The county partnered with the Eagle Vail Metropolitan District and secured a grant from FEMA that constructed flood improvements through the Eagle Vail Community. The project budget was about$177,000 and there was still approximately $5,000 left in the budget. Commissioner Chandler-Henry asked about the excess funds. Mr. Schroeder stated that a majority of the remaining funds would be returned to FEMA and a small amount would be returned to the county general fund and the property owners. This year the study would decrease the annual rents by about$99,000. They hoped to turn over units quickly to reduce vacancy rates and continue to look for other cost saving measures. Ms.Klosterman believed there would be plenty of cash to cover the operating expenses even with the decrease. Commissioner Fisher believed the rents were being calculated at the low of the market. Specifically, this proposed Special Use Permit will allow for the use of the property to continue providing environmental education programs for the public in a unique environment. This environmental education comes in the form of ecological and agricultural activities on the 113 acre property. A large portion of the property has been placed into a Conservation Easement to allow for environmental stewardship and the preservation of natural communities. This Conservation Easement is held by the Aspen Valley Land Trust and was not part of any land use approvals. IL BACKGROUND ACES is a non-profit organization dedicated to environmental education and land stewardship. ACES provides K- 12 in classroom environmental science education as well as year-round environmental education for adults and children through symposia,naturalist programs, sustainable agriculture programs and a Naturalist Field School. The Rock Bottom Ranch was acquired by ACES in 1999 to house the educational operations of the organization. The ranch is 113 acres in size spanning both Garfield and Eagle Counties. The majority of the parcel (78 acres) is held by Aspen Valley Land Trust in a Conservation Easement that protects its riparian forest and wetlands. Thirty- five acres is used to as irrigated pasture and managed for livestock. Chronology 25 10/07/2014 1968: Aspen Center for Environmental Studies(ACES)was established by Elizabeth Paepcke. 1999: Rock Bottom Ranch was acquired by ACES. 1999: 78 acres of RBR placed into Conservation Easement. 2003: Renovation was undertaken for the Staff Housing Building. 2012: Additional renovations undertaken for Staff Housing Building. 2014: Eagle County Planning received this application for a new Special Use Permit. 2014: RFVRPC recommended approval of the SUP. The resource zone district allows one primary residential unit and one ADU per 35 acres and as a result this parcel could be entitled to up to 3 primary residences and 3 ADU's on the property. RBR will utilize these entitlements to develop the six employee and ranch-hand housing units in the future. -Host onsite Agricultural Education Events. - Host "Mass Gatherings" similar to ACES' existing Fall Harvest Party. Rock Bottom Ranch will address with Eagle County any Mass Gathering of five hundred or more persons through a specific Mass Gathering permit for each event. - Reorganization of existing farmyard and outbuildings and addition of up to four 1,000 to 1,200 square foot greenhouses for food production, demonstration, and teaching. -Ecological restoration of significant areas of river and riparian habitat throughout the 113-acre property. -Pasture management and enhancement. 26 10/07/2014 III. STAFF FINDINGS AND RECOMMENDATION Effect of Special Use Permits Pursuant to Section 5-250.E — Effect of Issuance of Special Use Permit, Eagle County Land Use Regulations, Special Use permits are valid for three (3)years until the approved use is implemented. If the approved use is not implemented within the three year time period, the permit expires. Upon implementation of the approved use within the three year time period, Special Use permits remain valid in perpetuity, unless an expiration date or exception has been placed upon the permit by the Board of County Commissioners. NECESSARY FINDINGS: Chapter II,Article 5, Section 5-250, Special Use Permits Section Purpose Special Uses are those uses that are not necessarily compatible with other uses allowed in a zone district, but which may be determined compatible with the other uses allowed in the zone district based upon individual review of their location, design, configuration, density and intensity of use, and the imposition of appropriate conditions to ensure the compatibility of the use at a particular location with surrounding land uses. All Special Uses shall meet the standards set forth in this Section. Standards: Section 5-250.B. The issuance of a Special Use Permit shall be dependent upon findings that there is competent evidence that the proposed use as conditioned, fully complies with all the standards of this Section, this Division, this Article, and these Land Use