Commissioner updates
Commissioner Ryan spoke about the Vail Valley Partnership meeting that brought together statewide
philanthropic organizations and community leaders to discuss pressing issues for the county and potential funding
opportunities, such as affordable child care, affordable housing and workforce development. Commissioner
McQueeney also attended the meeting.
Commissioner McQueeney attended the Colorado Fiscal Forum in Summit County last week at which
concern was expressed for the fiscal future.
Chairman Chandler—Henry attended the National Association of Counties, some of the topics included
taxes, rural schools programs,broadband issues,waters of the US, etc.

Mr. Adams spoke to the board. He explained that it was a five(5)year agreement for snow
removal on the Frying Pan River Road. It was in the area of Meredith and Thomasville. Pitkin County was
driving up that road anyway, and as such the agreement made sense.
Commissioner Ryan moved to approve the intergovernmental agreement between Eagle County
and Pitkin County for snow removal in the Frying Pan Valley.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.

Ms. Ryan complimented the quality of the landscaping work.
Mr. Phillips spoke about the upgrading of airport signs as well to improve directional assistance for visitors
and residents.
Ms. Chandler-Henry stated that people love the airport and the proximity to the ski areas.
Mr. Lewis moved to approve the final settlement of contract between Eagle County and Landscape
Technology Group, Inc. for the landscaping and irrigation improvements at the Eagle County Regional Airport
property.
Ms. McQueeney seconded the motion. The vote was declared unanimous.
16. Agreement between Eagle County Air Terminal Corporation and RS&H, Inc. for Terminal and Landside
Area Planning Services

Mr. Phillips stated that the leadership wanted to improve the airport experience for the busiest times. They
wanted to look at conceptual designs for the next phases of growth. There was a contract for professional services
to evaluate and make recommendations regarding future changes. In 2016,with sufficient demand and funding,
there would be design and construction initiated. They hoped to add space without having to raise rates for airport
tenants. One area that needs to be upgraded is the holding area which gets very crowded on the busiest days. The
firm brings great airport experience. The scope of service agreement spelled out deliverables and termination
opportunity for the county. He felt that the contract amount was reasonable. The funds were within the budget.
Mr. Anderson added that the firm had reached out to staff during the process already.
Ms. McQueeney asked about the timelines.
Mr.Phillips stated that it would take about a year to do the design and get a good feel for potential costs. In 2016
there would be another RFQ process to select a design candidate. They anticipate construction in 2017.
Ms. Chandler—Henry asked about the program criteria document.
Mr. Phillips stated that it was a pre-design contract. It would look at the square footage and options. They
anticipate that it was about a$20 million project. This would start the process of getting cost estimates.
Ms.Ryan spoke about how exciting this phase was. Current airport improvements were great in her
opinion, and she appreciated the creativity in how the airport funded these improvements. Taxpayer dollars were
not involved.
Ms. Chairman Chandler—Henry complimented Mr. Phillips on the criteria of"sense of place"as important
in the selection of the architect.

address of the applicant,the names and addresses of the president,vice-president, secretary and
managing officer,the applicant's financial interest in the proposed transfer, and the premises for which
the Temporary Permit is sought.
3. An Affidavit of Transfer that all accounts for alcohol beverages have been paid,has been filed.
4. The application for the Temporary Permit has been filed no later than thirty(30)days after the filing of
the application for the transfer of ownership and the appropriate fees have been paid.
DISCUSSION:
Ms. Scriver explained the request. She introduced the new owner. She had no concerns with the request.
Sarah Millett, former Old Forge Pizza owner stated that the new owner wanted to continue to selling pizza
and would be introducing some regional Mexican specialties too.
Alejandro Flores spoke about offering burritos,tacos, sopas,tamales,mole and came asada,but also
offering liquor all day.

Temporary Permit to Cantina Don Quijote, LLC d/b/a Cantina Don Quijote&Old Forge Pizza which will be

twenty(120) days,whichever occurs first; except that, if the application to transfer the license has not been granted
or denied within the one-hundred-twenty day period and the transferee demonstrates good cause,the local licensing

Mr. Lewis explained that the 2015 budget was approved on December 9,2014,and since then some
additional grant revenue had been received, and there were a number of capital projects that started in 2014,were
still in progress and needed to be carried forward. There were also some additional expenditures that needed to be
made in accordance with the board's strategic priorities. The supplemental included$631,773 of additional new
revenue including$492,000 in the General Fund. Projects and other revenues carried forward from 2014 were
$16,264,775. Funds for projects carried forward and planned for 2014 without corresponding revenue such as
capital improvements,would result in a positive variance in the 2014 budget. $217,166 would be withdrawn from
the budget contingency line item.
Bryan Treu spoke about the approval in a public meeting with the ECO board.

