HomeMy WebLinkAboutC80-007 IGA with TOE for development of Brush Creek Valley, Eby Creek and Eagle Riverr INTER -GOVERNMENTAL COOPERATIVE AGREEMENT BETWEEN THE TOWN OF EAGLE AND THE COUNTY OF EAGLE FOR THE PURPOSE OF CONSIDERING PLANNING, PHASING, AND REGULATING THE DEVELOP- MENT OF LAND IN THE BRUSH CREEK VALLEY, ERY CREEK VALLEY, AND EAGLE RIVER VALLEY THIS COOPERATIVE AGREEMENT is made and entered into between the Board of County Commissioners of the County of Eagle, State of Colorado, hereinafter referred to as the "County", and the Town Council.of the Town of Eagle, hereinafter referred to as the "Town", WITNESSETH: RECITALS WHEREAS, the County is the ultimate governmental authority with regard to land use control and development in the unincorporated areas of the county, which areas include The Brush Creek Valley, Eby Creek Valley, and Eagle River Valley; and WHEREAS, the Town is the ultimate governmental authority with regard to land use control and development in the incorporated areas of the Town within The Brush Creek Valley, Eby Creek Valley, and Eagle River Valley; and WHEREAS, the Town is a significant potential source of urban facilities and services required for the orderly urban development within the aforementioned sphere of influence; and WHEREAS, the Town and County consider that joint planning, phasing, and regulating of the development of land in this sphere of influence in a coordinated manner is important to the future of The Brush Creek Valley, Eby Creek Valley, and Eagle River Valley; and e0 WHEREAS, the Town and County consider that existing and future growth and development should be studied, along with the facilities (7:11.1 and services necessary to serve adequately the population; and WHEREAS, the Town and County agree to accomplish careful and comprehensive surveys and studies of the existing conditions and probable future growth of the territory within their respective jurisdictions; and WHEREAS, the Town and County consider that existing and future growth and development should be studied to determine positive and negative impacts of this growth upon the citizens, visitors, and environment of The Brush Creek Valley, Eby Creek Valley, and Eagle River Valley; and WHEREAS, this planning study area shall encompass all private and public lands within the area bounded by Federal lands up the Eby Creek Valley to the North, Red Canyon to the East, the Town of Eagle's Water Treatment Plant to the South, West line of Section 6, Township 5 south, Range 84 west to the West. WHEREAS, comprehensive planning is necessary for the purpose of guiding and accomplishing coordinated planning and harmonious development in accordance with present and future needs and resources; to best promote the health, safety, morals, order, convenience, prosperity and general welfare of the inhabitants; efficiency and economy in the process of development, including distribution of population and uses of land for urbanization, trade, industry, habitation, recreation, agriculture, forestry, and other purposes -2- which will tend to create conditions favorable to health, safety, transportation, prosperity, civic activities and recreational, educational and cultural opportunities; to reduce the waste of physical, financial and human resources which result from either excessive congestion or excessive scattering of population; and to encourage efficient and economic utilization, conservation and production of the supply of food and water and of drainage, sanitary and other facilities and resources; THEREFORE, BE IT RESOLVED that in order to establish a cooperative spirit of understanding between the two general purpose governmental agencies, the County of Eagle and Town of Eagle, an Inter -Governmental Cooperative Agreement is entered into for the purpose of considering planning, phasing and regulating the development of land.
