Colorado had an 11%recycling rate and Eagle County had a 24%recycling rate. She believed that the community could do so much to keep items out of the landfill. Katie Haas stated that the Work Well Collaborative was possible through a grant received from the Colorado Department of Public Health and Environment. The program was funded by a three year grant and increased the capacity for worksite wellness programing. They would be working with the Health Links program that provided expert advising, certification,kick start funding and other resources. There would be extensive evaluation involved. They were currently working with about 15 employers in Eagle County. Ms. Caryl provided an update on the Gypsum to Dotsero trail. The trail extended from central Gypsum and connected with five river access sites. The Eagle County Road and Bridge Department were the primary constructors of the 2.2 miles completed. Subdivision History: 26 06/09/2015 In October of 1974, when Eagle County initially adopted and enacted zoning, the subject property was assigned the zone district designation of Residential Suburban Medium Density(RSM). Highland Meadows was originally subdivided by plat in 1978 under Reception No. 167543. The total land area was 53.45 acres and was slated for 84 duplex units on 29.58 acres, 150 apartment units on 7.65 acres, 12.16 acres of open space and 4.06 acres for roads. In 1981, the West Vail Area, including the Highland Meadows subdivision, was annexed to the Town of Vail with documentation under Reception No. 211362. However, the annexation was found invalid in the Colorado Court of Appeals under Case No. 84CA0737. In 1985, the Board of County Commissioners adopted temporary Land Use Regulations for the West Vail area pending the study and enactment of Permanent Land Use Regulations. This Resolution No. 85-50, under reception number 320258, recognized the Colorado Court of Appeals decision dated, August 15, 1985, that the annexation proceedings by the Town of Vail involving the area known as "West Vail" were invalid. The Town of Vail elected not to further appeal the decision regarding the annexation of West Vail, therefore the West Vail area was instantaneously deemed under the jurisdiction of Eagle County. The entire area was given the zoning designation of RSM. Current Zoning and Conditions: Both properties are zoned RSM and the Floor Area Ratio Standards of the RSM Zone District would not allow for additional square footage to be added to either side of the duplex unit. Therefore, the Applicant is proposing to incorporate 2020 Meadowbrook Drive to create a larger lot for future expansion for the B side of the duplex unit. All Dimensional Limitations and Improvement Standards for the RSM Zone District will be met. SUMMARY OF REQUEST The purpose of this application is to request a second,two-year extension for the Eagle River Meadows Sketch Plan for Planned Unit Development (PUD) originally approved in February, 2011. The Sketch Plan proposed 240 dwelling units and 261,000 square feet of medical, health and wellness-related service uses, including support commercial uses on 105 acres located just west of the Eagle River Preserve Property in the Edwards area of unincorporated Eagle County. This is the second extension request for the Sketch Plan, the first being approved in January, 2013 (R.esolution No. 2013-007 is attached for reference). As discussed under Section III — Findings, below, the Applicant for an extension request must satisfactorily demonstrate that the following conditions exist with regard to a failure to bring forth a Preliminary Plan application: a. That conditions prohibiting development of the Preliminary Plan were beyond the applicant's control; b. That the development complies with these Land Use Regulations and the Comprehensive Plan; and c. That there is a reasonable likelihood the next step in the development application will be submitted in the next two (2)years." Staff believes that one or more of the above criteria or standards can be met. The remainder of this report provides a brief background and chronology section, followed by discussion of the issues surrounding the extension request, a section describing the `effect' of a Sketch Plan approval, as well as a summary of suggested findings. II. BACKGROUND,DISCUSSION&EFFECT OF SKETCH PLAN Background The Applicant received approval, with twenty-four (24) conditions, in February, 2011 (File No. PDS-2313), for a Sketch Plan for Planned Unit Development on the former`B&B Gravel Mine" site located along the Eagle River, in Edwards. Since the time of original approval, the property has changed ownership. Specifically, the property owner at the time of Sketch Plan approval (BWAB-REEF)relinquished the property to a passive lender(Eagle River Meadows, LLC.) during the economic downturn. The new owner was not previously involved in the Sketch Plan process for the property. 