Mr. Lewis stated that there was $5.5 million in Road and Bridge funds alone. He added that this was the
biggest supplemental due to the large amount of grant revenue available. If anyone wanted to see the detail they
could go to the Finance Department page on the website or call Mr.Lewis or Ms.Arndt directly.
Commissioner Ryan moved to approve the first supplemental budget and appropriation of unanticipated
revenues for fiscal year 2015 and authorize the transfer of budgeted and appropriated monies between various
spending agencies.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
Chairman Chandler Henry thanked Rachel Oys for her service to the county as assistant county manager
and subsequently acting county manager. She started in Health and Human Services five years ago. She had great
energy and always had a smile.
Commissioner Ryan spoke about her responsiveness to the Board. A lot had been asked of her,
considering all the hats she wore the last couple of years. Her legacy would include bringing a Federally Qualified
Health Center to the county,which accepted medical patients regardless of ability to pay. She also started the
"Lean"initiative at Eagle County as a formal way for teams to streamline and improve processes. We have already
received positive feedback about this initiative.
Commissioner McQueeney spoke about Rachel's impact on the organization and her help with a new
commissioner's transition. She appreciated Ms. Oy leading by example in all she had done.
Kris Friel thanked Ms. Oys for expecting the best and giving her best.
Mr.Phillips thanked her for analyzing processes and promoting improvement.

I. EXECUTIVE SUMMARY:
Proposed are amendments to the Eagle County Land Use Regulations as it pertains to solar energy system use and
dimensional limitations in unincorporated Eagle County. Currently, solar energy devices up to 80-kw are allowed
as a use by right,where systems over 80-kw require special use review. If approved, the amendment would allow
structure-integrated solar energy systems without limitation in size,as well as ancillary ground-mounted systems
producing up to 120%of the electricity needs on-site, and special use review for solar farms over 80-kw in rural

zone districts and over 10-kw in community centers, suburban, and/or urban areas where solar energy systems are
the primary use on the subject property in unincorporated Eagle County.
II. BACKGROUND
In 2007,the Eagle County Land Use Regulations were amended to include definitions for solar energy devices, and
allowed them as a by-right use up to 80-kW. Any system over 80-kw would require approval of a special use.
Since that time,numerous solar energy systems below the 80-kw size have been installed on homes and businesses,
with little response or concerns raised from the public or adjacent property owners to such systems. For sake of
comparison,the average solar photovoltaic system installed in Holy Cross Energy service territory is 6.1-kw.
Typically, a 4-kw solar photovoltaic can meet the electricity needs of an average home supplied with gas heat.
Eagle County has received two special use applications since 2007: one 200-kw system proposed in El Jebel,and a
300-kw system proposed north of I-70 east of Eagle. Both such projects received approval; however, opportunities
to improve the public hearing and review process were identified through staff evaluation which may be helpful in
the future. Also, inquiries have been received regarding whether or not a solar energy system providing electricity
to their subject electric provider through an agreement could be considered a`utility' identified the need to
incorporate a definition for`utility' into the Eagle County Land Use Regulations.
Eagle County adopted Eco-Build energy-and resource-efficient residential and commercial regulations in 2006
and 2008 respectively. The exterior energy use component of the Eco-Build code requires that snowmelted areas
over 200 ft2, outdoor spas over 64 ft2, and outdoor pools provide at least 50%of the energy needed for the amenity
with onsite renewable energy systems, or pay a mitigation fee into the Eco-Build Fund,which is used to support
energy efficiency and renewable energy projects elsewhere in Eagle County. This program has resulted in the
construction of numerous solar energy systems in response to avoid such fees, as well as generated an average of
$200,000 per year into the Eco-Build Fund,which has supported hundreds of solar and energy efficiency projects in
Eagle County through rebates and community grants.
To date, few complaints have been received by staff regarding visual impacts of solar energy systems. Staff is
aware of a handful of cases where local Home Owner Associations have required landscaping/tree planting to
visually screen residential ground-mounted solar energy systems.
The table below shows the originally proposal for amendment to the land use regulations for reference purposes.
Based on Eagle County Planning Commission and Roaring Fork Valley Regional Planning Commission
recommendations,however, a revised proposed use table is shown later in this report:

