Commissioner Chandler-Henry thanked staff and welcomed the world to Eagle County. There would be 14 days of races, 70 different countries, 700 athletes,22,000 volunteers, and 750 million people watching worldwide. Commissioner McQueeney added her appreciation. She began her volunteer service tomorrow. Chairman Ryan spoke about the importance of the resolution. She'd been privileged to be the chairman for the last year and would be honored to hand the chairmanship to Commissioner Chandler-Henry. Todd Williams,representing the Edwards Community Authority,thanked the Eagle County Engineering staff for their work on Phase II of the I-70/Spur Road construction. Commissioner Ryan thanked the Edwards Authority for their work and their financial contribution towards the design of the Edwards Spur Road; she felt it had been a really nice partnership. Intergovernmental Agreement Among Eagle County, Edwards Metropolitan District,Berry Creek Metropolitan District,Arrowhead Metropolitan District, Lake Creek Metropolitan District and Edwards Community Authority for the Final Engineering Design of the I-70G Edwards Interchange Upgrade Phase II Eva Wilson, Engineering Ms. Wilson stated that the agreement supported a one million dollar effort to design the phase II project. CDOT was contributing$500,000, Eagle County was contributing$250,000 and Edwards Metropolitan District was matching$250,000. Commissioner McQueeney believed it was an amazing partnership between the state, county, and local entities. Commissioner Chandler-Henry thanked the Edwards Authority for creating an Authority; it was a beneficial to everyone. Commissioner McQueeney moved to approve the Intergovernmental Agreement among Eagle County, Edwards Metropolitan District,Berry Creek Metropolitan District,Arrowhead Metropolitan District, Lake Creek Metropolitan District and Edwards Community Authority for the Final Engineering Design of the I-70G Edwards Interchange Upgrade Phase II. Beer,wine, and other malt beverages will be available for purchase. 4-H volunteers will be stationed at each entrance/exit and bartenders will be checking ID's and wrist banding those 21 years of age and older wishing to purchase alcohol. The applicant hopes to attract 500 attendees. STAFF FINDINGS: 1. Staff had no concerns with the request. Patty Hackman stated that the proceeds went back to 4-H kids in the form of scholarships and awards. 23 02/03/2015 Jenny Wood-Leonetti spoke about the Jr. Livestock Sales Commission. The Commission oversaw the livestock auction at the County Fair and set a lot of the policies for the livestock shows. Ms. Hackman stated that the event was a family affair. All bartenders were professionals.There would me a petting zoo, activities for the children, a live auction,a silent auction and live music. Commissioner Ryan moved that the Local Licensing Authority approve the application for a Special Event Permit for the Rocky Mountain Oyster Fry being held on March 14,2015 from*6:00 pm to 11:59 pm at the Eagle River Center. Project Narrative: The Two Rivers Planned Unit Development(PUD)was approved in 2001.The PUD had two (2)planning areas: Two Rivers Village and Two Rivers.Two Rivers Village is a predominantly residential development south of I-70. Two Rivers, located north of 1-70, contains several residential and/or commercial lots. In 2003,the PUD was amended via Resolution No. 2003-055 to(1)allow townhomes on certain multi-family lots, (2)allow Y2 duplex structures(zero lot lines)on certain adjacent single family lots, (3)correct an error in the PUD Guide regarding maximum lot coverage, [4] reduce the minimum pitch for roofs of garages, carports,and outbuildings, and(5) increase the maximum size of the storage sheds from 10 feet by 10 feet to 12 feet by 12 feet. In 2009 another PUD Amendment was approved by Eagle County via Resolution No. 2009-064 Eagle County Planning File No. PDA-2112,which changed the usage of Parcel A and Parcel F of PUD to allow for the Gypsum Fire Protection District to place a fire training tower/station on Parcel A, which ultimately became Parcel M. This current request to amend the Two Rivers Planned Unit Development is to allow a Convenience Store/Truck and Automotive Services/Restaurant/Lodge facility on Parcel D and a portion of Parcel E2 of Two Rivers. Parcel D is currently a 1.808 acre commercial area allowing for Retail,Plant Nursery and Single Family Dwelling(including sale of material and all accessory buildings for this purpose).The applicant also desires to move the property line between Parcel D and Parcel E2 in order to allow for a more feasible building area that conforms with the land contours to 4.29 acres. Two Rivers currently has 41.214 acres dedicated to Open Space with Parcel El,Parcel E2 and Parcel J dedicated to open space.This proposed subdivision is being handled under planning file AFP-4830. In 2014, Eagle County Planning Commission approved LEA-4658 for the Dotsero CDOT Truck Parking Lot located on the north side of Interstate I-70 and west of the Two Rivers PUD. The existing truck parking lot was approved in 2008 for the purpose of parking approximately 60 long haul trucks when Vail Pass is closed due to inclement weather.The 2014 approval approved increase usage during peak ski traffic times, as well as weather related events. 26 02/03/2015 This recent CDOT Truck Parking Lot has created a need for the requested use change on Parcel D of Two Rivers Estate of a Convenience Store/Truck and Automotive Services/Restaurant/Lodge facility.Dotsero is an emerging area in western Eagle County with few services for truckers or residents of Two Rivers Village and surrounding residents of the Colorado River and Sweetwater areas.According to the Applicant,these new uses would benefit many residents and travelers in the area. In addition to the Amended Planned Unit Development changes to Parcel D and E2,the Applicant is seeking a change of uses for Parcel M of Two Rivers Estates.The Gypsum Fire Protection District(GFPD),the owner of Parcel M, is requesting minor changes to the PUD Guide in order to terminate the need for annual review of a Location and Extent permit at this location. According to the Applicant,these changes of use in the PUD Guide would greatly benefit residents within the GFPD, as well as the citizens of Eagle County by eliminating the time and cost associated with the need for annual review of a Location and Extent permit at this location. Overall Project Concerns: The Engineering Department has concerns in regards to future traffic generation for possible development scenarios on Parcel D.The Applicant responded that the layout and uses that could occur on the property have not yet been determined.Upon approval of the PUD Amendment they can begin to draft a more extensive plan and settle on the most appropriate size and uses for the site.This would permit them to complete a more detailed traffic analysis at that time. Staff suggests a condition requiring a detailed traffic analysis at the time of any site specific development permit. Please see Conditions#2,#3 and#4. The Engineering Department also had concerns with the existing access for Parcel M, currently utilized by Gypsum Fire Protection District(GFPD). GFPD has agreed to work with Colorado Department of Transportation(CDOT)to amend the existing access permit to accommodate possible future uses on the site, such as an increase of construction traffic on the I-70 Frontage Road. Should any use come in which the projected traffic count generated is greater than what the revised access permit would allow,then the developer/contractor would be responsible for obtaining a temporary access permit. Please see Condition#6. The adjacent property owners were concerned about the possibility of a truck'stop on Parcel D and the impacts of a different commercial development than Stephen's Nursery. The Applicant responded that a truck stop is not being proposed on Parcel D and has agreed to a size limit on trucks should the property be developed in the future for a gas station. Please see Note(a)under Parcel D in the Executive Session. Purpose of PUD Amendments The purpose of the Planned Unit Development(PUD)zone district is to permit variations from the strict application of the standards of the County's other zone districts in order to allow flexibility for landowners to creatively plan for the overall development of their land and thereby, to achieve a more desirable environment than would be possible through the strict application of the minimum standards of these Land Use Regulations. This is done through the application of performance standards. The performance standards are further outlined and analyzed in Appendix A. No substantial modification, removal, or release of the provisions of the plan shall be permitted except upon a finding by the County, following a public hearing called and held in accordance with the provisions of section 24- 67-104(1)(e) Colorado Revised Statutes that; (1) Modification. The modification, removal, or release is consistent with the efficient development and preservation of the entire Planned Unit Development; (2) Adjacent Properties. The PUD Amendment does not affect, in a substantially adverse manner, either the enjoyment of land abutting upon or across a street from the Planned Unit Development or the public interest; (3) Benefit.The PUD Amendment is not granted solely to confer a special benefit upon any person. 27 02/03/2015 PUD Amendment Standards Unified Ownership and Control The property within the PUD Amendment is owned by the Two Rivers Properties, LLP and Gypsum Fire Protection District. Staff has received letters from both entities authorizing the PUD Amendment for Two Rivers. Uses Parcel D of Two Rivers Estate Planned Unit Development was designated as Retail, Plant Nursery and Single Family Dwelling(including sale of material and all accessory buildings for this purpose). Currently, Stephens Nursery operates its nursery facility from Parcels D as well as Cl and C2 across the Colorado River Road to the east.The nursery will continue to operate on Parcels Cl and C2. Parcel D has been used for a retail commercial business. The use of a Convenience Store/Truck and Automotive Services/Restaurant/Lodge is a commercial use on the same Parcel. Parcel M has been utilized as an emergency training facility since 2009. The main use of a training facility is not changing,but additional uses are being added to accommodate the needs of GFPD and their members. The uses are listed in the Executive Summary. Dimensional Limitations No dimensional limitations are changing with the proposed PUD Amendment. Off Street Parking and Loading Parking and Loading Standards within the PUD are not changing. Landscaping There are no changes to the landscaping standards with the PUD. Any possible future development within the Two Rivers PUD will adhere to the landscaping standards established in the original PUD and are carrying forward in this PUD Amendment. Signs There are no changes to the master sign program in the Two Rivers PUD. Any possible future development within the PUD will adhere to the sign standards established in the original PUD and are carrying forward in this PUD Amendment. Adequate Facilities The entire Two Rivers PUD is served by the Two Rivers Metropolitan District(TRMD) for water and sewer.The TRMD has no issues with the PUD Amendment. The PUD is already served by existing infrastructure. Improvements Safe, efficient access, internal pathways, emergency vehicle access, principal access points and snow storage were established with the approval of the original PUD. The proposed amendment will not change previously established development standards. Compatibility with Surrounding Land Uses The proposed uses are in keeping with the surrounding properties. Doterso and the existing residences in the area have little commercial service options.The redevelopment of Parcel D into a gas