PART III—AWARD CONDITIONS
a. GENERAL CONDITIONS
The recipient covenants and agrees that it will expeditiously initiate and timely complete the project work for
which assistance has been awarded under this agreement, in accordance with all applicable provisions of 40 CFR
Chapter I, Subpart B. The recipient warrants, represents, and agrees that it, and its contractors, subcontractors,
employees and -representatives, will -comp ' ly with: (1) all applicable provisions of 40 ,CFR Chapter I, Subchapter B,
INCLUDING BUT NOT LIMITED TO the rovisions of Appendix A to 40 CFP Part 30, and (2) any special
conditions set forth in this assistance agreement or any assistance amendment pursuant to 40 CFR 30.425.
b. SPECIAL CONDITIONS:
(For cooperative agreements include identification or summarization of EPA responsibilities that reflect or
contribute to substantial involvement.)
1. This Cooperative Agreement is awarded in accordance with the Federal Grant
and Cooperative Agreement of 1977.
(a) This Agreement is subject to, but not limited to, the following Agency
Regulations:
- General Grant Regulations and Procedures (40 CFR Part 30);
- Implementation of Resource Recovery and Conservation Act of 1976
(40 CFR Part 35);
- National Environmental Policy Act of 1969 (40 CFR Part 6);
- Non-descrimination in Federally Assisted Programs (40 CFR Part 7).
(b) Procurement shall be in compliance with Attachment 0 to OMB Circular
A-102.
2. The Recipient must comply with the appliable guidelines published pursuant
to RCRA, Section 1008, as follows:
(a) Materials Recovery (Part 246). The Recipient shall comply with the
intent of Sections 246.200 and 246.201 of this Part as follows:
(1) High-grade paper recovery (Section 246.200). The Recipient shall
investigate the feasibility of, and implement where feasible, a model
high-grade paper recovery program if the Recipient employs more than
100 office workers in an office facility. Section 246.200 describes
recommended procedures for implementing the program.
(2) Residential materials recovery (Section 246.201). The Recipient
shall investigate the feasibility of, and implement where feasible, a
residential materials recovery program. Section 246.201 describes
recommended procedures for implementing the program.
(b) Thermal Processing (Part 240). Requirements and recommended
procedures are provided primarily for the design and operation of
facilities processing waste by means of heat. The Recipient in
planning any energy recovery project shall comply with the
requirements under this Part.
(c) Collection and Storage (Part 243). The Recipient shall comply with
applicable requirements of this Part. For example, materials that
have been separated for the purpose of recycling shall be stored and
transported in accordance with the requirements of this Part.

3. Recipients developing recovery facilities must agree to locate residue
disposal sites that are consistent with EPA's "Criteria for Classification of
Solid Waste Disposal Facilities: (40 CFR 257) promulgated on September 18,
1979, under Sections 4004 and 1008 of RCRA. Residue landfill siting cost
incurred in excess of $20,000 are not allowable as project costs and thus,
cannot be applied toward the grantee matching share. Signature of this
cooperative agreement constitutes commitment to locate residue disposal sites
in compliance with EPA criteria.
4. Substantive deviations from work plan activities or budget submitted with
the application must be approved by EPA.
5. The Recipient shall provide the following reports, documents, and working
papers:
a. Outputs of major tasks, as developed;
b. Outputs generated under subagreements, including contractor progress
reports;
c. Reports on project status due December 15, 1980, March 15, 1981, June
15, 1981, and September 15, 1981;
d. Public participation responsiveness summary report; and
e. A project assessment report developed at the end of a project phase
(or at critical decision points) that summarizes the outputs of tasks
in a briefing document format to enable local officals to make a go or
no go decision. Formal documentation of the decision must be attached
to the report for submittal to EPA.
6. Funding for Phase III is contingent upon satisfactory progress,
availability of funds, and the development of a workscope and budget
appropriate to meet the then -existing needs of the Recipient. EPA cost
sharing may be below 75 percent.
7. The Phase II report must include a energy conservation or savings
estimation.
8. The EPA Project Officer and the Technical Assistance Consultant shall
provide ongoing oversight and guidance throughout the project. Specific
requests for performance of work by the TA Consultant should be directed to
the Project Officer.

PART IV
NOTE: The Agreement must be completed in duplicate and the Original returned to the Grants Administration
Division for Headquarters awards and to the appropriate Grants Administrations Office for State and local
awards within 3 calendar weeks after receipt or within any extension of time as may be granted by EPA.
Receipt of a written refusal or failure to return the properly executed document within the prescribed time, may
=result in the withdrawal of the offer by the Agency. - Any change to the Agreement by the recipient subsequent
to the document being signed by the EPA Award Official which the Award Official determines to materially'
alter the Agreement shall void the Agreement.
