HomeMy WebLinkAboutC77-03 Lease with Town of Eagle for gym in elementary schoolD LEASE THIS INDENTURE, Made this 15th day of December 1977, between EAGLE COUNTY, Lessor, and the TOWN OF EAGLE, lessee; `9ITNESSETH, That, in consideration of the payment of M the rent and the keeping and performance of the covenants and agreements by lessee hereinafter set forth, lessor hereby leases unto lessee the following described premises in the Town of Eagle, County of Eagle, State of Colorado: The Gymnasium building and facilities once a part of the Elementary School, in the Town of Eagle, and now owned by the County of Eagle, located in Block 17, Town of Eagle; TO HAVE AND TO HOLD the same with all its appurtenances from noon of the 15th day of December , 1977, until noon of the 15th day:of December , 1978, for an annual rental of $50.00, payable in advance, and subject to the following terms and conditions: 1. That lessee will maintain the leased premises for the use and benefit of the general public of the Town of Eagle and County of Eagle. 2. That lessee shall have the sole authority to determine the time, scheduling and extent of use of the leased premises by the general public. There will be no commercial ventures held in the facility without written permission of County Commissioners. 3. That lessee shall at all times maintain and secure control of the leased premises and shall be obligated for the adequate supervision of all use of the leased premises. 4. That lessee will be responsible for the payment of all utility charges in the leased premises except the fuel bill. The lessor wiiL-provide the heat and be responsible for no other utility related charges. 5. That lessee shall maintain the premises in the same condition as when the same were entered upon. Lessee shall be responsible for repairs to the doors, windows, floor and interior of the leased premises. Lessor shall complete repairs on the roof of the leased premises, so that leakage is eliminated. Future repairs shall be mutually discussed and agreed upon as the need arises. 6. That the lessor shall carry insurance on the ex- terior of the building and the surrounding area. That the lessee shall carry insurance on the interior of the structure and will be responsible for activities within the building. 7. That at the option of lessee this lease may be automatically renewed upon the same terms and conditions, upon tender of the annual rent, without further action of the parties for a term of one year at the expiration of the primary term hereof, and may each year thereafter at the lessee's option be so renewed upon the same terms and conditions for additional terms of one year, not to exceed five such renewals. 8. That at the option of either party, this lease agree- ment may be terminated on 90 days notice upon cancellation or other termination of the agreement between the parties hereto concerning supplying of water by the Town of Eagle to the County Fairgrounds. Done this 15th day of December 1977.