station, convenience store or some other commercial option is compatible and identified need in the area based on the recently adopted 2012 Doteero Area Community Plan. Consistent with the Comprehensive Plan 28 02/03/2015 The Comprehensive Plan indicates that growth should be managed toward future sustainability—a healthy balance between economic success,quality of life and the preservation of the environment and that growth should be appropriately designed and should be located within or immediately contiguous to existing town and community centers.The new parking area is located adjacent to existing development. The Future Land Use Map(FLUM)in the Eagle County Comprehensive Plan identifies the property as a community center and is therefore appropriate for mixed use development. All standards of the Eagle County Comprehensive Plan and the Dotsero Area Community Plan have been met through the original PUD approval. The addition of the proposed uses does not change the conformance of the PUD to either plan. Phasing A phasing plan has not been provided with this PUD Amendment. The PUD is slowing building out as the economy and market allows. Additionally,the amendment only affects Parcels D and M and therefore no additional phasing plan is necessary. Common Recreation and Open Space The proposed changes to the uses by right within the PUD does not bring the overall development below the required open space threshold. Natural Resource Protection The proposed use,with the conditions,is not anticipated to cause significant deterioration of water and air resources,wildlife habitat, scenic resources, and other natural resources. REFERRAL RESPONSES: 29 02/03/2015 Eagle County Engineering Department: Greg Schroeder, Senior Project Engineer,reviewed the project and had the following comments: 1. Exhibit C,Traffic Information contains a table showing vehicle trip generation, including daily and morning and evening peak hour vehicle trips. As mentioned,the daily and peak hour trips represent a substantial increase in the traffic generation that could be added to either Colorado River Road,or the frontage road to the west of the roundabout. 2. Due to the increased proposed traffic generation that appears to be in excess of 20%of the existing capacity, and this affecting the nearby CDOT roads, a CDOT access permit will need to be acquired prior when development is commenced. Furthermore, if any improvements are required per the CDOT access permit,those improvements shall be completed prior to the completion of development. 3. The traffic memorandum mentions because of the low volume of traffic on Colorado River Road and recent roundabout improvements,the added volume will be accommodated without the need for additional road improvements or traffic control devices in the vicinity.Prior to commencement of future development,the applicant shall complete a traffic study including level of service analysis verifying that there is capacity within the current road network, and that the proposed development does not decrease the allowable level of service to that of county standards, as required in Article 4 of the Eagle County Land Use Regulations. 4. The applicant shall be responsible for all road impact fees due at time of building permit or other applicable permit(s). 5. Parcel M,Fire Station and All Related Uses, and other allowed uses, is being amended to allow"a rental location for storage and operations for other contractors of State, County, or other Public Utility,Telecomm, or other Governments... on a temporary 180 day maximum duration per occurrence."As a result of these temporary operations,the applicant shall coordinate with Eagle County and CDOT for a temporary state highway access permit prior to commencement of operations. 6. Parcel M also has known geotechnical hazard issues including,but not limited to,rock fall, debris flow, and sinkholes.Prior to any further development on this parcel,the applicant shall contact the Colorado Geological Survey for further review and comment. 7. It is suggested that prior to any development,the applicant schedule a pre-submittal meeting with county staff to discuss the traffic study and geotechnical requirements before beginning design. Eagle County Department of Environmental Health: Adam Palmer reviewed the application and provided the following comments, 1. In general,the proposed uses appear to be appropriate for the location to serve the local and regional community. Staff will review dimensional standards, access,water and wastewater systems for compliance upon submittal for building/electrical/plumbing permits accordingly. 2. Provision of a detailed drainage, hazardous material storage, and spill prevention/clean-up plan is recommended as a condition of approval to demonstrate limitation of potential for contaminants from the subject properties to enter the Colorado River. 3. Any fuel storage tanks proposed in the future will be required to meet OPS Storage Tank Regulations pursuant to 7 CCR 1101-14 from the Colorado Division of Oil and Public Safety. 30 02/03/2015 4. For fueling stations proposed for the site, consideration of offering electric vehicle charging stations, Compressed Natural Gas infrastructure and/or biofuels including E85 Ethanol and/or Biodiesel are recommended. Eagle River Fire: Since one of the Applicants is GFPD, Eagle River Fire Protection District reviewed the file. Gail McFarland,Assistant Fire Marshal,had no comments or concerns from a Public Safety standpoint. Town of Gypsum: Lana Gallegos,AICP, Senior Planner, did not have any comments that would necessitate a formal response on this application,but she stated that the services are certainly needed down there for many reasons. Colorado Parks and Wildlife: According to Perry Will,the Area Wildlife Manager,"The proposed amendment to the PUD is anticipated to have minimal impact on local wildlife species. As always, CPW, encourages residents and business owners to follow `bear aware' practices to reduce human-wildlife conflicts." IV. PLANNING COMMISSIONERS' COMMENTS: Planning Commissioners'Comments from the Public Hearing on December 3,2014: Parcel M The Planning Commissioners were in agreement that the proposed uses on Parcel M were appropriate as outlined in the PUD Amendment. Parcel D Planning Commissioner Runyon expressed concerns with the haphazard technique of the proposed uses.He did not like the idea of lodging and trucks in the same area.He would like to see a plan for the site and a tighter list of uses. Planning Commissioner Sage stated that he would like to see a greater focus of uses on the site. Planning Commissioner Warner expressed concern regarding a loss of open space and that there needs to be assurances that adequate facilities and infrastructure are in place. Planning Commissioner Carpenter stated that this parcel was identified as a Community Center in the:Dotsero Area Community Plan; however,he would like to see a more developed plan on this parcel. Planning Commissioner Bevan also expressed that the proposal needs a greater focus for the proposed uses. Planning Commissioner Conklin indicated that the proposed uses on this parcel are appropriate for the area. It has been designated as a Community Center through the planning process, for the Dostsero Area Community Plan. Planning Commissioner Moffet stated that the proposed uses are the types of uses contemplated with the approval of the Dotsero Area Community Plan; however, he didn't believe housing was appropriate in this area. Terrill Knight representing the Applicant on Parcel D has contacted the adjacent property owners to discuss what they would deem as appropriate uses on the parcel. The Applicant wanted to be clear to the Planning . Commission that they are not proposing a truck stop on the property. Planning Commissioners'Comments from the Public Hearing on January 7,2015: 31 02/03/2015 Planning Commissioner Carpenter stated that the CDOT parking lot or truck parking area is there now and the County never had control over it in the first place. If you put a facility down there; a lodge or convenience store, truckers will park in the CDOT lot and it is a given as they will park there to use the proposed facilities. The Applicant can already do the majority of what is being proposed based on the current uses by right. He supports the proposal and feels that it is supported by the Dotsero Area Community Plan for the area.He is in support of the project,but he would like to see the Applicant work closely with the County Engineering Department on the traffic impact. Planning Commissioner Warner agreed with most of what Commissioner Carpenter stated, it is a community center,the retail definition is fairly broad,but wishes Planning Commission had a concept and visuals on what is being proposed,however he understands that traffic will fluctuate based on future development. He would like to see the open space remain open space. Planning Commissioner Runyon agreed with Commissioner Warner and would have liked to have seen more specificity. It is a commercial center and it is appropriate to have services there.He did not see a whole lot that would be out of place with the proposed uses. He is in support of the project and feels that it is the right thing to go there. Planning Commissioner Sage stated that the market is going to dictate what will go in there and is not concerned that the Applicant will be putting anything in that will harm the community. The Planning Commission voted unanimously to recommend approval of the Two Rivers Estates PUD Amendment to the Board of County Commissioners. V. BOARD OF COUNTY COMMISSIONERS' OPTIONS: 1. Deny the [PDA FILE NO.ZS-4831] request if it is determined that the petition will adversely affect the public health, safety, and welfare and/or the proposed use is not attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is not in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan(and/or other applicable master plans). 2. Table the [PDA FILE NO.ZS-4831] request if additional information is required to fully evaluate the petition. Give specific direction to the petitioner and staff. 3. Approve the [PDA FILE NO. ZS-48311 request with conditions and/or performance standards if it is determined that certain conditions and/or performance standards are necessary to ensure public, health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). VI. SUGGESTED CONDITIONS: 1. Except as otherwise modified by this development permit, all material representations made by the Applicant in this application and in public meetings shall be adhered to and considered conditions of approval. 2. Applicant shall comply with all site development standards in the most recently adopted Eagle County Land Use Regulation(ECLUR) for any future development of Parcel D. 3. Prior to the commencement of any future development on Parcel D,the Applicant shall comply with the latest State Highway Access Code and provide a Traffic Impact Study to the County Engineer and the 32 02/03/2015 Colorado Department of Transportation(CDOT)Access Manager for approval. Study area shall include but not be limited to the Dotsero Roundabout and Colorado River Road segment adjacent to Parcel D. 4. The Applicant is solely responsible for the design and construction of all traffic mitigations derived from the Traffic Impact Study,both on-site and off-site. 5. Prior to commencement of future development on Parcel D,the Applicant shall submit a development plan in conjunction with the Traffic Impact Study. 6. Prior to commencement of future development on Parcel D,the Applicant shall obtain an access permit from Colorado Department of Transportation(CDOT). Should any improvements be required through the CDOT Access Permit,those improvements shall be completed prior to the completion of the development on Parcel D. 7. Prior to the commencement of future development on Parcel D,the Applicant shall submit a Spill Prevention, Containment and Countermeasures Facility Response Plan, as outlined on the Environmental Protection Agency's website,to limit potential for contaminants from Parcel D to enter groundwater or the Colorado River. 