Regulations. The Planning Commission may recommend and the Board of County Commissioners may attach any conditions deemed appropriate to ensure compliance with the following standards, including conformity to a specific site plan, requirements to improve public facilities necessary to serve the Special Use, and limitations on the operating characteristics of the use, or the location or duration of the Special Use Permit. Staff believes this proposal, as conditioned and based on representations made by the Applicant, meets all applicable standards for a Special Use Permit, as well as those standards specific to Educational Facility Operations. Staff is recommending approval with conditions. Please note that a more detailed analysis of the Standards may be reviewed under Appendix `A' of this staff report. Section 5-250 B—Standards: 1. Consistent with Comprehensive Plan. The proposed Special Use shall be in substantial conformance with the Eagle County Comprehensive Plan, Area Community Plans and any applicable ancillary County adopted documents pertaining to natural resource protection, affordable housing, or infrastructure management. The Special Use is generally compatible with the existing and currently permissible future uses of adjacent land and other substantially impacted land, services, or infrastructure improvements. RBR blends well with the Emma Character of irrigated fields and pastures and widely scattered ranches. Rock Bottom Ranch focuses on agricultural education, sustainable agriculture techniques and land stewardship. The response from 27 10/07/2014 neighbors has been supportive of the efforts of the Ranch to ensure education for ecological literacy, supporting and sustaining natural communities and encouraging environmental stewardship. 3. Zone Districts Standards. The proposed Special Use shall comply with the standards of the zone district in which it is located and any standards applicable to the particular use, as identified in Section 3-310, Review Standards Applicable to Particular Residential, Agricultural and Resource Uses and Section 3-330, Review Standards Applicable to Particular Commercial and Industrial Uses. Section 3-310 does not list specific standards for an "Educational Facility" but RBR will comply with all dimensional limtations specific to the Resource zone district. 4. Design Minimizes Adverse Impact. The design of the proposed Special Use shall reasonably avoid adverse impacts, including visual impacts of the proposed use on adjacent lands including trash, traffic, service delivery, parking and loading, odors, noise, glare, and vibration, or otherwise create a nuisance. (am.05/08/12) Staff believes this proposal minimizes adverse impacts. No areas of natural or geologic are present on the parcel containing Rock Bottom Ranch. Any impacts from development are resrtricted to the building envelope designated by the conservation easement on the property. 5. Design Minimizes Environmental Impact. The proposed Special Use shall minimize environmental impacts and shall not cause significant deterioration of water and air resources, wildlife habitat, scenic resources, and other natural resources. Staff believes this proposal minimizes environmental impacts. Rock Bottom Ranch works through restoration projects, protection of natural resources and enhancing native plant and animal species to ensure minimal impacts to the environment. 6. Impact on Public Facilities. The proposed Special Use shall be adequately served by public facilities and services, including roads, pedestrian paths, potable water and wastewater facilities, parks, schools, police and fire protection, and emergency medical services. Staff belives that this proposal has demonstrated that it can be adequately served by public facilities and services including; roads,paths,potable water,wastewater,police, fire and emergency services. VI. PLANNING COMMISSION DELIBERATION At their regularly scheduled meeting on Seoptember 4th, the Roaring Fork Vally Regional Planning Commission voted unanimously to recommend approval of the Rock Bottom Ranch Special Use Permit. The majoity of questions and deliberation focused on water and water rights on the property. It was made clear that Rock Bottom Ranch had successfully aqired non-exempt well status and an approved augmentation plan/allotment from Basalt Water Conservancy. V. SUGGESTED CONDITIONS OF APPROVAL I move that the Board of County of Commissioners recommends approval of file ZS-5016 with the following condition: 1) Except as otherwise modified by this development permit, all material representations made by the Applicant in this application and in any public meeting shall be adhered to and considered conditions of approval. 2) This Special Use Permit shall be valid for a period of not more than three (3) years prior to actual implementation of the permitted use. Upon implementation of the approved use, such permit shall remain valid, in perpetuity, and shall run with the land thereafter unless an expiration date or exception has been placed upon the permit by the Board of County Commissioners. 