This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Chairman Chandler-Henry welcomed all the third graders from Eagle Valley Elementary School.
1. Resolution 2015-026 Designating the Week of April 20 - 24, 2015 as Earth.
Awareness Week
John Gitchell,Environmental Sustainability
Ray Merry spoke about the county's goals towards environmental sustainability and stewardship. The year
2020 would be the 50th anniversary of the first Earth Day. He acknowledged the Board of County Commissioners
for their commitment to environmental excellence. This was a time to reflect on what's been learned in the past.
Commissioner Ryan stated that there would be a ribbon cutting on the new county solar system. She
thanked staff for their leadership,providing environmental policy and management systems. She read the
resolution into the record.
RESOLUTION DESIGNATING THE WEEK
OF APRIL 20-24,2015 AS "EARTH AWARENESS WEEK"
WHEREAS,the decisions we make as individuals and as an organization have direct and indirect impacts
on environmental health and sustainability; and
WHEREAS,the citizens of Eagle County want the quality of our environment to be sustained for present
and future generations; and
WHEREAS,the Board of County Commissioners of Eagle County(hereinafter the"Board") considers
preservation and enhancement of the natural environment a top priority to ensure the health, safety,welfare, and
economic well-being of its citizens; and
WHEREAS,Eagle County Government is developing an environmental policy and management system to
continuously improve our environmental performance by establishing baseline measurements and implementing
action plans that promote clean air and reduce our greenhouse gas emissions from fossil fuel consumption;
conserve water; reduce paper use; promote waste diversion and recycling; and to incorporate clean, renewable
energy to support our county operations; and
WHEREAS,Eagle County Government is committed to conduct ongoing monitoring and reviews of our
processes as part of our environmental management system to assure our actions align with our environmental
objectives; and to remain compliant with all applicable environmental regulations; and
WHEREAS,Eagle County Government has established a cross-functional environmental working group
referred to as our"Actively Green Team"to implement the environmental management system; and

WHEREAS,April 22,2014 marks the forty-fourth(44th) anniversary of the first Earth Day, a day
established to increase environmental awareness and cause individuals to consider how their individual actions
affect the environment; and
WHEREAS,there are also global efforts to involve communities in the celebration of Earth Day through
special events,media coverage and local efforts; and
WHEREAS,designating a week in April as Earth Awareness Week is one of the many ways that Eagle
County government can promote environmental awareness and education through community outreach.
NOW,THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT,the week of April 20 -24, 2015 be designated Earth Awareness Week.
THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the public
health, safety and welfare of the residents of the County of Eagle, State of Colorado.
Commissioner Ryan moved to approve the resolution designating the Week of April 20 -24, 2015 as Earth
Awareness Week.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
2. Resolution 2015-027 Designating the Week of April 19 - 25, 2015 as National
Crime Victims' Rights Week
Deena Ezzell, Sheriff's Office
Ms. Ezzell stated that since 1981,National Crime Victims' Rights Week has challenged the nation to
confront and move barriers to full justice for all victims of crime. Each year, communities across the country
revisit the history of the victims' rights movement and recommit themselves to advancing the progress already
achieved. Eagle County has issued an annual proclamation for most of the last 15 years.

National Crime Victims' Rights Week
WHEREAS,Americans are victims of more than 26 million crimes each year, and each crime affects
many more family members, friends,neighbors and co-workers;and
WHEREAS,crime can leave a lasting physical, emotional, or financial impact on people of all ages and
abilities, and of all economic,racial, and social backgrounds; and
WHEREAS,victims' rights are a critical component of the promise of"justice for all,"the foundation for
our system of justice in America; and
WHEREAS,Victims know best how to direct and manage their own lives, and true recovery from crime
will incorporate a victim's cultural,religious, economic, social, and personal interests; and