8. Gypsum Fire Protection District(GFPD) shall work with Colorado Department of Transportation (CDOT)to amend the existing access permit to accommodate allowable uses on Parcel M.This amendment shall be approved by CDOT prior to the commencement of any new uses. APPENDIX A NECESSARY FINDINGS: PROCESS INTENT ECLUR Section: 5-240 F.3.m—Amendment to Preliminary Plan for PUD; Section Purpose: No substantial modification, removal, or release of the provisions of the plan shall be permitted except upon a finding by the County, following a public hearing called and held in accordance with the provisions of section 24-67-104(1)(e) Colorado Revised Statutes that; (4) Modification. The modification, removal, or release is consistent with the efficient development and preservation of the entire Planned Unit Development; The proposed amendment will add uses by right to Parcel D and Parcel M of the Two Rivers PUD Guide. According to the Applicant, these additional uses will have no impact on the efficient development and preservation of the entire Planned Unit Development. (5) Adjacent Properties. The PUD Amendment does not effect, in a substantially adverse manner, either the enjoyment of land abutting upon or across a street from the Planned Unit Development or the public interest; The proposed PUD Amendment will be allowing additional uses on only Parcel D and Parcel M. According to the Applicant, this action will have no adverse impact on the land abutting the property or the public interest. (6) Benefit. The PUD Amendment is not granted solely to confer a special benefit upon any person. 33 02/03/2015 According to the Applicant, the proposed PUD Amendment is for the benefit of residents of Dotsero and travelers along I-70 as well as the members of the GFPD. Standards: Section 5-240.F.3.e., Standards; Section 5-280.B.3.e Standards and Section 5-230.D Standards is used to evaluate a Sketch & Preliminary Plan for PUD (with subdivision) application. All standards that would be met at a Preliminary Plan level must addressed by the application materials. It must therefore be determined, based on submitted evidence, whether applicable standards have been met at this stage. If the information supplied is found to be sufficiently vague or if it is doubtful that the proposal would be able to meet a specific Standard,a negative finding must be made for that Standard. STANDARD: Unified ownership or control. [Section 5-240.F.3.e (1)] — The title to all land that is part of a PUD shall be owned or controlled by one I person. A person shall be considered to control all lands in the PUD Y ��1� P either through ownership or by written consent of all owners of the land that they will be subject to P Y f f the conditions and Y subject of the PUD. Staff Response: The property within the PUD Amendment is owned by the Two Rivers Properties, LLP and Gypsum Fire Protection District. [Section 5-240.F.3.e (2)] — The uses that may be developed in the PUD shall be those uses that are designated as uses that are allowed, allowed as a special use or allowed as a limited use in Table 3-300, "Residential, Agricultural and Resource Zone Districts Use Schedule" or Table 3-320, "Commercial and Industrial Zone Districts Use Schedule" for the zone district designation in effect for the property at the time of the application for PUD. Variations of these use designations may only be authorized pursuant to Section 5-240 F.3.f, Variations Authorized. Variations of these dimensional limitations may only be authorized pursuant to Section 5-240 F.3.f., Variations Authorized, provided variations shall leave adequate distance between buildings for necessary access and fire protection, and ensure proper ventilation, light, air and snowmelt between buildings. Staff Response:No dimension limitations are changing with the proposed PUD Amendment. STANDARD: Off-Street Parking and Loading. [Section 5-240.F.3.e (4)] — Off-street parking and loading provided in the PUD shall comply with the standards of Article 4, Division 1, Off-Street Parking and Loading Standards. A reduction in these standards may be authorized where the applicant demonstrates that: 34 02/03/2015 (a) Shared Parking. Because of shared parking arrangements among uses within the PUD that do not require peak parking for those uses to occur at the same time, the parking needs of residents, guests and employees of the project will be met; or (b) Actual Needs. The actual needs of the project's residents, guests and employees will be less than those set by Article 4, Division 1, Off-Street Parking and Loading Standards. The applicant may commit to provide specialized transportation services for these persons (such as vans, subsidized bus passes, or similar services) as a means of complying with this standard. Staff Response: Parking and Loading Standards within the PUD are not changing. STANDARD: Landscaping. [Section 5-240.F.3.e (5)] —Landscaping provided in the PUD shall comply with the standards of Article 4, Division 2, Landscaping and Illumination Standards. Variations from these standards may be authorized where the applicant demonstrates that the proposed landscaping provides sufficient buffering of uses from each other (both within the PUD and between the PUD and surrounding uses) to minimize noise, glare and other adverse impacts, creates attractive streetscapes and parking areas and is consistent with the character of the area. Staff Response: There are no changes to the landscaping standards. Any future development will adhere to the landscaping standards established in the original PUD and are carrying forward in this PUD Amendment. STANDARD: Signs. [Section 5-240.F.3.e(6)] —The sign standards applicable to the PUD shall be as specified in Article 4, Division 3, Sign Regulations, unless, as provided in Section 4-340 D., Signs Allowed in a Planned Unit Development (PUD), the applicant submits a comprehensive sign plan for the PUD that is determined to be suitable for the PUD and provides the minimum sign area necessary to direct users to and within the PUD. Staff Response: There are no changes to the master sign program in the Two Rivers PUD. Any future development will adhere to the sign standards established in the original PUD and are carrying forward in this PUD Amendment. STANDARD: Adequate Facilities. [Section 5-240.F.3.e (7)] — The applicant shall demonstrate that the development proposed in the (Sketch) Preliminary Plan for PUD will be provided adequate facilities for potable water supply, sewage disposal, solid waste disposal, electrical supply, fire protection and roads and will be conveniently located in relation to schools,police and fire protection, and emergency medical services. Staff Response: The entire Two Rivers PUD is served by the Two Rivers Metro District for water and sewer. The Two Rivers Metro District has no issues with the PUD Amendment.The PUD is already served by existing infrastructure. STANDARD: Improvements. [Section 5-240.F.3.e (8)] — The improvement standards applicable to the development shall be as specified in Article 4, Division 6, Improvement Standards. Provided, however, the development may deviate from the County's road standards, so the development achieves greater efficiency of infrastructure design and installation through clustered or compact forms of development or achieves greater sensitivity to environmental impacts, when the following minimum design principles are followed: (a) Safe, Efficient Access. The circulation system is designed to provide safe, convenient access to all areas of the proposed development using the minimum practical roadway length. Access shall be by a public right-of-way,private vehicular or pedestrian way or a commonly owned easement. No roadway alignment, either horizontal or vertical, shall be allowed that compromises one (1) or more of the minimum design standards of the American Association of State Highway Officials (AASHTO) for that functional classification of roadway. (b) Internal Pathways. Internal pathways shall be provided to form a logical, safe and convenient system for pedestrian access to dwelling units and common areas, with appropriate linkages off-site. (c) Emergency Vehicles. Roadways shall be designed to permit access by emergency vehicles to all lots or units. An access easement shall be granted for emergency vehicles and utility vehicles, as applicable, to use private roadways in the development for the purpose of providing emergency services and for installation, maintenance and repair of utilities. 35 02/03/2015 (d) Principal Access Points. Principal vehicular access points shall be designed to provide for smooth traffic flow, minimizing hazards to vehicular,pedestrian or bicycle traffic. Where a PUD abuts a major collector, arterial road or highway, direct access to such road or highway from individual lots, units or buildings shall not be permitted. Minor roads within the PUD shall not be directly connected with roads outside of the PUD, unless the County determines such connections are necessary to maintain the County's road network. (e) Snow Storage. Adequate areas shall be provided to store snow removed from the internal street network and from off-street parking areas. As a development proposal moves from sketch plan to preliminary plan review, its conformance or lack thereof to aspects of the master plans may not necessarily remain static. If development of the PUD is proposed to occur in phases, then guarantees shall be provided for public improvements and amenities that are necessary and desirable for residents of the project, or that are of benefit to the entire County. Such public improvements shall be constructed with the first phase of the project, or, if this is not possible, then as early in the project as is reasonable. Staff Response: A phasing plan has not been provided with this PUD Amendment. The PUD is slowing building out as the economy and market allows. STANDARD: Common Recreation and Open Space. [Section 5-240.F.3.e(12)]—The PUD shall comply with the following common recreation and open space standards. Staff Response: Common areas/open space areas currently exist as part of this PUD will not be significantly altered as part of this PUD Amendment; however, Parcel E2 is being subdivided in order to add more acreage to Parcel D.This change in the parcels is necessary in order to create a lot that has more useable space to allow for safer ingress and egress into and out of Parcel D.The change in the lot line between Parcel D and Parcel E2 is more 36 02/03/2015 consistent with the geographic contours of the land in that location allowing for safer access off of the Colorado River Road and the I-70 Frontage Road. Two Rivers Estates currently has Parcel El,E2 and J as open space parcels within the Planned Unit Development, which total 41.214 acres of open space. STANDARD: Natural Resource Protection. [Section 5-240.F.3.e (13)] — The PUD shall consider the recommendations made by the applicable analysis documents, as well as the recommendations of referral agencies as specified in Article 4, Division 4, Natural Resource Protection Standards. The modifications to this PUD affect previously disturbed portions of land and will not further affect or hinder any of the natural resources standards as found in the Eagle County Land Use regulations such as Wildlife Protection, Development in Areas Subject to Geologic Hazards,Development in Areas Subject to Wildfire Hazards,Wood Burning Controls, or Ridgeline Protection. DISCUSSION: Ms.Valdez presented the request. The applicant was requesting to expand the list of uses within the PUD guide to allow for an expanded list of uses by right within the Two Rivers Estates Planned Unit