28 10/07/2014 VI. In this case the large portion of land set aside as a Conservation Easement works to maintain the community character found in the mid-valley area, and contributes to quality of life for visitors and students of ACES and Rock Bottom Ranch by providing a unique educational opporotunity and helping promote stewardship of the surrounding lands. The `Economic Resources' section of the Comprehensive Plan encourages land uses that further support and enhance the regional economic structure and local economic drivers. RBR seeks to continue its agricultural nature and to produce agricultural products to be sold and consumed by local residents. Employee `Housing' is the majority of the development associated with this proposal. All housing proposed with this SUP is to be used as employee housing and meets the definition of affordable housing. Regarding `Infrastructure and Services', Hooks Spur Road is sufficient for the needs of this proposal. Please refer to the Eagle County Engineering memo dated July 24th for specific language. Pertaining to `Water Resources', Wright Water Engineers, Inc has evaluated the water requirements associatedwith the existing and proposed operations of Rock Bottom Ranch. A water allotment contract with the BWCD has been submitted to assure adequate legal water supply to meet the demand at the ranch. Protection of the river bank along RBR will preserve and enhance water quality in the Roaring Fork River. Regarding `Wildlife Resources', as of the writing of this report no comments have been received by CDPW. In a letter from the USFS Karen Shroyer commented "the additional structures at Rock Bottom Ranch will have no negative effects on adjacent property owned by the Forest Service For `Sensitive Lands',RBR has placed 78 acres of land primarily within the floodplain of the Roaring Fork River in a protective Conservation Easement held by the Aspen Valley Land Trust. The `Future Land Use Map' designates the subject property as Rural Agriculture. The Comprehensive Plan expressly recognizes the existing Agricultural uses but is Silent to Educational Facility. Staff Response: 30 10/07/2014 Staff believes the proposal is in substantial conformance with all applicable plans and adopted policy documents. Specifically, the proposal was reviewed against relevant guiding policies, goals, and recommended implementation strategies of the Eagle County Comprehensive Plan and Eagle Area Community Plan. Mid Valley Community Plan Evaluation Policies Policy 1.1.2 Maintain the quality, density and distribution of residential land uses. Rock Bottom Ranch proposes to continue use of the existing accessory agricultural structures and to develop six employee and ranch-hand housing units in the future based on a total parcel size of 113 acres in the Resource Zone District. All future employee housing on site will occur within the identified Activity Envelope, forever protecting 101 acres on the site. Policy 1.1.3 Monitor and manage recreational uses appropriate to the area. Rock Bottom Ranch will continue to promote public environmental education classes and programs for all ages while supporting and sustaining natural communities and encouraging environmental stewardship. The Ranch has demonstrated its' intent for long-term accountability for open space by placing a conservation easement over this vital piece of land. Recreational uses outside of walking and biking are not allowed per the conservation easement. Policy 1.1.4 Assure land use compatibility. Rock Bottom Ranch has demonstrated its' intent to preclude new uses that would interfere with the quiet enjoyment of the neighborhood and preserve the agricultural and ranching operations in the area by placing a conservation easement over the parcel which limits any new development to the 12 acre parcel containing the existing ranch buildings.No zone changes are proposed for this property. Policy 1.1.7 Adhere to the purposes and intents of the Future Land Use map for the Emma Area. Staff feels the current and proposed uses of Rock Bottom Ranch reflect the rural land use purpose and intent for the Emma area as designated on the Future Land Use Map. 2.Design, Character and Appearance Goal 2.1 The character and appearance of Emma is preserved in a manner consistent with the values and expectations of local residents. Policy 2.1.1 Protect and/or enhance elements that contribute to the existing appearance and character of the area. The Roaring Fork River to the north and the Rio Grande trail on the south frames Rock Bottom Ranch. Most of the property is riparian forest and wetlands associated with the Roaring Fork River. 