At the ECPC hearing February 4, 2015,the file recommendation was to approve with the following amendments:
1. Increase maximum height for small ancillary systems from 8'as proposed to 12'plus additional allowance for
areas with higher average snowpack as a use by right.
2. Reduce aggregate permitting fee caps from$500 and$1000 from state statute to $250 and$500 for residential
and commercial solar energy systems respectively.
ROARING FORK VALLEY REGIONAL PLANNING COMMISSION RECOMMENDATION:
At the RFVRPC hearing February 5,2015, the file recommendation was to approve with the following
amendments:
1. Suggested preamble to state Eagle County's support of progressive regulations which encourage development of
clean renewable energy technologies such as solar, and encourage landowners to accommodate potential neighbor
concerns into design.

2. Strike limit of one non-habitable structure for use-by right structure integrated systems.
3. Increase maximum height for small ancillary systems from 8'as proposed to 18'as a use by right.
4. Reduce aggregate permitting fee caps from$500 and$1000 from state statute to$250 and$500 for residential
and commercial solar energy systems respectively.

5. Strike item 3-310.Bb.b. as proposed to determine adverse visual impact finding due to challenge of subjectivity
and possible redundancy to general special use standards listed in Section 5-250.
6. Strike standard 3-310.Bb.3 d. as proposed which requires a deconstruction /reclamation plan for solar going
through limited review/special use. Such requirements aren't in place for other long-term construction projects.
Many solar energy systems will be in place 50 years or land more,having or enforcing this provision would be
challenging to administer and lacks parity with other uses.
7. Eliminate limited review process for larger ancillary systems and 1000 ft2 threshold. Make all systems up to
120%of on-site energy use offset a use by right in alignment with state net metering requirements.
8. Eliminate 1000 ft2 threshold for solar farms; all commercial-scale solar farms(defined as primary use on the
property and/or system generating beyond 120%on-site use)would require special use as proposed.

Bb. Solar Energy Systems.
Solar Energy Systems able to convert radiant energy from the sun into clean renewable energy are generally
encouraged in Eagle County. It is the goal of this section of the Land Use Regulations to allow for development of
Solar Energy Systems while encouraging responsible design, and providing for appropriate public process when the
scale, location, and/or design presents neighborhood, area, and/or community impacts.
1. All Solar Energy Systems shall incorporate anti-reflectivity coating provided by the manufacturer, as
well as non-reflective materials for racking, structural, and/or other associated equipment.
Concentrated solar devices are prohibited.
2. All Solar Energy Systems shall comply with dimensional limitations articulated Table 3-340, including
height, setback, and lot coverage.

4. Structure-Integrated Solar Energy System. A Structure-Integrated Solar Energy System shall be
allowed as a use by right regardless of production capacity. Such systems shall be incidental to the
primary use of the structure and subject property, and are encouraged to be flush with the roof/top
and/or wall,architecturally integrated, and utilize anti-reflective materials.
5. Ground-Mounted Solar Energy Systems.
a. Ancillary Ground-Mounted Solar Energy Systems 15-feet or less in height measured from the
highest point of the improvement to existing or finished grade,whichever is more restrictive; shall
be allowed as a use by right.
b. Solar Farm. Solar farms over 80-kw rated nameplate capacity or equivalent in rural areas of the
county, and over 10-kw rated nameplate capacity or equivalent in community centers, designated
community buffer areas,and in zone districts articulated in Table 3-300 shall complete a Special
Use Review and approval pursuant to Section 5-250 and Standards identified below in Section 3-
310 Bb.4.
6. Standards. The following standards shall apply to Solar Energy Systems completing special use
review in addition to the standards specified pursuant to Section 5-250 Special Use:
a. Setbacks. All Solar Energy Systems must comply with required height and setback requirements
as defined in Section 3-340.
b. Design minimizes adverse visual impact. The project applicant shall demonstrate through visual
impact analysis,materials, and/or screening to the extent practicable,that the project will not create
adverse visual impact to neighboring properties, surrounding areas,and community buffers as
further detail necessary to support Section 5-250.B.4 Design Minimizes Adverse Impact.

