Swearing In Ceremony for Newly Elected Officials Frederick W. Gannett, Colorado Fifth Judicial District Judge Chairman Ryan acknowledged the service of Commissioner Sara Fisher who had served out her term of eight(8)years. Chairman Ryan swore in Judge Fred Gannett. Judge Gannett stated that he'd been a County Court Judge and Assisting County Court Judge for Eagle County for the last 28 years. It's been a privilege for him to serve. Judge Gannett swore in the officials'taking office. • Jeanne McQueeney, Commissioner • Kathy Chandler-Henry, Commissioner • Teak Simonton, Clerk and Recorder • Mark Chapin,Assessor • Ted Archibeque, Surveyor • Kara Bettis, Coroner Consent Agenda Chairman Ryan stated the first item before the Board was the Consent Agenda as follows: 2. Approval of Bill Paying for the Week of January 12, 2015 (Subject to Review by the Finance Director) John Lewis,Finance 3. Approval of Payroll for January 22, 2015 (Subject to Review by the Finance Director) John Lewis,Finance Commissioner Chandler-Henry thanked John Lewis for always being in attendance for the two bill paying items on the agenda. Commissioner Chandler-Henry moved to approve the Consent Agenda for January 13,2015, as presented. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Citizen Input Chairman Ryan opened and closed citizen Input, as there was none. 1 01/13/2015 Commissioner Chandler-Henry moved to adjourn as the Eagle County Board of County Commissioners and re-convene as the Eagle County Local Liquor Licensing Authority. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Eagle County Liquor License Authority Kathy Scriver, Clerk and Recorder's Office Other Liquor Business Transfer of Ownership/Temporary Permit APPLICANT: Mexican Restaurant Bar and Seafood Playa Azul, Inc. DBA: Playa Azul REPRESENTATIVE: Salvador Cruz Pena—Owner LOCATION: 58 El Jebel Road Unit A—El Jebel REQUEST: Transfer of Ownership/Temporary Permit STAFF REPRESENTATIVE: Kathy Scriver CONCERNS/ISSUES: None DESCRIPTION: The applicant has applied for the transfer of a Hotel and Restaurant liquor license and is requesting a Temporary permit to allow him to operate during the period in which the application to transfer ownership of the license is pending. The applicant has submitted all of the required documents and associated fees for the transfer. Malibu, LLC d/b/a Malibu Restaurant&Bar currently holds the license. STAFF FINDINGS: 1. The premises where the alcoholic beverages will be sold have been previously licensed by the State and Local Licensing Authority, and were valid as of the date of receiving the application. 2. The applicant has applied on forms provided by the Department of Revenue and includes the name and address of the applicant,the names and addresses of the president,vice-president, secretary and managing officer,the applicant's financial interest in the proposed transfer, and the premises for which the Temporary Permit is sought. 3. A statement that all accounts for alcohol beverages sold to the applicant are paid have been filed. 4. The application for the Temporary Permit has been filed no later than thirty(30)days after the filing of the application for the transfer of ownership and the appropriate fees have been paid. DISCUSSION: Ms. Scriver presented the request. Mr. Pena stated that he hoped to open a restaurant with a bar and seafood cuisine. His father and he would be working together. This was his first time owning this type of business. He currently managed a ski concierge business in Snowmass. He and his family were excited. The restaurant would offer traditional Mexican dishes. He hoped to host weekend and nightly events with special groups from all over the nation. They would have seating for up to 50. The patio would be open during the summer. They had three(3)billiard tables, a stage, and dance floor. Commissioner Chandler-Henry asked Mr. Pena to talk through his alcohol management plan. Mr. Pena stated that the bartenders would be trained and they would be training bussers, waiters, and servers to check IDs. He planned on being present seven days a week. Ms. Scriver stated that she and Mr. Pena had the conversation about the server training requirement for unincorporated Eagle County. Anyone serving, selling, or dispensing alcohol must be train within 30 days of hire. Mr.Pena was young but understood the responsibility of holding a liquor license. 2 01/13/2015 Chairman Ryan wished Mr.Pena luck and stressed the importance of not serving alcohol to underage youth. Commissioner Chandler-Henry move that the Local Liquor Licensing Authority approve the issuance of a Temporary Permit to Mexican Restaurant Bar and Seafood Playa Azul, Inc. d/b/a Playa Azul which will be valid until such time as the application to transfer ownership of the license is granted or denied or for one hundred twenty (120)days,whichever occurs first; except that,if the application to transfer the license has not been granted or denied within the one-hundred-twenty day period and the transferee demonstrates good cause,the local licensing authority may extend the validity of said permit for an additional period not to exceed sixty(60)days. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Commissioner Chandler-Henry moved to adjourn as the Eagle County Liquor Licensing Authority and re- convene as the Board of County Commissioners. Commissioner McQueeney seconded the motion. The vote was declared unanimous.