35 acres are irrigated pasture currently managed for livestock, and the remaining few acres include the Field Studies Center and staff housing building renovated in 2003 and 2012, a large hay shed, and several agricultural outbuildings. An existing gravel parking area accommodates 30 vehicles. Policy 2.1.2 Support social and cultural activities and events that contribute to or enhance the rural and agricultural character of the area. Field ecology classes, farming and agricultural arts programs are conducted at RBR for people of all ages. The Ranch provides a location for school programs and summer naturalist programs that offer environmental 31 10/07/2014 education, agricultural education, sustainable agriculture techniques and wild land stewardship for the mid-valley area. 3. Natural Resources and Environmental Quality Goal 3.1 The responsibility for overseeing the utilization and protection of natural resources is appropriately shared between affected stakeholders, management agencies and user groups. Policy 3.1.1 Foster collaboration and public input in the development and implementation of natural resource management plans. Rock Bottom Ranch has demonstrated its intent to protect and manage natural resources by placing a conservation easement over the parcel which limits any new development outside of the 12 acre parcel containing the existing ranch buildings. Policy 3.1.2 Promote understanding and encourage stewardship of local natural resources. This application is supporting the uses at Rock Bottom Ranch by securing the future of an educational facility that promotes stewardship of local natural resources. Goal 3.2 The quality of the natural environment and the function of sensitive lands and natural ecosystems is preserved and protected. Policy 3.2.1 Preserve the visual quality of natural areas. Rock Bottom Ranch has demonstrated its intent to preserve the visual quality of natural areas by placing a conservation easement over the parcel to ensure the protection of visual quality as well as complying with the dimensional limitations of the Resource zone district. Policy 3.2.2 Work to maintain and enhance air quality. Dust suppression on Hooks Spur Road is applied regularly to help prevent any dust problems from vehicle traffic. Rock Bottom Ranch also works to have no exposed soils that could create dust and poor air quality. No open air burning outside of small camp fires is permitted within the Ranch as part of the effort to maintain and enhance air quality. Policy 3.2.3 Preserve and/or enhance water quality and quantity in Emma. Wright Water Engineers, Inc. has evaluated the water requirements associated with the existing and proposed operations of Rock Bottom Ranch. A water allotment contract with the BWCD has been approved to assure adequate legal water supply to meet the demand at the ranch. Protection of the river bank along RBR will preserve and enhance water quality in the Roaring Fork River. Policy 3.2.4 Protect and preserve the quality of wildlife habitat and the vitality of wildlife populations. Landscape restoration projects at Rock Bottom Ranch include revitalizing declining cottonwood forests, enhancing native plant and wildlife diversity in riparian areas, and restoring the vigor of irrigated pastures to the benefit of livestock and wildlife. Policy 3.2.5 Maintain natural hazard areas in an undisturbed condition. Rock Bottom Ranch does not contain areas subject to natural geologic hazards or extreme wildfire hazards. Policy 3.2.6 Protect lands supporting important or unique vegetative communities. Most of Rock Bottom Ranch is riparian forest and wetlands associated with the Roaring Fork River. 32 10/07/2014 Policy 3.2.7 Assure the continued contribution of public lands on the Crown to the quality of natural resources available in the area. RBR does not propose access to the Crown as part of the environmental education activities and sustainable agriculture programs offered at the Ranch. Goal 3.3 Development incorporates appropriate energy and resource efficiencies. Policy 3.3.1 Encourage and/or require the use of alternative energy sources, energy efficient designs and energy efficient fixtures. The focus at RBR is sustainability, and as part of that focus ACES is planning to install a photovoltaic system of solar cells on the west end of the property. Policy 3.3.2 Promote energy and resource efficient lifestyles. As previously stated, the focus at RBR is sustainability and efficient lifestyles. The programs offered at the ranch are all in line with promoting, supporting and sustaining natural communities and encouraging environmental stewardship. 