Development. Steven's Nursery was currently operating on Parcel D and Gypsum Fire Protection District; Station 13 operated a training facility on Parcel M. If amended the PUD would allow for the following uses on Parcel D: A. Retail,Plant,Nursery and Single-Family Dwelling; (including sale of material and all accessory buildings for this purpose); B. Truck and Automotive Services; C. Fuel Sales and Delivery; D. Transportation Services; E. Automobile and Equipment Storage and Parking; F. Emergency Vehicle Parking; G. Temporary Vehicle Storage-30 day limit; H. Boating,Fishing and Hunting Supplies& Services; I. Restaurant with Drive thru and/or Carry out Service; J. Food and Supply Delivery; K. Offices; L. Retail and Wholesale Facilities; M. Farmers Market and/or Flea Market; and N. Lodging. The proposed uses by right on Parcel M include: A. Fire Station and all related uses; B. Storage site for inside and outside storage of materials,recreational vehicles, automobiles and other related items; C. Temporary buildings and props for the use of firefighting training for a maximum duration of 6 months; D. The Fire District may use property as rental location for storage and operations for other contractors of the State, County, or other Public Utility,Telecomm, or other Governments for the betterment of the people of Eagle County as approved by the Fire Board on a temporary 180 day maximum duration per occurrence. The proposed plat showed the new lot configuration. Staff had not received any negative feedback within the last three(3)years. She explained the amendment criteria and presented the suggested conditions. The applicant was also proposing to amended Parcel D and E2 through the proposed amended final plat. The size of Parcel D would increase by approximately 2.4 acres. Public water and sewer services will be provided by Two River Metro District. The nursery would continue to operate on Parcels Cl and C2. Parcel D would be used for a convenience 37 02/03/2015 store,truck and automotive services,restaurant and lodging. Parcel M would continue being used as an emergency training facility but additional uses were being added to accommodate the needs of the Gypsum Fire Department. The PUD still met the recreational and open space standards. The proposed changes were consistent with the original PUD. The proposed residential uses and development controls would ensure compatibility with the surrounding area. The amendment was consistent with the efficient development and preservation. The proposed amendment did not have an adverse effect on adjacent property owners. Staff was suggesting eight(8)conditions as presented in the staff report. Chairman Ryan asked about the second standard related to uses. Ms. Valdez stated that staff considered whether the proposed uses were compatible with the existing uses already part of the PUD. The definitions for"retail"within the Eagle County Land Use Regulations were very open ended. Chairman Ryan asked about the uses by right. Ms. Valdez stated that the list covered all the uses, and any proposals in the future would have to fit in one of the categories. Ms.Ayres -Oliver stated that because this was a PUD,the list was specific to this property. Commissioner McQueeney understood that the list was created by the applicant for this property. Commissioner Chandler-Henry asked about the impact to traffic. Mr. Schroeder stated that many of the conditions addressed the traffic impacts. The applicant submitted a traffic memorandum which specified that the potential uses could be up 1,300 vehicles per day. The proposal would be a significant increase in traffic. There may also be increase traffic on the south side of the property. The roundabout was only one lane and could need to be widened in the future. The applicant would need to provide a traffic impact study prior to submitting any development plans. Terrill Knight was present with Bill Stevens, owner of Steven's Nursery. Mr.Knight stated that the applicant worked closely with county staff and tried to cooperate with the neighbors. The nursery was located on parcel D and would continue operating. The CDOT truck parking area accommodated 65 vehicles and the proposal would provide services within walking distance. If the uses were approved they would move forward with the next step. Chairman Ryan wondered if trucks would be navigating through the roundabout, or park and walk to the services. She wondered what was linking the two. Mr.Knight stated that there was currently no sidewalk but the applicant would make any necessary provisions. The applicant was proposing vehicle services, convenience store,truck stop,restaurant and some fuel on Parcel D. There was a joint community effort to keep the Fire Station active and working on site. The proposal would be phased over years as needed. They hired a competent traffic study specialist. The basic services were already there. The applicant believed it was a reasonable site for the proposed uses. Chairman Ryan asked the applicant the definition of a truck stop. Mr. Stevens stated that there wasn't enough area for a truck stop but if a truck needed fuel there was enough room for them to fuel. Mr.Knight stated that there was plenty of room in the CDOT parking area for rest. They were not proposing a site for that use. Mr. Stevens stated that the State also had parking along Hwy 6 for semi parking. Ms.Valdez stated that as there was no definition of automotive service in the regulations,the Planning Commission wanted to add a note that the weight,height, and width of the vehicle shall comply with the legal vehicle dimensions.The document would be referenced on the CDOT website. Mr.Knight stated that the applicant accepted all the conditions proposed by staff. Commissioner McQueeney asked for clarification regarding the timing of the traffic study. Mr. Knight stated that the burden was on the applicant to decide when to perform the traffic study. Mr. Schroeder stated the applicant could do a study based on the highest practical use. Mr.Knight believed the risk was theirs,but this allowed for some flexibility in the planning process. Commissioner Chandler-Henry wondered if development would impact the Colorado River Road. Mr.Knight stated that they intend to service those users but not create a traffic burden. Commissioner McQueeney asked about the process used to determine the best use and if the community would have the opportunity to weigh in. Mr.Knight stated that the applicant did not intend to do something that didn't make sense. They would research in order to identify the proper service for the area. 38 02/03/2015 Commissioner Chandler-Henry opened public comment. Chief Justin Kirkland, Gypsum Fire Protection District stated that the property was given to the Fire District; they built a fire station and used the property for training purposes. They work with the community and have had no complaints from any surrounding property owners. They supported the proposed services. Commissioner Chandler-Henry closed public comment. Chairman Ryan stated that she was prepared to vote yes. The proposal was compatible with surrounding land uses. The biggest advantage was for travelers when I-70 was closed. Commissioner McQueeney supported a community center and believed it was a logical next step. Commissioner Chandler-Henry had concerns with the traffic but understood that this would be discussed moving forward. She agreed with her fellow commissioners. There were eight(8)proposed conditions. Commissioner Ryan moved to approve the file no. ZS-4831 with conditions and/or performance standards if it is determined that certain conditions and/or performance standards are necessary to ensure public,health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan. Staff Findings and Recommendation Staff believes the proposed building envelope amendment is in keeping with 1)the intent of the original final plat, and 2)the requirements of the Eagle County Land Use Regulations(ECLURs). Specifically, staff believes the Amended Final Plat meets each of the following, applicable criteria: Adjacent property. Staff believes the proposed amendment will not adversely affect any neighboring property. Final Plat Consistency. EXECUTIVE SUMMARY: Request and Process The Applicant requests review of a Special Use Permit to allow for the designation of certain lands owned by Eagle County as those lands to be used for, and associated with, the Eagle County Landfill. Per the application submitted by KRW Consulting, Inc. on behalf of the Eagle County Solid Waste and Recycling Department: "Eagle County Solid Waste & Recycling wishes to amend the existing Certificate of Designation (CD)for the Eagle County Landfill issued by Resolution No. 46 and adopted by the Eagle County Commissioners on June 9, 1986. This CD designated an approximate 180 acres of land owned by the Bureau of Land Management and leased to Eagle County for the operation of a sanitary landfill. This lease...was due to expire in 2015. Upon expiration, BLM made it known that, due to 41 02/03/2015 policy changes they would not renew the lease and suggested that Eagle County purchase the land under the auspices of the Recreation & Public Purposes Act. Following these guidelines, Eagle County completed the purchase in 2002 and 2003 of 730 acres of public land administered by the Bureau of Land Management including the original area designated in the 1986 CD. Eagle County Solid Waste & Recycling Department therefore wishes to amend the existing CD to include the original lease area and surrounding contiguous acreage for a total of 730 acres." Therefore, the primary focus of this special use review centers on designating the physical boundaries of the County's land holdings related to landfill operations north of Wolcott. Most operational aspects of the landfill, inclusive of future expansion plans that have been vetted by the State of Colorado, will not change by virtue of this amended CD. Importantly, the Applicant applied for and was granted a Special Use Permit in April, 2013 for a vertical expansion of the existing landfill, resulting in a capacity increase within the existing landfill footprint of up to 2.6 million cubic yards. This expansion request was submitted under the auspices of an amendment to the "Revised Design, Operations, and Closure Plan", also known as an "Engineering Design and Operations Plan" (EDOP) for the landfill which establishes four phases for lateral expansion within the 730 acres over a 100-year time horizon (see attached map depicting the existing landfill area as well as proposed expansion areas); such plan included several waivers and amendments to operations plans approved by the State since the original CD was issued and was approved by the State of Colorado Department of Health&Environment in August, 2013. The EDOP reviewed by the State and, in part,by the County at that time included details regarding future phases of the landfill, lifespan/capacity forecasts for the existing landfill and an analysis of the landfill uses over the 730 acre parcel in relation to master plan policies and goals, as well as the specific standards for special use review. Staff believes the EDOP, inclusive of previously approved vertical expansion plans, as well as overall (lateral) expansion plans for phases II—IV complies with the standards for a special use permit while maintaining conformance to the Wolcott Area Therefore, this special use request recognizes the previously approved uses and amendments to previous operational plans (represented in the current EDOP), and seeks to memorialize the boundaries of the County's land holdings as a follow-up to the 2013 Special Use Permit and the subsequent State approval for the current EDOP. Report Organization and Recommendation The following sections of this report provide a brief background regarding the request(s),referral agency responses, staff review of the requests, potential