29 06/09/2015 This transition in ownership (and the ability of new ownership to become familiar with previous approvals and conditions)took significant time and effectively precluded the proper development of the Preliminary Plan for PUD during the initial two (2) year period in which the Sketch Plan approval was valid. Likewise, national, state and local economic and market trends during that time made development of the Preliminary Plan - where detailed information regarding real estate product mix, phasing and financing is developed to support a finding of need, compatibility and conformance with Sketch Plan conditions — difficult, at best. This precipitated a request in late 2012 for a two year extension to the Sketch Plan approval, effectively extending approval until February 1, 2013. Despite the allotted two-year extension, economic conditions, as well as ongoing uncertainty in lending and recovering market conditions —particularly the local real estate markets—continue to pose significant challenges for the development of a Preliminary Plan that responds accurately to community need and market demand. For these reasons, the Owner has retained the services of Brian Judge, Vail Architecture Group, Inc., to continue working to address conditions of approval and to further the development of a Preliminary Plan. As described in the request for an additional extension(attached): "As previously addressed, we continue to work as a team to review phasing, utility infrastructure, import and fill, water availabilities, market conditions and demands, partnerships and the statements and concerns of the applicant and[County]at the time of[original]approval." Staff Discussion A primary component of the Sketch Plan included significant destination medical and wellness uses, or a medical campus, to serve as the anchor of the project. Since the time of original approval, there have been several new proposals for medical services developments in both unincorporated Eagle County or within are towns. For instance, the Vail Valley Medical Center is moving forward on expansion/redevelopment plans for the Hospital facilities in Vail Village, inclusive of nearly 100,000 additional square feet of medical and office/research uses; likewise, the Town of Avon recently approved a new 49,000 square foot medical and medical office facility for medical,medical office and emergency services uses. Staff is of the understanding that the Applicant continues to pursue development partnerships for the development of the medical/commercial, as well as residential uses within the PUD, while state and local economic conditions (including local real estate markets) continue to improve. Specifically, staff is of the understanding that the Applicant proposes to maintain the medical component of the project, but that phasing plans will be revised to focus initially on developing residential uses, while allowing for the provision of`pad ready' sites for medical uses. This is different than what was represented by the previous ownership during the Sketch Plan review; this is also most likely a direct result of significant changes in the national, regional and local economies which, in turn, have had a direct impact on lending and development practices. In response to such conditions, the Applicant has taken a different tact toward carrying forth the original vision for the project—to develop a medical campus combined with residential uses. Specifically, in order to develop medical / commercial sites (or attract commercial-medical developers to the project), the Applicant suggests that infrastructure within the project must be largely developed as part of initial(residential)phases of development, and that development tracts (for medical/destination wellness uses) should essentially be `pad ready.' This would allow the developer to partner with medical providers and commercial interests without structuring up-front infrastructure costs into development agreements. The original concept for the project proposed medical and commercial development first, with a major medical "anchor" developing a significant portion of the medical/commercial square footage early in the project. This is likely not realistic any longer, particularly given recent approvals for new or expanded medical,medical research, and medical office uses in the region. For these reasons, staff questions the viability of the medical portion of the Sketch Plan for PUD, at least as originally approved. This is not necessarily a negative aspect, as most PUDs are created to allow flexibility over time to respond to market conditions and community need. The Eagle River Meadows PUD is no different, proposing a range of uses and maximum("up to")residential and commercial square footages. In this context, staff suggests that any downward departure in the total amount of medical/commercial square footage in any future Preliminary Plan application would still comply with the purpose and general development 30 06/09/2015 concepts approved within the Sketch Plan. Further, the Eagle County Land Use Regulations allow for the Director of Community Development to make a determination(at the time of Preliminary Plan submission) as to the degree of conformance with the previously approved Sketch Plan; if the proposed Preliminary Plan deviates substantially from the uses, locations of uses, and/or extent of development proposed during Sketch Plan, the Director could advise the Applicant to essentially begin the PUD review process over with a new Sketch Plan for PUD application. In this sense, the granting of a second extension to the Eagle River Meadows presents minimal risk for Eagle County. If, on the one hand, the Applicant is successful in bringing forth a Preliminary Plan application that largely conforms to previous approvals (while meeting the standards of Eagle County) and is accompanied by fiscal and market analyses, phasing plans and site specific responses to previous conditions of approval — effectively demonstrating that the project is viable and can meet the standards of the County - within the next two years, the extension appears reasonable in light of overarching goals and policies of the Eagle County Comprehensive Plan with regard to economic development and diversification, and general development (locating development within or near existing community centers). On the other hand, if such