WHEREAS, with the full weight of their community and victim service providers behind them, survivors
will feel empowered to face their grief,loss, fear, anger, and shame,without fear of judgment and will feel
understood and worthy of support; and
WHEREAS,National Crime Victims' Rights Week, April 19—25, 2015,provides an opportunity to
celebrate the energy, creativity, and commitment that launched the victims' rights movement, inspired its progress,
and continues to advance the cause of justice for crime victims; and
WHEREAS,today thousands of victim assistance programs provide help and support to child victims of
violence and sexual abuse; stalking victims; survivors of homicide victims; victims of drunk-driving crashes; and
victims of domestic, dating, and sexual violence and other crimes; and
WHEREAS,observing victims' rights and treating victims with dignity and respect serves the public
interest by engaging victims in the justice system, inspiring respect for public authorities, and promoting confidence
in public safety; and
WHEREAS,the Eagle County Sheriff's Office is joining forces with victim service programs, other
criminal justice officials,and concerned citizens throughout Eagle County and America to raise awareness about
victims' rights and observe National Crime Victim' Rights Week.
NOW,THEREFORE,THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
EAGLE, STATE OF COLORADO does hereby proclaim the week of April 19 -April 25, 2015,as Crime Victims'
Rights Week and reaffirms this County's commitment to respect and enforce victims' rights and address their
needs throughout the year. We express our appreciation for those victims and crime survivors who have turned
personal tragedy into a motivating force to improve our response to crime victims and build a more just community.
THAT, the Board hereby finds, determines and declares that this Resolution is an important
acknowledgement for the health and safety of the public in the County of Eagle, State of Colorado.
Commissioner McQueeney moved to approve the resolution designating the Week of April 19 -25, 2015
as National Crime Victims' Rights Week.
Commissioner Ryan seconded the motion. The vote was declared unanimous.
Chairman Chandler-Henry thanked all the partner agencies for working on this important issue together. It
made a difference in the community.

Ms. Valdez stated that this was a request to vacate an existing building envelope and replace it with an
amended building envelope. The square footage would not be changing.
Commissioner Ryan moved to approve the Amended Final Plat to Vacate the Existing Building Envelope
and Replace it with an Amended Building Envelope on Cordillera Filing 17, Lot 5,Block 2 (Eagle County File No.
AFP-5306).

14. Resolution 2015-031 Approving Special Use Permit for TNT Botanicals Marijuana Cultivation Facility
(Eagle County File No.ZS-5032)

Mr. Hunn stated that the board acted upon the file January 6, 2015. The facility was located south of
Gypsum.
Commissioner McQueeney moved to approve the resolution Approving Special Use Permit for TNT
Botanicals Marijuana Cultivation Facility(Eagle County File No. ZS-5032).
Commissioner Ryan seconded the motion. The vote was declared unanimous.
Business Items
15. Revision to the Eagle County Environmental Policy Statement
John Gitchell, Sustainable Communities
Mr. Gitchell explained that each year the Policy Statement was reviewed to reflect the values as an
organization. The policy statement was called"Actively Green". The goal was to save 15%by 2015. He read the
statement into the record.
Commissioner Ryan moved to approve the Revision to the Eagle County Environmental Policy Statement
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
He recognized some county employees for their work on various projects, energy efficiency, and highway
clean-up. He also thanked Energy Smart Colorado and Holy Cross Energy for their support. He thanked Adam
Palmer for leading the way on the new solar project. Next year the work plan included a regulatory compliance
audit within the organization, continuing to do events with the Actively Green Culture Group and continuing to
improve buildings and vehicles. He invited everyone to participate in the events scheduled throughout the day.
Chairman Chandler-Henry asked if the county would make its goal.
Mr. Gitchell believed that everyone was doing their best.
Commissioner Ryan appreciated Mr. Gitchell recognizing the employees that went above and beyond their
day jobs. It was great to have a culture of conservation and protecting the environment. The solar array increased
the ante on energy savings.
Mr. Gitchell stated that the solar panels on the roof top would cover about 10%of the total electricity for
the main campus.
16. First Amendment to Agreement between Eagle County and Ruggs Benedict,Inc.for Flooring
Services

Mr. Siebert stated that the amendment would increase the flooring service limit to$60,000 per service in
order to accommodate larger projects.
Commissioner Ryan moved to approve the first amendment to the agreement between Eagle County and
Ruggs Benedict, Inc. for Flooring Services.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
17. Agreement for On-Call Services between Eagle County and Snowbridge,Inc.for Utility and
Vacuuming Services

Mr. Siebert stated that the agreement had been fully budgeted. The services were on-call in nature.
Commissioner McQueeney moved to approve the Agreement for On-Call Services between Eagle County
and Snowbridge, Inc. for Utility and Vacuuming Services.
Commissioner Ryan seconded the motion. The vote was declared unanimous.
18. Sand and Gravel Mining Lease between Eagle County and Oldcastle SW Group,Inc.