issues, as well as an outline of standards for approval with brief responses from staff as to how/why the proposal meets or does not meet applicable standards. An appendix section is attached, containing an in-depth examination of all applicable review and approval standards. Staff is recommending approval, with conditions for this Special Use Permit request. II. BACKGROUND: Proposal Overview As noted above, the primary purpose of this application is to memorialize the boundaries of Eagle County's land holdings, as well as the overall operations plan related to the Eagle County Landfill facility via the Certificate of Designation process. The original CD for the landfill approved in 1986 by Eagle County and the State included 180 acres. Today, approximately 61 acres of the site are in use for landfill operations, and recently approved vertical expansion plans will allow Eagle County to utilize the existing footprint of the landfill more effectively and efficiently,thus extending the life of the existing footprint area substantially. Background According to the application,the following timeline represents the general history of the Eagle County Landfill: 42 02/03/2015 In July, 1985, Eagle County leased the landfill site from the Bureau of Land Management for use as a landfill. This was a 30-year lease, but the County intended to purchase the land from the BLM prior to expiration of the lease. Also in 1985,the original operations plan,or EDOP,was prepared for the landfill. In August, 1986, Eagle County approved the original Certificate of Designation for 180 acres. In 1996,the State and the County approved the original EDOP for the landfill. Since 1996, several amendments and State approved waivers had been approved. In 2012, the Applicant began revisions to the EDOP that incorporated all such amendments and waivers into one stand-alone document—for State and County approval. As referenced above, a Special Use Permit was granted in 2013 (Resolution No. 2013-100) to increase the size of the landfill operations and, specifically to amend the operations plan to allow for vertical expansion as the primary means to extend the life of the landfill, and, therefore, to avoid future horizontal or "lateral" expansion within the 730 acres owned by the County. Per a letter from the State, dated August 15, 2013, and addressed to Ken Whitehead, Director of Eagle County's Solid Waste and Recycling Department, with regard to the current application for an amendment to the CD and EDOP, "The Revised Plan...incorporated all previous Division-approved waivers and amendments into one stand-alone document. In addition, the Revised Plan...included landfill operation revisions that had been developed since the original Plan was approved in 1996. The landfill operation revisions included modifications to waste disposal such as the management of declining waste volumes, the use of different compaction equipment, changes in personnel, and the use of waste diversion." The above referenced letter from the State verifies the State's approval of the new, or current EDOP. The new EDOP — setting forth specific vertical and lateral expansion and operational planning details and limits — was approved by the State of Colorado in August of 2013. Therefore, while the State has approved the EDOP to reflect the new boundaries of the landfill, and while the Applicant has already provided detailed information with regard to current and future landfill operations and expansion plans (via the 2013 Special Use Permit for vertical expansion), State Statute (Section 1.6.1, Hazardous Materials and Waste Management Division Regulations Pertaining to Solid Waste Sites and Facilities)requires that the County formally act on this CD to recognize the 730 acres owned by Eagle County for landfill purposes. Review Timeline and Issues This request was formally submitted on August 27, 2014. However, the Applicant held meetings with Planning Department and Environmental Health Department staff members starting in May, 2014, to discuss plans to submit this new Certificate of Designation as well as requirements for the special use permit application. This application was referred to thirty-seven(37) different public, quasi-public and private organizations for review over a 21 day period with only one entity (the Colorado State Office of Archeology and Historic Preservation) providing a formal response to the referral(see suggested condition number 4). Although staff has not identified any substantive issues with regard to this request, the Planning Commission conducted a review on January 7, 2015, and did forward specific recommendations for conditions requiring additional special use review by Eagle County for any future phases. Likewise, neighboring property owners attended that hearing and expressed concern with regard to future expansion plans. III. STAFF FINDINGS AND RECOMMENDATION: Staff is recommending approval of this application,with conditions. Staff believes the proposal, as conditioned meets or exceeds all applicable standards for a Special Use Permit. 43 02/03/2015 Special Use Standards Specifically, the following excerpts from Section 5-250 B — Standards, ECLURs provide direction regarding the intent and necessary findings for the approval of any Special Use Review, as well as the specific standards for marijuana cultivation and variations to improvement standards that are to be addressed. Likewise, the following section provides brief responses (provided in greater detail in the"Appendix" section of this report) from staff as to how staff believes the application meets or does not meet a particular standard, as well as suggested mitigation measures (conditions): 1. Consistent with Comprehensive Plan. The proposed Special Use shall be in substantial conformance with the Eagle County Comprehensive Plan, Area Community Plans and any applicable ancillary County adopted documents pertaining to natural resource protection, affordable housing, or infrastructure management. Staff Response: Staff believes the proposal is in substantial conformance with all applicable plans and adopted policy documents. Specifically, this proposal seeks to memorialize the 730 acre land holdings associated with the Landfill and to recognize the current EDOP approved by the State of Colorado in August, 2013. The proposal was reviewed against relevant guiding policies, goals, and recommended implementation strategies of the Wolcott Area Community Plan which designates the landfill area as being the dominant land use within the Ute Creek Character Area and encourages the continued use of the area for landfill, or other similar uses such as contractor storage, resource recovery,recycling and alternative energy facilities. 2. Compatibility. The Special Use is generally compatible with the existing and currently permissible future uses of adjacent land and other substantially impacted land, services, or infrastructure improvements. Staff Response: Staff believes the proposal has no direct or immediate impact or effect on issues of compatibility. The Wolcott Area Community Plan recognizes this area as the predominant land use within the Ute Creek Character Area. As such, the Community Plan stipulates that other potential uses in this same area should be light industrial in nature and that any proposals for residential development may be incompatible with the Landfill. 3. Zone District Standards. The proposed Special Use shall comply with the standards of the zone district in which it is located and any standards applicable to the particular use, as identified in Section 3-310, Review Standards Applicable to Particular Residential, Agricultural and Resource Uses and Section 3-330, Review Standards Applicable to Particular Commercial and Industrial Uses. Staff Response: Staff believes the proposal conforms with the ECLURs. 4. Design Minimizes Adverse Impact. The design of the proposed Special Use shall reasonably avoid adverse impacts, including visual impacts of the proposed use on adjacent lands including trash, traffic, service delivery,parking and loading, odors, noise, glare, and vibration, or otherwise create a nuisance. Staff Response: Staff believes the proposal meets this standard. The new CD is meant to formally recognize and accept the 730 acres owned by the County since 2002-2003 for the purposes of landfill operations. Plans for future expansion, inclusive of a vertical expansion approved in 2013 by Eagle County, have been designed to minimize future impacts. Further, such plans (the EDOP) have been vetted and approved by the State. Previous approvals granted for vertical expansion included conditions 44 02/03/2015 that specifically address traffic related mitigation at the intersection of Hwy. 131 and Ute Creek Road which serves the landfill as well as other developments such as the Ute Creek Industrial Park & Storage PUD, if warranted, in the future. S. Design Minimizes Environmental Impact. The proposed Special Use shall minimize environmental impacts and shall not cause significant deterioration of water and air resources, wildlife habitat, scenic resources, and other natural resources. Staff Response: Staff believes the proposal substantially meets this standard (see above comments regarding the design of the project and the focus of this Special Use Permit review). 6. Impact on Public Facilities. The proposed Special Use shall be adequately served by public facilities and services, including roads,pedestrian paths,potable water and wastewater facilities,parks, schools,police and fire protection, and emergency medical services. Staff Response: Staff believes the proposal meets this standard. The public facilities and/or services impacted will primarily be public roadways. This proposal was referred to and reviewed by the Eagle County Engineering Department with no comments or concerns noted. As noted above, previous Special Use Permit approval for vertical expansion was conditional to require mitigation by the Applicant in the future if warranted due to increases in traffic resulting from increased intensity of use at the landfill. 7. Site Development Standards. The proposed Special Use shall comply with the appropriate standards in Article 4, Site Development Standards. Staff Response: Staff believes the proposal meets this standard. 