94.87 feet;
thence, North 39059140" West, 126.00 feet to a curve
concave to the Northeast having a central angle of
3003914611, a radius of 635.00 feet and the chord of
which bears, North 24039147" West, 335.80 feet;
thence, along the arc of said curve, 339.83 feet;
thence, North 09019154" West, 644.77 feet to a curve
concave to the Southwest having a central angle of
62000147", a radius of 565.00 feet and the chord of
which bears North 40020117" West, 582.10 feet; thence,
along the arc of said curve, 611.52 feet; thence,

North, 71°20'41" West, 292.73 feet; thence leaving
said South and Westerly right-of-way line, North
18039119" East, 70.00 feet to a point on the North and
Easterly right-of-way line of Brush Creek Road;
thence, along said North and Easterly line, South
710201.41" East, 292.73 feet to a curve concave to the
Southwest having a central angle of 6210014711, a
radius of 635.00 feet and the chord of which bears
South 40020117" East, 654.22 feet; thence, along the
arc of said curve, 687.28 feet; thence, South 09019154"
East, 644.77 feet to a curve concave to the Northeast
having a central angle of 3003914611, a radius of
565.00 feet and the chord of which bears, South
24039147" East, 298.77 feet; thence, along the arc of
said curve, 302.37 feet; thence, South 39059140" East,
147.00 feet to a point on the East line of said Tract
69; thence, leaving said North and Easterly right-of-
way line, South 0001130" West, 96.00 feet to the Point
of Beginning.
The above-described tract contains 3.359 acres.

O Said right-of-way hereby granted is for the maintenance
and full, free and quiet use and enjoyment by the County of
Eagle for any and all purposes by it desired or deemed neces-
sary or beneficial, as a public highway.
The Grantee shall at all reasonable times have the right
to enter upon said right-of-way hereby conveyed for, but not
limited to the purposes of, constructing, reconstructing,
repairing, maintaining and patrolling said right-of-way, doing
as little damage as possible.
The said party of the first part, for itself, its heirs,
executors, and administrators, does covenant, grant, bargain
and agree to and with the said party of the second part, its
heirs and assigns, that at the time of the ensealing and
delivery of these presents, it is well seized of the premises
above conveyed, as of good, sure, perfect, absolute and
indefeasible estate of inheritance, in law, in fee simple, and
has good right, full power and authority to grant, bargain,
sell and convey the same in manner and form as aforesaid, and
that the same are free and clear from all former and other
grants, bargains, sales, liens, taxes, assessments and encum-
brances of whatever kind of nature soever.
And the above bargained premises in the quiet and peace-
able use of the said party of the second part, its heirs and

assigns against all and every person or persons lawfully
claiming or to claim the whole or any part thereof, the said
party of the first party shall and will warrant and forever
defend.
IN WITNESS WHEREOF, the said party of this first part has
hereunto set its hand and seal the day and year first above
written.
