HomeMy WebLinkAboutMinutes 07/21/15 PUBLIC HEARING July 21, 2015 Present: Kathy Chandler-Henry Chairman Jeanne McQueeney Commissioner Jillian Ryan Commissioner Brent McFall County Manager Bryan Treu County Attorney Teak Simonton Clerk to the Board This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Commissioner Update Chairman Chandler Henry asked for commissioner updates. Commissioner McQueeney announced that the Women's Foundation luncheon was August 12th and encouraged participation. Commissioner Ryan spoke about the Transportation Committee presentation she and Eva Wilson had recently attended. The state had a$1,000,000,000 shortfall for transportation projects. The Tabor Amendment limited revenue that the state could take in. In most years, CDOT did not receive any state general funds, and the gas tax hasn't been increased in many years. There was data that showed the need for rural area improvements due to economic impact produced from the resort areas. Eagle County has subsidized local roads and bridges to the tune of more than$6,000,000 in recent years. They asked CDOT to continue funding I-70 maintenance to keep the highway open during winter,high revenue producing months. Chairman Chandler—Henry reminded everyone that the Fair and Rodeo would be beginning this week. The Eagle River Center would have displays and contests. Habitat for Humanity was starting a building project in Eagle and she encouraged community members to participate. Consent Agenda Chairman Chandler-Henry stated the first item before the Board was the Consent Agenda as follows: 1. Resolution 2015-060 Approving the VIA Planned Unit Development(PUD),Zone Change and 1041 (Eagle County File No(s).PDSP-5266, ZC-5270 and 1041-5267) Sean Hanagan, Planning 2. Final Settlement of Contract between Eagle County and Frontier Paving, Inc. for the Base and Paving Project,Phase II, of the Gypsum to Dotsero Trail Ellie Caryl, ECO Trails 3. Grant Agreement between Eagle County and the State of Colorado Department of Local Affairs for the Community Service Block Grant(CSBG) for Services and Assistance to Low Income Families and Individuals Sarah Luben,Human Services 4. Memorandum of Understanding between Eagle County and the State Department of Human Services, Division of Early Care and Learning, for Additional Funding for the Child Care Assistance Program Megan Burch, Human Services 1 07/21/2015 5. Memorandum of Understanding between Eagle County and the State of Colorado Department of Human Services for Child Welfare Family Engagement Kendra Schleff, Human Services 6. Amended Final Plat for Emma Farms to Eliminate the Lot Lines Creating Lots 3,4, 5, and 6 Together with Certain Easements,and to Establish a Legal Description for a Conservation Easement. (Eagle County File No.AFP-5547) Sean Hanagan, Planning Commissioner McQueeney moved to approve the Consent Agenda for July 21, 2015, as presented, excluding item 6. Commissioner Ryan seconded the motion. The vote was declared unanimous. Amended Final Plat for Emma Farms to Eliminate the Lot Lines Creating Lots 3,4, 5, and 6 Together with Certain Easements, and to Establish a Legal Description for a Conservation Easement. (Eagle County File No. AFP-5547) Sean Hanagan,Planning Diane Mauriello presented the basis for the requested approval. This was the final piece for the open space project required prior to closing. The plat would remove certain development parcels and create an open space parcel. There were two conservation easements presently existing. Tom Waldeck stated that they started the project 12 years ago and this finalized that 95%of the ranch which would now be in a conservation easement. All of the land that represents the valley named Emma has been almost 100%conserved on both the Eagle and Pitkin county sides. This was the last piece to consolidate this effort. He thanked the board and staff for their efforts. Commissioner Ryan moved to approve the a Amended Final Plat for Emma Farms to Eliminate the Lot Lines Creating Lots 3,4, 5, and 6 Together with Certain Easements,and to Establish a Legal Description for a Conservation Easement. (Eagle County File No. AFP-5547). Commissioner McQueeney seconded the motion. The vote was declared unanimous. Citizen Input Chairman Chandler-Henry opened and closed citizen input, as there was none. Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and re- convene as the Eagle County Board of Equalization. Commissioner Ryan seconded the motion. The vote was declared unanimous. Board of Equalization 7. Resolution 2015-061 Concerning Change in Value in Accordance with Recommendation of Eagle County Assessor Mark Chapin,County Assessor 2 07/21/2015 Mr. Chapin explained that one lot was missed during the re-appraisal process and he was asking the board to increase this specific property to bring it into line with current market pricing. Commissioner Ryan moved to approve the resolution concerning change in value in accordance with recommendation of the Eagle County Assessor. Commissioner McQueeney seconded the motion. The vote was declared unanimous. 