THIS SUBCONTRACT, wade tnis 27th day of .October
1980, by and between the Morthwest'Colorado Council of Governments,
hereinafter referred to as the Issuing Agency and Eagle County
Commissioners , hereinafter -referred to as the Subcontractor,.
WHEREAS, authority exists in the Law and Funds have been
budgeted; and
WHEREAS, federal funds haveeven made available by the
Comprehensive Older Amercanb Act, for the purposes and under
the conditions specified in the same which the parties hereto
intend to comply; and
WHEREAS, the parties intend to compl:" with the contract
and all future revisions and modifications thefeto bbtween
the Issuing Agency and the Colorado Department'of Social
Service which prescribes the grant of funds to'the Issuing
Agency and the conditions thereof, and to comply as well with
all implementing statutory and administrative directions
issued by the Department of Social Service.
NOW THEREFORE it is hereby agreed that
1. The Subcontractor will be reimbursed in the amount
not to exceed $ 7�-,q7 , such amounts to
be paid by the Issuing Agency pursuant to the terms
and conditions set forth in the Assurances and
Certifications and the attachments which follow.
These funds cover the period October 1, 80, to
Sept. 30, 81 '
2. The Subcontractor agrees to meet all conditions and
to perform in accordance with and to abide by and
to comply with all provisions of the following:
SCHEDULE
Period of Performance. October 1, 1980 - September 30, 1981.
Inspection and Monitoring. An authorized representative of
the Issuing Agency shall be appointed and will be responsible
for monitoring.and evaluating performance under this Subcontract.
Each subcontract will be subject to a minimtua of one audit
review during the contract and will make available any
r` pertinent staff and records in order to ascertain contract
compliance.
Payments.
(1) Subcontract shall be paid upon submission of properly
certified reimbursement requests. In no event shall total
payments exceed the subcontract amount.
(2) Subcontractor shall maintain records sufficient
to support all payments and upon request of the Issuing
Agency, shall make such records available to the Issuing
Agency, Department of Social Service and the Federal
Government.
Reporting..
(1) Financial reporting by the Subcontractor shall be
in accordance with the procedures as developed and prescribed
by the Issuing Agency during the performance of this Subcontract.
(2) Program reporting by the Subcontractor shall be in
accordance with the procedures as developed and prescribed
by the Issuing Agency during the performance of this Subcontract.
PROGRAM NARRATIVE m
1. Introduction.
"4any older citizens in Region XII experience hardship
from lack of sufficient services. The increase in the
number of older citizens within the Region requires
improvements in existing services and extension of
social services.
The Subcontractor understands and agrees that it is the
purpose of this contract to foster a comprehensive,
coordinated system which: 1) facilitates access to and
utilization of all existing services, 2) effectively and
effiecier,'.:ly develops social ser -ices to meet the needs
of older persons. The Contract will give priority to those
persons with the.greatest social and economic need.
The Subcontractor assures that at least 500 of the amount
allotted for Part B to the planning and service area
will be expended for the delivery of:
A. Services associated with access to services (trans-
portation, outreach, and information and referral);
B. In-home services (homemaker, home health aides,
friendly visiting, telephone reassurance, and chore
services).

1981 TITLE III SCOPE OF SERVICES
GOAL 1: Senior citizens in Eagle County shall have low cost'trans-
portation available to them within the county.
OBJECTIVE 1-A: Existing senior transportation services will be
coordinated to increase services by 10% by October 1,
1981.