8. Other Provisions. The proposed Special Use shall comply with all standards imposed on it by all other applicable provisions of these Land Use Regulations for use, layout, and general development characteristics. Staff Response: Staff believes the proposal meets this standard. Summary Analysis This request represents the latest step in a multi-year process by and between Eagle County Government, the State of Colorado, and the Federal Government to operate a sanitary landfill operation on lands owned by Eagle County since 2002-2003. The proposed Certificate of Designation and the accompanying Engineering Design and Operations Plan have been reviewed and approved by the State of Colorado; State Statute requires the County to act on the same CD and EDOP. Staff believes details included within the EDOP were previously presented and reviewed, in part by Eagle County in April, 2013, as part of a previous special use review to consider vertical expansion of the existing landfill footprint. At that time, operational plans and potential expansion scenarios were considered and deemed compliant with the goals,policies and implementing actions of County master plans,as well as the standards of the ECLURs. Additionally, staff is of the understanding there are no immediate plans or proposals for lateral expansion. Therefore, the focus of this proposal has been to memorialize the existing boundaries of lands owned by Eagle County for the purposes of operating a sanitary landfill operation. For the foreseeable and, perhaps, distant future, 45 02/03/2015 the existing landfill footprint (originally 180 acres) is expected to accommodate demand for disposal solid waste within Eagle County without the need for additional lateral expansion. As such, during their review, the Eagle County Planning Commission recommended that the request be approved with the condition that the Applicant be required to submit a new special use request at the time that any future phase for lateral expansion is proposed. Staff and the Applicant agree with this suggested condition. Recommendation: Approval,with Conditions Based upon staff's analysis of the proposal, as well as the review and recommendation(s) of the Eagle County Planning Commission, staff is recommending approval of the request. Specifically, staff believes that the proposal positively addresses a preponderance of applicable master plan goals, policies and strategies, and that positive findings can be made with regard to each applicable standard for approval. IV. PLANNING COMMISSION REVIEW: At their regularly scheduled hearing on January 7, 2015, the Eagle County Planning Commission considered the request, as well as testimony by the Applicant's representative and concerned neighboring property owners. During their discussion and deliberations, the Commission members expressed concern regarding the potential for impacts from future phases of landfill operations. Some members questioned the setbacks that will be enforced— from the edge of landfill operations to property lines — while others commented on the need to ensure that future phases be reclaimed properly(with top soil and re-vegetation). The Commission recommended conditions of approval that 1) require the Applicant, Eagle County, to work with neighboring (adjacent) property owners in the future to ensure that potential impacts from any additional phases (lateral expansion) are identified during the design of individual phases, and 2) require the Applicant to apply for a new special use for any future phases (lateral expansion). V. SUGGESTED CONDITIONS OF APPROVAL: 1. Except as otherwise modified by this development permit, all material representations made by the Applicant in this application and in public meeting shall be adhered to and considered conditions of approval. 2. This Special Use Permit shall be subject to the provisions contained in the document `Impacts To Wildlife As a Result of the BLM/Eagle County Land Transfer and Eagle County Landfill Wildlife Mitigation and Implementation Plan". 3. This Special Use Permit shall be subject to the provisions and recommendations contained in the Class III Cultural Resource and Archeological Inventory completed by Metcalf Archeological Consultants(1997). 4. The Applicant shall notify and seek input from adjacent property owners with regard to design and mitigation planning,prior to application to Eagle County for any future(expansion)phases (Phases II, III, and/or IV). 5. The Applicant shall submit a new Special Use Permit request for any and all future phases (Phases II, III and/or IV) for the purpose of review of site specific development,mitigation and reclamation planning. VI. SITE DATA: The project site is located approximately 2.5 miles north of Wolcott. Please see attached referral agency response letters/emails for full text of each response: Colorado State Historical Society(Edward Nichols): - The land included in the Revised Plan (EDOP) was surveyed in 1998 prior to County purchase of the BLM's lands. - The survey identified several sites with"significant cultural resources" and the County has identified those areas within the EDOP for avoidance during any future expansion of the landfill operations. - We encourage the County to continue to avoid such areas during any future lateral expansions. NECESSARY FINDINGS: 47 02/03/2015 ECLUR Section: 5-250 Special Use Permits Section Purpose: Special Uses are those uses that are not necessarily compatible with the other uses allowed in a zone district, but which may be determined compatible with the other uses allowed in the zone district based upon individual review of their location, design, configuration, density and intensity of use, and the imposition of appropriate conditions to ensure the compatibility of the use at a particular location with surrounding land uses. All Special Uses shall meet the standards set forth in this Section. Standards: Section 5-250.B. The issuance of a Special Use Permit shall be dependent upon findings that there is competent evidence that the proposed use as conditioned, fully complies with all the standards of this Section, this Division, this Article, and these Land Use Regulations. The Planning Commission may recommend and the Board of County Commissioners may attach any conditions deemed appropriate to ensure compliance with the following standards, including conformity to a specific site plan, requirements to improve public facilities necessary to serve the Special Use, and limitations on the operating characteristics of the use, or the location or duration of the Special Use Permit STANDARD: Consistent with Comprehensive Plan. [Section 5-250.B.1] The proposed Special Use shall be in substantial conformance with the Eagle County Comprehensive Plan, Area Community Plans and any applicable ancillary County adopted documents pertaining to natural resource protection, affordable housing, or infrastructure management. Staff Response: Staff believes the proposal meets the majority of applicable Comprehensive Plan goals, objectives and policies, inclusive of those specific to the Ute Creek Character Area of the Wolcott Area Community Plan. Below, staff has analyzed the proposal against the Eagle County Comprehensive Plan (2006), as well as the Wolcott Area Community Plan (2009), with a focus on development (land use), infrastructure, environmental and economic aspects of both plans. Eagle County Comprehensive Plan The Eagle County Comprehensive Plan was adopted in 2006 and includes specific policies and implementation strategies for unincorporated Eagle County inclusive of those areas included within sub-area master plans such as the Wolcott Area Community Plan. The Comprehensive Plan provides overarching policy and implementation direction in the following areas of strategic importance for Eagle County: 1. Governance 2. Development 3. Economic Resources 4. Housing 5. Infrastructure and Services 6. Water Resources 7. Wildlife Resources 8. Sensitive Lands 9. Environmental Quality The Eagle County Comprehensive Plan clearly and specifically supports the preservation of agricultural uses in rural areas of the County. Likewise, certain Comprehensive Plan goals and strategies support diversification of local "economic infrastructure", while others provide direction for protecting the environment and reducing 48 02/03/2015 impacts from new development proposals. Many policies of the Comprehensive Plan are not germane to the review of the proposed use(s). Therefore, staff's analysis of the Comprehensive Plan focuses primarily upon the overarching intents and policies of each strategy area applicable to the current proposal. Specifically, the following section highlights those policies, goals and recommended strategies related to Development; Economic Resources; Infrastructure and Services;Water Resources; Wildlife Resources; Sensitive Lands, and; Environmental Quality. 3.2.6-General Development: Policy "a"— Those attributes that support quality of life options unique to Eagle County today should be preserved for future generations. Applicable Recommended Strategies: • Ensure that all plans for development recognize the need to preserve the natural beauty and environmental integrity of Eagle County. Staff Response: Previous work done in conjunction with the State of Colorado, as well as previous approvals in 2013 by the State and Eagle County with regard to the revised EDOP and vertical expansion included technical studies and reports documenting how the Applicant will work to avoid disturbance of certain environmentally or culturally sensitive areas within the 730 acres owned by the County. • Work to preserve vestiges of the County's western heritage and the rural quality of life found in outlying areas of the county. Staff Response: This special use permit memorializes the boundaries and operational plans for the Eagle County Landfill; this use has been in place since 1986 and is slated to continue for many years. The proposed Certificate of Designation allows for the continuation of landfill uses in an area of the County that has been designated for such uses. Thus, the continued use of the landfill should not adversely affect the quality of life for this area of Eagle County, but may, instead,provide a means to maintain a rural, agricultural way of life in surrounding areas of the County. Policy "c"— Growth should be managed toward future sustainability—a healthy balance between economic success, quality of life, and the preservation of the environment. Applicable Recommended Strategies: • Ensure that all plans for development recognize the need to maintain a healthy economy. Staff Response: The Landfill provides important benefits to all residents of Eagle County by way of allowing for a balance between economic success, quality of life, and the preservation of the environment. Policy "j"- Development should be fully responsible for the mitigation of development related impacts upon both the natural and built environment. Applicable Recommended Strategies: • Assure that each development application fits the policies and applicable mapping of all master plans and area community plans. 49 02/03/2015 Staff Response: The area is designated within the Wolcott Area Community Plan as being part of the Ute Creek Character Area; it has been identified as a predominant use in this area, now and in the future. • Design and locate development to minimize and/or mitigate identified impacts. Staff Response: Staff believes the EDOP approved by the State of Colorado in 2013 and which was previously considered, in part, by Eagle County in 2013 as part of plans for vertical expansion of the landfill demonstrates that future plans for continued use of the existing landfill footprint, as well as any potential lateral expansion in the future, has been designed to avoid sensitive environmental and/or cultural resources. 3.3.9-Economic Resources Policy "b"- A healthy, attractive business environment,appropriate to the area's character and resources should be fostered. Applicable Recommended Strategies: • Match the economy to the natural and built characteristics of Eagle County and ensure that it is of a scale and scope that best fits the environmental and social values. Staff Response: The proposal responds to macroeconomic forces within Eagle County by providing a service that is directly tied to growth and development of the County's many communities. Policy "c"- Those qualities that make Eagle County a world class tourist destination and a great place to live should be identified,promoted and protected. Applicable Recommended Strategies: • Continue to make Eagle County attractive and convenient for residents and visitors by offering an appropriate mix of recreational experiences and business types, and by enhancing related services and infrastructure. Staff Response: The landfill should be considered "related service and infrastructure" necessary for the maintenance of quality of life and, specifically, the continued development and/or preservation of other areas of Eagle County as destinations. 