c. Utility grid interconnection. The project applicant shall provide to the County the system design
and interconnection to the grid; and evidence such design has been accepted or approved by the
associated utility provider.
d. Longevity and reclamation. The project applicant shall identify the proposed timeline for its use,
and shall submit a reclamation plan specifying the reclamation of the project site which will occur
upon termination of use.
DEFINITIONS:
To be added to Article 2 Definitions of the Eagle County Land Use Regulations
Ancillary Solar Energy System: Any Solar Energy System which purpose is to provide up to 120%of the energy to
support other structures and/or on-site uses contained upon a subject property. Such systems are incidental to other
primary use(s)on the property and may be structure-integrated or ground-mounted.
Concentrated Solar Device: Solar devices which utilize mirrors, lenses, or reflectors to magnify and/or concentrate
solar rays.
Grid-Tied Solar System: A photovoltaic solar system that is connected to an electric circuit service territory
maintained by an electric utility company.
Ground-mounted solar energy system: A Solar Energy System which is free-standing and constructed upon a
natural and/or improved surface,including but not limited to pedestal mounted collectors,tracking devices,
including associated infrastructure and site improvements.
Off-Grid Solar System: A photovoltaic Solar Energy System in which the circuits energized by the solar system are
not electrically connected in any way to electric circuits that are served by an electric utility company.
Photovoltaic System: An active Solar Energy System that converts solar energy directly into electricity.
Solar Energy System: A system of solar collectors and associated equipment to provide for the collection,
conversion, storage, and transmission of radiant energy from the sun for electricity generation, space heating, space
cooling or water heating.
Solar Thermal system: An active Solar Energy System that converts solar energy into hot air or water.
Solar Farm: Parcel or land area primarily utilized as a Ground-mounted Solar Energy System.
Structure-integrated Solar Energy System: A Solar Energy System which is constructed upon the roof/top and/or
wall of a structure which is incidental to the primary use of the structure,which may include but is not limited to
residential and commercial buildings, carports, and/or shade structures.
Utility or Utility Facility: Any privately,publicly or cooperatively owned line, facility, or system for producing,
transmitting, or distributing communications, cable television,power, electricity, light, heat, gas, oil, crude
products,water, steam,waste, storm water not connected with highway drainage, or any other similar commodity,
including any fire or police signal system or street lighting system,which directly or indirectly serves the public.
The term utility shall also mean the utility company inclusive of any substantially owned or controlled subsidiary.
For the purposes of the Code,the term includes those utility-type facilities which are owned or leased by a

those facilities used solely by the utility which are part of its operating plant. As the context provides,the term

registered with the Colorado Secretary of State as a Special District pursuant to CRS Title 32-1.

Staff Response:
Subarea plans in Eagle County identify and support energy efficiency and renewable energy
implementation. They also identib,preservation of open space agricultural areas and preservation of rural
character in lower density areas of the subarea plans. The draft Land Use Regulation amendment aligns
with these goals to promote solar energy system development, but also provide for a public review and
hearing process to address potential visual impacts and compatibility.

plan which contemplates potential solar upon existing terminal and/or hangar structures.
2. Compatible with Surrounding Uses. The proposed change in zoning is compatible with the
type, intensity, character and scale of existing and permissible land uses surrounding the
subject property. Dimensional limitations of the proposed zone district, when applied, should
result in development that will be harmonious with the physical character of existing or

Staff Response:
The intent of the proposed regulation amendment is to allow structure-integrated and ancillary solar
energy systems as use by right. Staff has researched reflectivity of solar panels extensively. Since solar
panels are designed to absorb radiant energy from the sun rather than reflect it, most photovoltaic and
solar thermal panels have albedo indexes (`albedo index'is a metric of reflectivity)below that of many
roofing materials when anti-reflective coating is utilized. For this reason, structure-integrated or small
ancillary ground-mounted systems utilizing anti-reflective materials are not perceived to create significant
glare or reflectivity to potentially impact adjacent properties and compatibility.
Compatibility and visual impacts of larger solar farms would be a primary determining factor in the revievv
of the special use application, which would be addressed through the standards proposed in Section 3-
310.Bb.4 as well as the special use standards in Section 5-250.