Preliminary Plan application does not materialize within the next two years, staff suggests that no particular harm has been done with regard to impacting the timing of other projects in the area, or the goals and policies of Eagle County. With that said, staff believes that the medical campus (with"anchor")concept approved during Sketch Plan review should not be overlooked; the focus of the Sketch Plan concept was clearly on creating such campus as a means to diversify the local economy, to potentially bring living wage jobs to the area, to meet identified community needs in the mid-valley portion of the Eagle River Valley for medical services as well as medical office space for medical professionals, and to support a major goal of the then Eagle County Economic Development Plan—to promote and encourage medical research and medical(destination wellness) tourism. Therefore, it is incumbent on the Applicant to demonstrate that that there is a reasonable likelihood that the Preliminary Plan can be completed within the allotted two year time period, and that such Preliminary Plan maintain the core concepts of the Sketch Plan for a medical campus. Additionally, as approved, the Sketch Plan included twenty-four (24) conditions of approval; several conditions are still germane, while others may be more difficult to address based on a number of factors (change in circumstances, changes in County policies), most of which are outside the control of the Applicant. Nevertheless, the Applicant will be responsible for demonstrating that: 1. The project still meets the standards of the ECLURs and applicable Comprehensive plan documents (inclusive of a new Edwards Area Community Plan expected to be completed and adopted by the end of 2015),and; 2. The conditions of Sketch Plan approval can be satisfactorily addressed. The Effect of the Sketch Plan and Extension Pursuant to the Eagle County Land Use Regulations, Sketch Plans are valid for two (2) years from the time of approval. Specifically, an Applicant must act to submit the Preliminary Plan within such two (2) year period, or request another extension prior the expiration of the two-year time frame. In this case, the Sketch Plan was originally granted on February 1, 2011 was valid until February 1, 2013; a two-year extension granted in 2013 was slated to expire on February 1, 2015, however the Applicant submitted a request for (2m1) extension within the timeframe allotted. (It has taken several months to work with the Applicant through the sufficiency review and referral process, and to find an appropriate hearing date.) A second extension, if granted,will extend the Sketch Plan approval until February 1,2017. There is no limit stated within the ECLURs as to the number of extensions that may be granted for a Sketch Plan for PUD, and all original conditions of approval (as listed on the attached resolutions) will remain in full effect upon any approval of an extension. III. FINDINGS 31 06/09/2015 Pursuant to Section 5-240.F.2.e(4)—Extension, of the ECLURs, the Board of County Commissioners must find as follows: "Approval of a Sketch Plan for PUD shall be voided and extinguished unless the applicant can demonstrate by competent substantial evidence that failure to proceed with the development of the application was: a. Beyond the applicant's control; b. The development complies with these Land Use Regulations and the Comprehensive Plan; and c. There is a reasonable likelihood the next step in the development application will be submitted in the next two (2)years. " In this case, staff believes the Applicant has provided evidence to support each of the necessary findings, particularly items "a" and "b." However, the Board of County Commissioners may desire additional information to support a positive finding for item"c." IV. BOARD OF COUNTY COMMISSIONERS OPTIONS: 1. APPROVE PR-5295 with or without conditions if it is determined that the petition DOES meet the standards outlined in Section 5-250.E.3(b) 2. DENY PR-5295 if it is determined that the petition DOES NOT meet the standards outlined in Section 5-250.E.3(b) 3. TABLE the PR-5295 if additional information is required to fully evaluate the petition. Give specific direction to the petitioner and staff. DISCUSSION: Mr. Mr. Hunn presented the request. The Planned Unit Development sketch plan was originally approved in 2009. This was the second request for a two-year extension. All of the original 24 conditions of approval would remain in effect. The project went through a change of ownership and complicated the process. The applicant had worked on resolving some of the conditions of approval. He introduced Brian Judge and Otis Moore. Mr. Judge provided a brief history of the project. He spoke about the influences beyond the applicant's control such asthe global and local housing markets, local and national lending availability and economic factors including employment trends that had impacted the overall project. The development complied with the Land Use Regulations and Comprehensive Plan. The applicant reached out to community partners that shared interest in the project. They believed the project had a community benefit associated with the medical aspects. The 24 conditions still needed to be addressed but he believed and of the issues could be resolved. The applicant believed there was a reasonable likelihood the development would be submitted within the next two (2)years. It was a debt free parcel. Since 2013 they raised funds to carry and maintain the property. The team had continued with ongoing and detailed negotiations with numerous potential medical and tourism providers. Their