8. Resolution 2015-062 Regarding Petitions to the County Board of Equalization Christina Hooper,Assistant County Attorney Ms. Hooper explained that this was the second step in the protest and adjustment process. There had been hearing officers here for the last two weeks hearing appeals. There were 65 recommendations; 14 for adjustment, 34 for denial of appeal and 14 stipulations and 3 withdrawals. Each taxpayer would receive letters outlining options for further appeal. Commissioner McQueeney moved to approve the resolution regarding petitions to the County Board of Equalization. Commissioner Ryan seconded the motion. The vote was declared unanimous. Commissioner Ryan moved to adjourn as the Eagle County Board of Equalization and re-convene as the Eagle County Local Liquor Licensing Authority. Commissioner Ryan seconded the motion. All the necessary fees have been paid. An Alcohol Management Plan is on file and proof of server training has been provided. 10. Rink Productions,Inc. d/b/a Rink Productions #26-25945-0000 Permit Application/Temporary Modification—Inclusion of property for Oktoberfest 2015 scheduled for September 5 and September 6, 2015. Commissioner McQueeney moved that the Board approve the Liquor Consent Agenda for July 21,2015, as presented. Commissioner Ryan seconded the motion. The vote was declared unanimous. Other Liquor Business 15. Transfer—RRRevolution,LLC DBA Revolution Rotisserie Restaurant APPLICANT: RRRevolution, LLC TRADE NAME: Revolution Rotisserie Restaurant REPRESENTATIVE: Riley Romanin, Owner LOCATION: 26 Avondale Lane—Beaver Creek, 81620 REQUEST: Transfer of Ownership STAFF REPRESENTATIVE: Kathy Scriver CONCERNS/ISSUES: None DESCRIPTION: The applicant has requested the transfer of a Hotel and Restaurant Liquor License. Enterprise Hotels of Colorado, Inc. d/b/a Rocks Modern Grill currently holds the license. The applicant took possession of the premises in May and is currently operating under a Temporary Permit issued by the Local Licensing Authority on March 19, 2015. Mr. Romanin is also the owner of Hooked, a restaurant located in the Beaver Creek Plaza. LIQUOR AUTHORITY CONSIDERATIONS: 1. Whether the fees have been paid. 2. Whether the applicants are of good moral character 3. If applicant plans to make any physical change, alteration or modification of the licensed premises,whether the premises, and if changed, altered or modified,will meet all of the pertinent requirements of the Colorado Liquor or Beer Codes, including,but not limited to the following factors: a. the reasonable requirements of the neighborhood and the desires of the adult inhabitants; b. the possession,by the licensee, of the changed premises by ownership, lease,rental or other arrangement; c. compliance with the applicable zoning laws of the county; and 4 07/21/2015 d. compliance with the distance prohibition in regard to any public or parochial school. STAFF FINDINGS: 1. This application is in order,all applicable requirements have been met, all the proper forms have been provided, and all fees have been paid. 2. The state and local licensing authorities have previously licensed the premises where such alcohol beverages will be sold and such licenses were valid at the time the application for transfer of ownership was filed with the local licensing authority. 3. The applicant is reported to be of good moral character. 4. The Affidavit of Transfer and Statement of Compliance has been received. 5. The applicant is over 21 and fingerprints are on file. 6. Public notice was given by the posting of a sign in a conspicuous place on the premises July 10, 2015, at least 10 days prior to the hearing. 7. Publication is not required for a transfer of ownership. 8. The applicant does not wish to make any physical changes, alterations, or modifications to the licensed premises, which would alter the licensed premises, or the usage of the licensed premises. CONCLUSION: The applicant has met all the necessary requirements for a transfer of ownership and all findings are positive. DISCUSSION: Ms. Scriver provided some details. The restaurant encompassed the entire Beaver Creek Lodge. Riley Romanin explained that it was a memorable experience theme restaurant. They would serve breakfast and dinner. Lunch would be added in the winter and it would be a buffet style Brazilian steak house. Commissioner Ryan moved that the Local Liquor Licensing Authority approve the transfer of a Hotel and Restaurant license currently held by Enterprise Hotels of Colorado,Inc. d/b/a Rocks Modern Grill to RRRevolution, LLC d/b/a Revolution Rotisserie Restaurant. Commissioner McQueeney seconded the motion. The vote was declared unanimous. 