J,,�;OAL 2: Adequate information/referral and outreach services will be
maintained to assure all older individuals convenient access
to needed services.
OBJECTIVE 2-A: Update current inventory of resources for Eagle County
by January 1, 1981.
A. Review current information/referral resources
B. Provide AAA an update to prepare for printing
C.- Distrubute information/referral data to senior centers, senior
groups and all county nutrition site by .March 1, 1981.
Objective 2-B: Advertise the availablility of services through
newsletters and local media by November 30, 1980.
A. Publish information/referral services in a monthly newsletter.
GOAL 3: Senior citizens in Eagle County shall be provided a system
of services to maintain an independent life style.
Objective 3-A. Provide for the provision of 460 units of home
services by October 1, 1981.
GOAL 4: All seniors shall have opportunities to pursue recreational
activities.
Objective 4-A. Expand recreation services by loo for 1981.
STANDARD ASSURANCES
The Subcontractor
1. Compliance with Comprehensive Older Americans Act
Amendments of 1978
Except where waivers have been duly granted by the State -
agency, the Subcontractor complies with all other
responsibilities and obligations prescribed to it by the
Comprehensive Older Americans Act Amendments of 1978,
and applicable federal regulations.
2. Fifty -percent Reguirement
The Subcontractor expends at least 50 percent of F—cial
services funds received under Title II, Part B for
access services, in-home services, and legal services.
(Section 1321.77d)
13. Access to Information and Referral
Information and Referral (I & R) Services are provided
sufficient to assure convenient access and in language
spoken by -older persons and that I & R providers maintain
current information, develop lists of older persons in
need of services and opportunities, employ a specially
trained staff, and disclose information about an individual
only with informed consent. (Section 1321.77 c 7)
4. Preferred TargetGroup
Older persons with the greatest economic or social need
receive preference in the delivery of each service under
the Area Plan. (Section 1321.77 e 5)
5. No Means Test
No service provider'under the Area Plan uses a means test
to determine the eligibility of an older person for any
services funded under Title III, Part B. (Section 1321.77 e 5)
6. Age Discrimination
Service providers under the Area Plan shall not discriminate
against older persons and shall employ persons on a.full-
time and part-time basis in carrying out their programs.
7. Non -Discrimination on the Basis of Handicap
All recipients of funds from the Area Agency are required
to operate each program or activity so that, when viewed
in its entirety, the program or activity is readily acces-
sible to and usable by handicapped persons. Where
structural changes are required, these changes shall be
made as quickly as possible, but by June 3, 1982 at the
latest, in keeping with 45 CFR 84.
8. Civil Rights Compliance
The Subcontractor insures that benefits and services
available under the Area Plan are provided in a non-
discriminatory manner as required by Title VI of the Civil
Rights Act of 1964
9. Affirmative Action Plans
The Subcontractor has developed and is implementing an
affirmative action plan for employment opportunity in
all aspects of personnel administration. The affirmative
action plan -contains quantifiable goals relative to
employment and upgrading of minorities, women, handicapped,
and persons 60 and above, action steps with timetables
and identification of organizational units or individuals
responsible for carrying out steps to achieve the goals,
grievance and appeal procedures regarding discrimination
in employment, provision for training and upgrading skills
of staff to ensure upward mobility, and provision for
continued minoriting and assessment of plan, with updating
of plan as appropriate. The Area Agency will neither
renew nor grant new approvals of subgrants unless the
applicants contain an acceptable affirmative action plan.
10. Equal Employment Opportunity
Subcontractors shall, to the extent possible, provide
for adequate numbers of qualified staff working full
or part-time, including older persons, handicapped indi-
viduals, women and members of minority groups.
11. Composition of Advisory Council
The Subcontractor has established an advisory committee
whose composition, function, frequency of meetings,
support and by-laws are in accordance with federal require-
ments. (Section 1321.97)
12. Arrangements with -Chill Care Organizations and Educational
Institutions J
The Subcontractor will, if possible, have arrangements with:
a) children's day care organizations so that older persons
can volunteer to help provide day care; and b) local
educational agencies, institutions of higher education,
and non-profit private organizations, to use the services
provided older individuals under the community schools
program of the Elementary and Secondary Education Act
of 1965. (Section 1321.77•b 2 and 3 )
13. Needs Assessments
The Subcontractor assesses the kinds and levels of
services needed by older persons in the planning and
service area and the effectiveness of the services proveded
under the plan. (Section 1321.77 b 4)
14. Opportunities for Older Persons to Express Their Views
The Area Agency provides adequate and effective
opportunities for older persons to express their views
to the Area Agency`�on policy development and program
implementation under the area plan (Section 1321.77 b 7)
15. Outreach Efforts
The Subcontractor has outreach efforts, with special
emphasis on rural elderly and persons with greatest
economic or social need, to identify older persons and
inform them of the availability of services under the area
plan. With respect to nutrition services, outreach
efforts ensure that the maximum number of eligible persons
have an 'opportunity to receive services. (Section 1321.77 b8)
16. Requirements to be met by Providers Under the Area Plan
Service providers funded through the Area Plan' meet,
existing State and -local licensure and safety requirements:
comply with procedures established by the Area Agency for
a) outreach activities to ensure participation of eligible
older person; b) training and use of elderly and other
volunteers and paid personnel; and c) coordination with
other service providers in the planning and service area;
d) follow priorities set by the Area Agency for serving
older persons with greatest economic or social need;
e) comply with rules concerning contributions; f) assure
maintenance of non -Federal support for services; g) maintains
procedures for obtaining the views of participants about
services they receive. (Section 1321.77 c 3)

SPECIAL PROVISIONS
�(')�,Fund Availabilitv. Financial obligations of the Subcontractor and
Issuing Agency payable after the current fiscal year are contingent
upon funds for that purpose being appropriated, budgeted, and
otherwise made available.
Discrimination.. The Subcontractor agrees to comply with the
letter and spirit of the Colorado Antidiscrfmination Act o3=
1957, as amended, and othar applicable law respecting discrimi-
nation and unfair employment practices (80-21-1, CRS 1963,
a.s amended) .
Safety and Health Conditions. In the performance of this
subcontract, the Subcontractor agrees to establish and maintain
appropriate standards of safety, health, and work conditions
for the particular work performed by participants employed
under this subcontract. Where the work performed by such
participants comes within the preview of standards prescribed
pursuant to Federal, State or local law, such standards shall
apply.
Termination. This subcontract may be terminated in whole or
in part, for any reason by either party upon the giving of
thirty (30) days prior written notice of such termination
to the other party.
Notice of Termination shall be deemed given upon the mailing
of said notice by United States certified, first-class mail,
postage prepaid, and addressed to the parties at their
respective addresses as shall appear herein. Such Notice of
Termination shall specify the extent of which performance of
work under the subcontract is terminated and shall be effective
upon the expiration of thirty (30) days from the receipt of
such notice by the respective party.