Mr. Ullom spoke about the gravel project at the fairgrounds. The original agreement went back to 2010.
The gravel resource under the existing WECMRD ball fields was removed from the lease and other areas of the
property were excluded from the initial operation. $1,750,000 would be returned to Oldcastle SW Group Inc. There
would be an audit once the agreement was signed.
Mr. Treu stated it was a cleanup item.
Commissioner McQueeney moved to approve the Sand and Gravel Mining Lease between Eagle County
and Oldcastle SW Group, Inc.
Commissioner Ryan seconded the motion. The vote was declared unanimous.

I. SUMMARY: The intent of this Minor Type B Subdivision is to further subdivide an existing platted property,
known as Lot 25 in Highland Meadows subdivision. Specifically, Lot 25 is being subdivided into two (2) single
family lots. Access is proposed from Vermont Road. Due to addressing issues with adjacent properties, the two
lots will be known as 2109 A Vermont Road and 2109 B Vermont Road.
Subdivision History:
In October of 1974,when Eagle County initially adopted and enacted zoning,the subject property was
assigned the zone district designation of Residential Suburban Medium Density(RSM).
Highland Meadows was originally subdivided by plat in 1978 under Reception No. 167543.The total land
area was 53.45 acres and was slated for 84 duplex units on 29.58 acres, 150 apartment units on 7.65 acres,
12.16 acres of open space and 4.06 acres for roads.
In 1981,the West Vail Area, including the Highland Meadows subdivision,was annexed to the Town of
Vail with documentation under Reception No. 211362. However,the annexation was found invalid in the
Colorado Court of Appeals under Case No. 84CA0737. In 1985,the Board of County Commissioners
adopted temporary Land Use Regulations for the West Vail area pending the study and enactment of
Permanent Land Use Regulations.This Resolution No. 85-50,under reception number 320258,recognized
the Colorado Court of Appeals decision dated,August 15, 1985,that the annexation proceedings by the
Town of Vail involving the area known as"West Vail"were invalid.
The Town of Vail elected not to further appeal the decision regarding the annexation of West Vail,
therefore the West Vail area was instantaneously deemed under the jurisdiction of Eagle County.The entire
area was given the zoning designation of RSM.
Current Zoning and Conditions:
As such,the site is properly zoned for a single-family structure on each proposed lot and contains adequate
square footage to accommodate the future structures. The maximum allowed density in the RSM zone
district is one residence per 8,000 square feet of lot area. All Dimensional Limitations and Improvement
Standards for the RSM Zone District will be met.

III. STAFF FINDINGS: Pursuant to Section 5-290.G.1 of the Eagle County Land Use Regulations,the
Community Development Director has considered the following in the review of this Type B Minor
Subdivision:
a. Access,Water and Sewage. The access is provided via Vermont Road. Access to potable water
and sewage are public systems and are provide by Eagle River Water and Sanitation District.
b. Conformance with Final Plat Requirements. This Minor B Subdivision is in conformance with the
Final Plat requirements and other applicable regulations,policies, standards, and guidelines; and
c. Improvements Agreements. A Subdivision Improvements Agreement is not applicable.
DISCUSSION:
Ms. Valdez presented the request. The applicant was requesting that lot 25 be subdivided into two single
family lots. Access was already provided by Vermont Road. There were some addressing issues with the parcel
because in 1978 the parcel was assigned a different address. The issue had been resolved with the emergency 911
system. She presented photos of the property and adjacent properties. The request was in conformance with the fmal
plat requirements. Staff recommended approval.
Commissioner Ryan noted for the record that her husband was the project engineer.
Chairman Chandler-Henry asked if there were any comments made by adjacent property owners.
Ms. Valdez indicated that one neighbor wasn't please with the addressing and one neighbor wondered if there
would be two duplexes and if their view corridor would be affected. She indicated that the view corridor would not be
affected and there were similar structures in the neighborhood.
Commissioner Ryan moved that the Board of County Commissioners approve File No. SMB-5323 and
authorize the Chairman to sign the plat.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.

L SUMMARY:
The intent of this Amended Final Plat is to amend the platted building envelope and, specifically, to allow for a
minor addition to the existing single-family residence.