16. Special Event Permit—Crawlin' to a Cure APPLICANT: Crawlin' to a Cure REQUEST: Special Events Permit EVENT: Jeep Crawl Annual Fundraiser DATE OF EVENT: Saturday-August 8, 2015 REPRESENTATIVE: Vikki Hobbs,Event Manager LOCATION: Eagle County Fairgrounds—0426 Fairgrounds Road,Eagle STAFF REPRESENTATIVE: Kathy Scriver DESCRIPTION: The applicant has requested a permit for their annual fundraiser being held at the Eagle County Fairgrounds on Saturday, August 8,2015 from 4 pm to 11 pm. Keg beer will be available for purchase in 12 oz. 5 07/21/2015 plastic cups. Food vendors include Pazzo's Pizza, Smokin J BBQ, and the Potato Guy. Citadel Security will be providing a minimum of 10 roving security officers. The applicant expects 1,500—2,500 attendees. STAFF FINDINGS: 1. The applicant has submitted all the required documents and associated fees. 2. Public notice was given by posting a sign in a conspicuous place on the premises on July 10, 2015, at least 10 days prior to the hearing. 3. No protests have been received in the Clerk's Office. 4. The applicant has provided an alcohol management plan,proof of server training and properly notified the Eagle County Sheriff's Department per the requirements of the Eagle County Local Licensing Authority. DISCUSSION: Ms. Scriver explained the event. Vikki Hobbs spoke about a course that they built at the Fairgrounds. All proceeds from driver registration went to scholarships. The scholarships were for children or their family members impacted by cancer to help pay for college. The organization was located out of Ms.Hobb's home and her family came up with the event to help people in need. They had other fundraisers in other counties. This would be the fifth year for the event. Commissioner McQueeney moved that the Local Liquor Licensing Authority approve the Special Event Permit application for the Crawlin' for a Cure event being held at the Eagle County Fairgrounds on Saturday— August 8, 2015 from*4:00 p.m.— 11:00 p.m. Commissioner Ryan seconded the motion. The vote was declared unanimous. *The hours approved in the motion are the hours requested on the application and are not necessarily the hours of the event. 17. Special Event Permit—Realm of Caring,Inc. APPLICANT: Realm of Caring,Inc. REQUEST: Special Event Permits EVENT: Yarmony Grass Festival DATE OF EVENT: Thursday thru Sunday,August 13 - 16, 2015 REPRESENTATIVE: Jake Wolf,Realm of Caring Chris Thompson, Coral Creek Music Productions. LOCATION: Ranch Del Rio-4199 Trough Road,Bond STAFF REPRESENTATIVE: Kathy Scriver STAFF CONCERNS/ISSUES: None DESCRIPTION: The applicant has requested three (3) permits for a four(4) day music event being held at Rancho Del Rio in Bond on the following days: Thursday,August 13 (No Alcohol Sales) Friday,August 14 from 10 a.m.to 2 a.m. (August 15) Saturday, August 15 from 10 a.m. to 2 a.m. (August 16) Sunday,August 16 from 10 a.m.to 11 p.m. This is a family friendly event. On-site camping is encouraged and included with the purchase of a festival pass. The applicant hopes to attract 1,000 attendees daily. Lonestar Security and staff will control the front gate and bar entrance. There will be at least 4-6 licensed food vendors within the concert venue. 6 07/21/2015 STAFF FINDINGS: 1. An Events Limited Review Application(LR-5534), which allows for mass gatherings over 500 has been reviewed and approved by the Eagle County Community Development Director. 4. The applicant has provided an alcohol management plan,proof of server training and properly notified the Eagle County Sheriff's Office per the requirements of the Eagle County Local Liquor Licensing Authority. DISCUSSION: Ms. Scriver presented some details for the request. They hope to attract about 1000 people each day. There will be four to six licensed food vendors within the licensed liquor service area. Michael Welle has been contracted to help the organizers at Rancho Del Rio. He was happy to be a part of the event. Jake Wolf hoped to have more focus to music education for kids. There would be kid's performances. He hoped this would be the best year. Realm of Caring started in 2005 and 2006 to subsidize musical instruments for underprivileged kids. Realmofcaring.org was the correct organization and the mission would be available on that website,not the website listed in the alcohol management plan. Commissioner McQueeney stated that she didn't think it had bearing on approving the special events permit. Commissioner McQueeney moved that the Local Liquor Licensing Authority approve the Special Event Permit application submitted by Realm of Caring, Inc. for an event being held at Rancho Del Rio in Bond on: Friday,August 14 from 10 a.m. to 2 a.m. (August 15) Saturday,August 15 from 10 a.m.to 2 a.m. (August 16) Sunday,August 16 from 10 a.m. to 11 p.m. Commissioner Ryan seconded the motion.