3. Public Benefit. The proposed change in zoning addresses a demonstrated community need or
otherwise result in one or more particular public benefits that offset the impacts of the
proposed uses requested, including but not limited to: Affordable local resident housing;
childcare facilities; transportation efficiencies, public recreational opportunities; infrastructure
improvements; preservation of lands of high conservation value, senior housing, or medical

Staff Response:
Development of solar in Eagle County provides public benefits in clean air and water, economic
development through both retention of utility dollars typically sent elsewhere, as well as recruitment of new
jobs created, and a distributed energy system which supports a more stable diverse grid.
4. Change of Circumstances. The proposal change in zoning addresses or responds to a beneficial
material change that has occurred to the immediate neighborhood or to the greater Eagle

Staff Response:
Since the original solar energy device land use regulation adoption in 2007, hundreds of solar energy
systems have been installed in Eagle County. Few if any complaints have been received for systems
installed in unincorporated Eagle County under the current regulations.
Staff has reviewed two special use applications for large solar farms, as well as had inquiries on the
definition of`utility'as it may pertain to allowed uses on subject parcels or areas thereof restricted for
such utility uses. Response from these special use applications and addition inquiries made the need for
revised regulations for solar energy systems apparent to be able to better direct staff and provide decision
makers improved tools to support such installations where appropriate, and discourage them where they're
not.
5. Adequate Infrastructure. The property subject to the proposed change in zoning is, or may be
served by adequate roads, water, sewer and other public use facilities. (am.04/04/06) (am

Staff Response:
Interconnection to local utility systems is proposed as a standard under Section 3-310.Bb, if and when it is
proposed. In some cases, such systems may be proposed and/or constructed without connection to the
electric or other utility grid.

DISCUSSION:
Mr. Palmer presented a PowerPoint slide show with details about the proposed changes. The attempt was
to simplify and encourage solar panel use. He reviewed the proposed additional standards for solar special use
review.
Chairman Chandler-Henry asked for an example of an adverse visual impact.
Mr. Palmer stated that if there were a solar farm that l impacted the character via a ridgeline or valuable

visual area, on which a solar farm didn't seem to fit,that would be an example.
Chairman Chandler—Henry spoke about this criteria being used as a future objection to a solar farm.
Mr. Palmer stated that it would be subjective as some appreciate the technology and as such think solar
farms look great,but others don't like the industrial look. He reviewed the referral responses, many of which
included valuable comments. He summarized the Eagle County Planning Commission's recommended approval,
which included reducing the permit fees and increasing the by right height to 12 feet,with additional allowance for
areas with higher average snow depth.
Mr. Palmer reviewed the Roaring fork Valley Planning Commission recommendations. He indicated that
staff recommended approval of these changes. The current permit limit was use by right up to 80 kilowatt. The
permit fees were$500 for residential and$1000 for commercial as dictated by state statutes.

Commissioner Ryan commended Mr. Palmer for his work. She wondered if the public still felt there were
too many regulations.
Megan Gilman,Active Energies, stated that largely,their concerns had been addressed.
Mr. Palmer felt that there was a reasonable balance between regulation and promotion through proper tools
for reviewing these types of installations. There were a few examples of use by right installations that were not
visually pleasing to the neighbors in existence today.
Commissioner McQueeney asked about the plan for reclamation. She wondered about abandonment
regulations that would require someone to clean up an existing structure.
Mr.Palmer felt that if any project on a property became defunct there should be some requirement to
address reclamation.
Chairman Chandler—Henry stated that it seemed like an evolution of solar energy rather than a one size
fits all approach. She asked about the ECO build fund and whether there would be any positive or negative impact.
Mr.Palmer didn't anticipate any changes to the fund. He didn't think these regulations should impact
residential systems or where the fees would come from.
Beth Ayres—Oliver stated that the standards of conformance and compatibility with surrounding uses,
change of circumstances, and adequate infrastructure had all been met.
Commissioner McQueeney thanked Mr.Palmer for his efforts to do this in the right way.
Chairman Chandler—Henry thanked him for sending the referral requests to so many community partners.
Commissioner Ryan spoke about environmental stewardship and appreciated the thoughtful and
appropriate approach to this issue.
Commissioner Ryan moved to approve file number LUR-5253/Land Use Regulation Amendment.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