Similar to previously approved building envelope amendments in the Beaver Creek subdivision, the Applicant
proposes to maintain the overall size of the envelope by re-allocating unused square footage from one area of the
envelope,to the area proposed for a minor addition.
The existing residence, constructed in 1988, includes a garage bay and roof-top terrace(above the garage) that was
approved to extend outside of the platted building envelope; such encroachments of non-habitable space outside of
building envelopes are permitted with Design Review Board (DRB) approval. However, the Applicant proposes to
remodel the home specifically to enclose the existing roof-top terrace with habitable space, thus dictating an
amendment to the building envelope.
Likewise, the proposed expansion of the master bedroom (see attached plans, sheet A2.1 and sheet A3.1) and
associated roof overhangs will encroach slightly (by approximately two feet) into an existing easement. The
Applicant has provided a copy of a recently executed Encroachment Agreement (attached) by and between the
Applicant and the Beaver Creek Metropolitan District.
This request has been reviewed but not yet approved by the Beaver Creek Resort Design Review Board. DRB
approval is contingent upon successful completion of the County's process.
And, pursuant to the Planned Unit Development Guide for Beaver Creek Resort, although the Applicant has
provided evidence of support for the proposal from adjacent property owners, this plat must be considered during a
public hearing due to the fact that written letters of approval from each adjacent property owner have not been
received.
A sign has been posted near the front of the property(visible from Holden Road), and mailed notice of the proposal
and hearing date has been sent to each adjacent property owner of record.
In response to public notification, staff has not received any inquiries from any party who may be affected by the
proposed amendment.
Staff Findings and Recommendation
Staff believes the proposed amendment is in keeping with 1) the intent of the original final plat, and 2) the
requirements of the Eagle County Land Use Regulations (ECLURs).
Specifically, staff believes the Amended Final Plat meets each of the following, applicable criteria:
Adjacent property. Staff believes the proposed amendment will not adversely affect any neighboring
property.
Final Plat Consistency. Staff has reviewed the original Final Plat for Filing No. 4, Beaver Creek
Subdivision, and finds that the proposed amendment is consistent with the intent of the original plat.
Conformance with Final Plat Requirements. The Applicant's surveyor has made all necessary revisions
and refinements to the plat document as required by the Eagle County Surveyor, the Eagle County
Engineering Department and the Eagle County Planning Department. Furthermore, the plat has been
reviewed by the Eagle County Attorney's Office for compliance with legal requirements. The plat, as
signed by applicable parties is, therefore, consistent with the intent of the Eagle County Land Use
Regulations.

III. STAFF FINDINGS AND RECOMMENDATION:
Pursuant to Section 5-290.G.3., Standards for Amended Final Plat:
a. Adjacent property. Review of the Amended Final Plat has determined that the proposed
amendment DOES NOT have an adverse effect on adjacent property owners.
b. Final Plat Consistency. Review of the Amended Final Plat has determined that the proposed
amendment IS consistent with the intent of the Final Plat.
c. Conformance with Final Plat Requirements. Review of the Amended Final Plat has determined
that the proposed amendment DOES conform to the Final Plat requirements and other applicable
regulations,policies and guidelines.
d. Improvement Agreement. DOES NOT apply.
e. Restrictive Plat Note Alteration. DOES NOT apply.
DISCUSSION:
Mr. Hunn presented the request. The homeowner was requesting an amendment to the platted building
envelope to allow for the expansion of the master bedroom. The request was conditionally approved by Beaver
Creek Design Review Board. This was a fairly minor alteration. He presented a photo of the residence and the
surrounding area.
Chairman Chandler-Henry wondered if the modification would affect the view corridor for any adjacent
property owners.
Mr. Hunn stated that it would not have any adverse effect on adjacent property owners and the request
conformed to the final plat requirements. Notice was given twice and he had not received a response from anyone.
Typically for this location it was difficult to receive full sign off from adjacent property owners.
Commissioner McQueeney moved that the Eagle County Board of County Commissioners approve the
Amended Final Plat for Lot 40, Filing No. 4, Beaver Creek Subdivision (Eagle County File No. AFP-5341), as
presented,based on its conformance with applicable standards and based on a review of staff findings.
Commissioner Ryan seconded the motion. The vote was declared unanimous.
Special Recognition
Earth Day Poster Contest Winners
John Gitchell, Environmental Sustainability
Adam Palmer stated that this was the 25th Earth Day poster contest. Eagle County employees voted on the
winner. The contest theme this year was"Actively Green for Wildlife Habitat".
Commissioner Ryan welcomed everyone and thanked the participants for their interest in protecting the
environment and wildlife.
Commissioner McQueeney thanked everyone for raising awareness.

Chairman Chandler-Henry quoted Gaylord Nelson"We do not inherit the earth from our ancestors we
borrow it from our children". She thanked everyone for their work on the posters.
Mr. Palmer stated that the poster contest was open to fourth grade students throughout Eagle County.
There were hundreds of posters made. There were 36 finalists being recognized today. He thanked Timberline
Tours, Cliff Simonton,Toby Sprunk,the teachers,and the student artists.