3.5.6-Infrastructure and Services Policy "e"- To preserve mountain character, county roads should be adequate and safe for their intended use,but not over-designed. Applicable Recommended Strategies: • So long as safety considerations are met, apply minimal road standards in outlying areas to preserve the county's agricultural heritage and rural mountain character. Staff Response: 50 02/03/2015 The subject property is served by Ute Creek Road, a publically maintained road. No additional improvements are proposed to, or required for, Ute Creek Road as a result of this proposal. Any future expansion of the landfill may trigger additional improvements and the Applicant has already worked with the Eagle County Engineering Department and CDOT with regard to cost sharing in the event that improvements are required. • Assure adequate access for emergency responders. Staff Response: See above response. Policy "i"- Exemplary emergency and community services should be available to all residents, visitors and second homeowners. Applicable Recommended Strategies: • Refer all development proposals to potentially affected emergency and service providers for comment. Staff Response: The proposal was referred to several emergency, service and law enforcement agencies and providers for comment. • Require demonstration that all new developments will be adequately served by emergency and community services. Staff Response: See above responses. Policy "I"-Solid waste disposal in Eagle County should be efficiently and effectively managed. Applicable Recommended Strategies: • Track potential threats to the long-term safety, accessibility, and capacity of the landfill. Staff Response: This proposal is part of ongoing, long-term planning and coordination by and between Eagle County, the State of Colorado and the Federal Government to ensure the viability of the landfill for generations to come. 3.6.6-Water Resources Policy "a"- Protect the long-term viability of both ground and surface water sources. Applicable Recommended Strategies: • Utilize current water quantity information in all development applications and planning reviews. Staff Response: While no"development"is proposed within this special use request,the application provides ample evidence regarding the historic, current and future practices employed at the landfill with regard to protection of ground and surface water sources. • Protect source water areas and reduce the potential for source water contamination. 51 02/03/2015 Staff Response: See above response. • Dispose of hazardous materials properly and keep all potential pollutants away from streams and groundwater recharge areas. Staff Response: The landfill supports this strategy by restricting the disposal of hazardous solid or liquid wastes, as well as meeting strict State regulations. Policy "a“- Participate in water quality monitoring efforts. Staff Response: The application provides detailed information regarding ongoing groundwater monitoring occurring within the landfill area as part of ongoing compliance with State regulations. Policy "f”- Water quality in Eagle County should meet the highest applicable standards. Applicable Recommended Strategies: • Promote the appropriate best management practices for the control of stormwater runoff and work to ident and treat other non point sources of pollution. Staff Response: The application provides detailed information regarding the implementation of BMPs and water resource protection. Policy "g"- Surface and groundwater supplies should be protected from agricultural, industrial and development related impacts. Applicable Recommended Strategies: • Require an effective water quality management plan be implemented with new development. Staff Response: See above responses. • Adhere to established Land Use Regulations, and implement appropriate water quality best management practices (BMPs) on all development proposals. Staff Response: See above responses. • Minimize the extent of impervious surfaces within new developments and encourage the use of pervious paving systems. Staff Response: Most (roadway) surfaces at the landfill are not paved and no impervious improvements are proposed with this application. 3.7.6-Wildlife 52 02/03/2015 Policy "a"- The quality, integrity and interconnected nature of critical wildlife habitat in Eagle County should be preserved. Applicable Recommended Strategies: • Encourage owners of large land parcels to protect riparian areas and other identified wildlife habitat. Staff Response: The 730 acre parcel conveyed to Eagle County in 2002 and 2003 reflects boundaries that were established by identifying sensitive environmental and/or cultural resources such as wetlands and riparian areas to be avoided; previous mapping of the area as part of the original EDOP and the transfer of lands from the BLM to Eagle County has informed the establishment of the 730 acre parcel and operations planning for any future landfill phases. Policy "d"- Development in areas critical to the continued well-being of Eagle County's wildlife populations should not be allowed. Applicable Recommended Strategies: • Direct development away from areas of critical wildlife habitat. Staff Response: No areas of "critical" wildlife habitat have been identified on or around the subject property, however certain portions of the 730 acre parcel have been mapped as either "Winter Range," "Winter Concentration Area," or "Severe Winter" range for mule deer and elk. Portions of the property are also identified as Sage Grouse winter range and overall range, as well as Moose winter and overall range. The CPW did not provide any referral comments or concerns, however staff suggests that, like previous approvals for vertical expansion in 2013, the Applicant be held to stipulations and recommendations addressed within the Wildlife Mitigation and Implementation approved during the land transfer process between the BLM and Eagle County. 3.8.5- Sensitive Lands Policy "a"- Development should avoid areas of significant natural hazard. Applicable Recommended Strategies: • Utilize available hazard mapping, GIS mapping and other state-of-the-art analysis tools in the analysis of development proposals. Staff Response: The EDOP approved by the State includes detailed analyses of hazards and sensitive lands. The 730 acre parcel is the result of mapping and analysis done prior to the transfer of property from the BLM to Eagle County and reflects avoidance (removing certain acreages from the property transfer)of natural and/or cultural resources identified on the property. Policy "b"- The mitigation of natural hazards should be done in a manner that protects the integrity of the natural environment and the visual quality of the area. Applicable Recommended Strategies: • Minimize alteration of the natural landform by new development improvements to the greatest extent possible. 53 02/03/2015 Staff Response: See above responses. • Require a wildfire management plan for all new development. Staff Response: Not Applicable. Policy "c"- Development and development patterns should preserve landscapes that include visual, historic, and archeological value. Applicable Recommended Strategies: • Identj and inventory significant views, historic sites and structures, and archeological sites in Eagle County. Staff Response: This proposal was referred to the Colorado State Historical Society. The previous special use requests for the landfill as well as the more recent review of the amended EDOP by the State of Colorado in 2013 included detailed inventory and analyses of views, historic sites and structures and archeological sites in the area. Further, such analyses were completed in the late 1990s and early 2000s prior to transfer of the property from the BLM to Eagle County. 3.9.6-Environmental Quality Policy "a"- Air quality should meet the highest applicable safety standards, as well as the aesthetic expectations of local residents. • Set limits for construction site disturbance, require temporary re-vegetation of stockpiles, and permanent re-vegetation of all disturbed areas once final grades have been established. Staff Response: No new development is being proposed with this application; however the EDOP includes specific information and BMPs for maintaining air quality through re-vegetation and grading standards. Policy "b"- Lighting plans that reduce nuisance glare and protect the quality of the night sky should be encouraged. Applicable Recommended Strategies: • For commercial uses, require applications for commercial uses submit a lighting plan that conforms to applicable regulations. Staff Response: No new structures or other development is being proposed with this application. Wolcott Area Community Plan The Wolcott Area Community Plan was adopted in 2009 and is organized into sub-areas, or"character areas". The subject property is located within the Ute Creek Character Area, wherein the following policy and goal sections guide review of proposals. UC 1: Administration and Process Policy "A"- Approval Process: 54 02/03/2015 Applicable Recommended Strategies: • Development proposals for the Ute Creek basin should be reviewed under the Special Use Permit (SUP) or Planned Unit Development(PUD)process. Staff Response: The proposed CD is being reviewed under the special use permit process. A suggested condition of approval stipulates that any future site specific plans for expansion of the landfill will require additional special use review. UC 2.1: Natural and Cultural Resources Policy "A"- Visual Quality Applicable Recommended Strategies: • Require demonstration that proposed or expanded development in the Ute Creek will not unreasonably impact views of the Ute Creek drainage from distant view points on Bellyache Ridge and the I-70/US Highway 6 corridor. Staff Response: Although this special use request is not proposing any new or imminent development associated with the landfill, staff believes that previous proposals—to expand the landfill vertically--included detailed analysis of viewsheds and visual impacts from Bellyache Ridge and from travel corridors. The conclusion of those analyses was that even with increased height to the existing landfill footprint,no significant impacts on visual resources were anticipated. UC 2.2: Water Quality Policy `B"- Surface and Ground Water Protection Applicable Recommended Strategies: • Apply Best Landfill Management Practices to avoid negative impacts to ground and surface water from landfill operations. Staff Response: The Applicant has demonstrated adherence to State regulations with regard to surface and ground water protection via the recently approved EDOP, as well as through ongoing groundwater monitoring. Best practices include dust abatement, stormwater management and re-vegetation practices. • Ensure that hazardous materials are handled, stored and/or disposed of in a manner consistent with applicable Federal, State and local laws and regulations, and in a manner that protects the quality of local water systems. Staff Response: Staff is of the understanding that the landfill does not accept hazardous household or industrial waste/materials. UC 2.3: Air Quality Policy `B"—Dust Control 55 02/03/2015 Applicable Recommended Strategies: • Require the prompt reclamation of disturbed areas. Staff Response: The EDOP outlines standards for reclamation and re-vegetation within the landfill; the EDOP is approved by the State and monitored for compliance. Policy "C"—Monitoring and Compliance Applicable Recommended Strategies: • Preclude land uses that would deteriorate air quality in the area below state and/or local standards. Staff Response: The EDOP outlines standards for air quality, dust abatement and re-vegetation within the landfill; the EDOP is approved by the State and monitored for compliance. UC 2.4: Sensitive Lands,Hazards and Habitat Policy "A"—Mapping and Protection Applicable Recommended Strategies: • Identify and map sensitive lands, habitats and ecosystems prior to new development. Staff Response: All sensitive lands, habitats and ecosystems within the 730 acre property have been previously mapped or identified as part of original special use permits, the EDOP and more recent amendments to such permits. • Avoid disturbances to natural drainages,floodplains, riparian areas, wetlands, steep slopes, areas of swelling or unstable soils, and areas harboring unique or endangered vegetation. Staff Response: The approved