primary focus was on the economic viability, possibly smaller density and scale and"phased" infrastructure. The applicant wished for the opportunity to continue. Mr.Moore spoke about the benefits of having an approved sketch plan. There would be some flexibility. Commissioner McQueeney asked about the sketch plan and the layout of residential structures and medical portion. Mr. Judge stated that the designation was never prescribed in the plan. There would be 261,000 square feet of commercial,retail and medical. Commissioner McQueeney asked, if since the last extension,any of the 24 conditions had been addressed. Mr. Judge stated that they focused on two or three of the conditions. He believed their predecessor agreed to everything just to get something done and move forward. Many of the terms and conditions were very broad. Mr. Hunn noted that that all the conditions were crafted mutually between staff and the previous property owner and needed to be met. 32 06/09/2015 Mr.Judge stated that he was not making light of the conditions but believed the conditions were further down the line but he was confident they could satisfy them. Chairman Chandler-Henry wondered why the applicant was looking for an extension rather than corning back with a new plan and zero conditions. Mr.Judge stated that they believed in the project and that it had value. Mr. Hunn stated that the expiration date February 1, 2015 but staff received a request for extension 30 days prior. If an extension were granted it would be retroactive to February 2015. Chairman Chandler-Henry didn't see that the circumstances hadn't changed much between 2011 and 2013 and 2015. Mr. Judge believed there was limited focus on the project prior. Since the last extension the property had stabilized and lending markets were favorable. They were focusing on a"phased plan". Commissioner McQueeney wondered how much the plan would change within the two years. Mr. Judge stated that investors were looking for shovel ready projects that could be capitalized on in a short period of time. He believed that the larger building components could break up into smaller pieces in order to be phased. The main focus would still be live-work and medical components. Chairman Chandler-Henry opened and closed public comment, as there was none. Chairman Chandler-Henry was challenged with the flux of the project. There were no specific plans and there were still 24 conditions of approval. She thought it might be beneficial to begin with a clean slate. Commissioner McQueeney was not confident that the conditions would be met or the economic situation would be resolved within two years. Chairman Chandler-Henry wondered if the applicant was working with the Edwards Area Community plan as it moved forward. Mr. Judge stated that they attended the meetings and were active participants. They expected to present an economically and executable viable project. Many of the conditions were standard. Chairman Chandler-Henry wondered about the viability of future projects and if the sketch plan was not extended. Mr. Hunn believed it had a lot to do with the Edwards Community Plan update. It was unknown whether there was a need for this type of market. The conditions were specific to this parcel and its potential impact on roadways and road improvements over time. The existing future land use map did not identify any development on the north side of the parcel. He believed a lot of things could change. There may or may not be a market for the same amount of commercial. If the sketch plan was not extended the board would consider a new sketch plan. As with other PUD projects moving from sketch plan to preliminary plan,things were changing from a phasing plan. Mr. Treu believed it boiled down to getting the preliminary plan submitted in two years considering all the work that still needed to be done. Commissioner McQueeney believed the conditions would take time and didn't believe it was reasonable to think it would happen in the next two years. Chairman Chandler-Henry stated that the board had three standards to consider and believed the applicant had only met one Mr. Judge believed the project had merit and it gave their partner some assurance. It would set the project back significantly to start over As it was now it gave them a basis of what the costs were Chairman Chandler-Henry stated that she was not willing;tq`aite yes at this time. The conditions were tied to a plan that did not work economically. Mr.Treu stated that the question was whether the applicant could act within the two year time line. Mr. Judge stated that they were actively partnering and looking to partner with vertical developers. The plan that came back would be an integrated approach to delivering methods within a two year timeline that made economic sense. Commissioner McQueeney believed the applicant was still at the starting gate and did not meet the three standards. Mr. Judge requested a tabling. Chairman Chandler-Henry asked the applicant to consider the three requirements because as of today those standards had not been met. Mr. Hunn made it clear he did not want to negotiate the conditions when considering an extension. 33 06/09/2015 Chairman Chandler-Henry stated that she was looking for some certainty that the next plan would be submitted in two years. Commissioner McQueeney encouraged the applicant to consider the Edwards Land Use map and think about a sketch plan that made sense in 2015. Commissioner McQueeney moved to table the file no.AFP-5080 to receive additional information. Chairman Chandler-Henry seconded the motion. Of the two voting Commissioners, the vote was declared unanimous.