EDOP stipulates avoidance of such areas. • Preclude development and human activity in critical wildlife habitats or movement corridors. Staff Response: See above responses. • Provide open spaces buffers between critical wildlife habitats and developed areas. Staff Response: The current and future footprint of landfill operations provides ample space within the 730 acre property to provide significant open lands as buffers for the foreseeable and distant future. UC 2.5: Cultural Resources Policy "A"—Inventory and Protect Applicable Recommended Strategies: 56 02/03/2015 • Require an inventory of cultural and archeological sites be submitted with application for development or special use approval. Staff Response: Such inventories have already been completed. • Preclude development and minimize human activity in areas where significant cultural and archeological sites have been identified. Staff Response: The current EDOP is based on mapping and planning of potential future expansion designed to avoid—in perpetuity—such sites. UC 3.1: Design and Character Policy "A"—Character of Developed Areas Applicable Recommended Strategies: • In the north central portions of the basin, maintain the perception of a well-kept and well-managed landfill, contractor storage and light industrial operations. Staff Response: The proposed CD and associated EDOP provide the control mechanisms necessary to monitor and enforce management of the landfill operations in the future to achieve this strategy. UC 3.2: Development Pattern Policy `B"—Preservation and Open Space Applicable Recommended Strategies: • Preserve critical wildlife habitat and ridgeline areas as undeveloped open space. Staff Response: See above responses regarding previous mapping and management plans to avoid sensitive habitats and to provide ongoing buffer areas. UC 4.1: Compatible Mix Policy "A"—Adequate Infrastructure and Services Applicable Recommended Strategies: • Ensure adequate access, infrastructure and fire and life safety services are available for the types and intensities of use in the area. Staff Response: Access is provided and the Applicant has already participated in preliminary cost sharing estimation with regard to future improvements to the intersection of Lite Creek Road and Hwy. 131. Policy `B"—Compatibility with Landfill and Light Industrial Operations 57 02/03/2015 Applicable Recommended Strategies: • Abide by provisions of the Land Patent Agreement that limits the type of land uses that may be conducted on County owned lands in the area. Staff Response: By virtue of the proposed CD and EDOP, staff believes the Applicant is abiding by the provisions of the Land Patent Agreement. STANDARD: Compatibility. [Section 5-250.B.2J The proposed Special Use shall be appropriate for its proposed location and compatible with the character of surrounding land uses. Potential Surrounding Land Uses/Zoning C issues . .! STANDARD: Zone District Standards. [Section 5-250.B.3] The proposed Special Use shall comply with the standards of the zone district in which it is located and any standards applicable to the particular use, as identified in Section 3-310, Review Standards Applicable to Particular Residential, Agricultural and Resource Uses and Section 3-330, Review Standards Applicable to Particular Commercial and Industrial Uses. Staff Response: Staff believes this standard is met. SECTION 3-310.REVIEW STANDARDS APPLICABLE TO PARTICULAR RESIDENTIAL,AGRICULTURAL AND RESOURCE USES STANDARD: Design Minimizes Adverse Impact. [Section 5-250.B.4] The design of the proposed Special Use shall minimize adverse impacts, including visual impact of the proposed use on adjacent lands;furthermore, the proposed Special Use shall avoid significant adverse impact on surrounding lands regarding trash, traffic, service delivery,parking and loading, odors, noise, glare, and vibration, and shall not create a nuisance. Staff Response: Staff believes the proposal meets this standard. Although this Special Use request is primarily sought to memorialize the boundaries of lands owned by Eagle County for landfill purposes, the EDOP,previously approved by the State of Colorado, and which is included within this application for reference, demonstrates that future expansions of the landfill, inclusive of a previously approved vertical expansion (Eagle County Resolution No. 2013-100)will result in several years or decades where no lateral expansion occurs, if ever. Therefore, staff believes the Applicant has sought to directly reduce or eliminate future impacts to lands immediately surrounding the existing landfill operations and, therefore, to minimize the overall impacts of the landfill on surrounding lands, businesses and peoples. Furthermore, the EDOP recently approved by the State 58 02/03/2015 details best management practices for landfill operations. This updated or amended CD is meant to formally recognize the 730 acres-owned by the County for the purposes of landfill operations since 2003. STANDARD: Design Minimizes Environmental Impact. [Section 5-250.B.5] The proposed Special Use shall minimize environmental impacts and shall not cause significant deterioration of water and air resources, wildlife habitat, scenic resources, and other natural resources. Staff Response: Staff believes the proposal meets this standard, although there will be some impacts. Specifically, while the EDOP . does include areas within the 730 acres, and outside of the original 180-acre landfill site, where future expansions are proposed, the EDOP also speculates that such expansion is highly dependent on 1) future growth and development in Eagle County, and 2) future use of landfill and recycling technology. In other words, future expansion of the landfill has already been approved by the State of Colorado and,to a certain extent, by Eagle County by virtue of previous special use requests for vertical expansion. The EDOP has been designed to minimize impacts to the lands included with the 730 acres by placing development in areas that are suited for future landfilling while limiting impacts on adjacent lands. Yet, while the EDOP sets forth specific plans for future phases of landfill development — as designed to meet State regulations for solid waste disposal and environmental protection -it also suggests that such future phases (and therefore, any potential future impacts from expansion)may not be needed. STANDARD: Impact on Public Facilities. [Section 5-250.B.6] The proposed Special Use Permit shall be_ adequately served by public facilities and services, including roads, pedestrian paths, potable water and wastewater facilities,parks, schools,police and fire protection, and emergency medical services. Staff Response: Staff believes the proposal meets this standard. The public facilities and/or services impacted will primarily be public roadways. This proposal was referred to and reviewed by the Eagle County Engineering Department with no comments or concerns noted. The site is served by Hwy. 131 and Ute Creek Road. Any physical expansion proposed in the future may trigger improvements at the intersection of Ute Creek Road and Hwy. 131. The Applicant has already addressed obligations with regard to intersection improvements at Ute Creek Road and Hwy. 131 as a result of previous conditions of approval for vertical expansion in 2013. STANDARD: Site Development Standards. STANDARD: Other Provisions. [Section 5-250.B.8] The proposed Special Use shall comply with all standards imposed on it by all other applicable provisions of these Land Use Regulations for use, layout, and general development characteristics. Staff Response: Staff suggests there are no further standards from other applicable provisions of the ECLURs that would apply to this request. DISCUSSION: Mr. Hunn stated that the applicant was requesting a new Certificate of Designation(CD)for Eagle County Landfill and the Special Use Permit was the mechanism to process the request. The 730 acres and the operation plan had already been approved by the State of Colorado. The request formally recognized an amendment to the previous CD. Since that time the county had acquired a total of 730 acres for landfill operations. He showed a vicinity map that identified the original 180 acres that were designated for landfill operations in 1986 and the 730 acres owned by Eagle County for the purpose of landfill. The request memorialized the boundaries of the Eagle County's land holdings. He reviewed the special use standards and staff believed the proposal met the standards. The Planning Commission reviewed the request on January 7, 2015; some members expressed concern regarding the potential impacts for future phases of the landfill operations and setbacks. There were five(5) suggested conditions of approval on page seven(7)of the staff report. Condition five(5)addressed the Planning Commission's concerns. Chairman Chandler-Henry commented on the process.The county was responsible for following its own Land Use Regulations and following the same process that any other applicant would go through to use the land. Ken Whitehead, Solid Waste and Recycling Director for Eagle County spoke. The county purchased the 730 acres from BLM many years back. He believed the landfill would last over 100 years.The original CD for the landfill included 180 acres. 61 acres of the site was used for landfill operations. He recommended that the board 60 02/03/2015 give future boards and future solid waste directors the moral high ground to protect the landfill. He recommended that any future expansion beyond the original 180 acres CD require the Board and Planning Commission approval. He recommended changing the language in the following conditions; 4. The Applicant shall notify and seek input from adjacent property owners with regard to design and mitigation planning,prior to application to Eagle County for any future(expansion)beyond the original 180 acre CD. 5. The Applicant shall submit a new Special Use Permit request for any and any expansion beyond the original 180 acre CD for the purpose of review of all site specific development, mitigation and reclamation planning. He believed that this gave the board and future staff a lot of flexibility but did not put the landowners out of the loop and would allow future boards to consider future conditions and population. Commissioner Chandler-Henry opened public comment. Steve Jouflas stated that the Jouflas family owned some of the surrounding property. They have worked with everyone on the team. He believed the process would work in the future. He acknowledged that everyone had worked together. There were no issues. Mr.Whitehead suggested that a view shed analysis be done as part of the design and planning in the future for any expansion outside the 180 acres.The recommendation could be added to condition four(4). Commissioner McQueeney wondered if this type of analysis would be required of other applicants. Mr. Hunn stated that the requirement had been required of other applicants for other types of special uses. Commissioner McQueeney stated that she was ready to vote in favor of the request and believed it met the standards, conformed with the Comprehensive Plan and Community Plan and was clearly what the area was designated for. Chairman Ryan believed staff had done a wonderful job and agreed that the request had met the standards. Commissioner Chandler-Henry stated that the application met the standards and supported the efforts to protect the footprint. Commissioner Ryan moved to approve file no. ZS-5097 with conditions and amendments to four (4) and five (5) and/or performance standards if it is determined that certain conditions and/or performance standards are necessary to ensure public, health, safety, and welfare and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan(and/or other applicable master plans). Commissioner McQueeney seconded the motion. The vote was declared unanimous.