4. Public Services and Infrastructure Goal 4.1 Residents and visitors are provided adequate pubic services. Policy 4.1.1 Assure adequate infrastructure and levels of service appropriate to the rural character of the area. Rock Bottom Ranch currently has an onsite wastewater system installed in 2002, permit #2139A-01 which is included as an Exhibit. The Ranch remains a working ranch consistent with its historical heritage. Irrigation occurs under the historical rights in the Home Supply and Grange & Cerise Ditches, which have operable headgates and measuring devices. There are currently two wells on the property—Well No. 1 primarily provides stockwater, while Well No. 2 provides for the domestic water requirements in the Field Study Center. Well No. 1 will continue to operate as it has historically, as will the irrigation ditches. Well No. 2 will be re-permitted as a non-exempt well, and, therefore, will need an augmentation plan, which has been applied for with BWCD. The complete water report and BWCE contract application is included as an exhibit to this application. Policy 4.1.2 Promote appropriate and efficient vehicular and pedestrian connectivity. An existing parking area accommodates employee and visitor vehicles on the east side of the ranch. A pedestrian trail connects the parking area to the farm yards, outdoor classrooms, Field Studies Center and several agricultural outbuildings. The Rio Grande Trail also provides pedestrian and bicycle access to the property. Policy 4.1.5 Assure public health and safety Rock Bottom Ranch does not contain areas subject to natural geologic hazards or extreme wildfire hazard. Pedestrian trails have been designated within the Ranch creating a safe environment for all visitors. DISCUSSION: Commissioner Fisher was not present. Mr.Hanagan introduced Doug Pratte from the Land Studio and Chris Lane,ACES Chief Executive Officer. As part of the presentation there was a video from ACES Chris Lane introduced Connor Coleman of the Aspen Valley Land Trust,Jason Smith; ACES Site:Director, Katie Schwoerer; ACES Finance&HR Director, and John Kelly with Brightwater Engineers. Mr. Hanagan stated that the request fell under the definition of educational facility. The facility was a residential camp and day camp. The applicants were requesting approximately 3,100 on-site student visits annually,youth classes and programs, adult classes and programs, general public visits, farm tours, community events, sustainable agriculture dinners,birthday parties,retreats, overnight field trips, and community gardens. They were also requesting permission to expand the educational and office space, employee and ranch-hand housing, and habitable residential floor area. All habitable space on the parcel was governed by the conservation 37 10/07/2014 easement. They would like to continue hosting mass gatherings similar to the Fall Harvest Party but would still be required to go through the Limited Review Process for 500 or more. The proposal also included adding up to four 1,000-1,200 square foot green houses for food production demonstrations. The Special Use Permit had seven standards it must meet. The site was zoned resource in 1974 and historically the site had been used as an agricultural property and location for ACES since 1999. The Mid Valley Community Plan identified the property as rural agricultural. Adjacent property owners were notified. Staff received four letters of support and no letters of concerns. He reviewed the Special Use Standards. ACES had been functioning as is for many years and there had never been any issues. The site development standards had to do with lighting signage and there were no issues. In terms of conditions, staff recommended two conditions. Doug Pratte spoke about the community benefits and programs offered by ACES. Rock Bottom Ranch was acquired by ACES in 1999 and was a 113 acre refuge of wild,wet and green in the increasingly developed Mid Valley. ACES educated over 4,600 students every school year. He reviewed the list of standards and believed the request met all them and asked for the board's support. Approval would formalize existing uses and address future programs. Commissioner Chandler-Henry asked about the staff housing and square footage proposed for the units. Mr. Pratte stated that they were proposing up to six residences for agricultural staff and educators. There were currently two residences. The allowed square footage was less than 10,000 square feet. Commissioner Chandler-Henry asked if Aspen Valley Land Trust had any concerns. Mr. Coleman stated that they had been working closely with ACES since 1999 and had no concerns. Commissioner Chandler-Henry spoke about the letter from the Fire Marshall that identified several potential safety requirements. She wondered if they were all doable. Mr. Pratte believed they received good direction. Commissioner Chandler-Henry stated that there was a letter of support missing from David Wilson. She asked if there could be an addendum to the staff report that showed the entire property being in the conservation easement. Chairman Ryan asked about the other types of mass gatherings that took place on the property and how they handled the parking. Mr. Lane stated that there was one parking area that held about 30 cars. They require shuttles if any events exceeded a certain number and they did not allow parking on the road. Chairman Ryan opened public comment. Laura Kim presented a letter to the commissioners. Although her family supported Rock Bottom Ranch they were concerned with many of the uses. The ranch was located in a sensitive wetlands area. Upon reviewing the communication they received from ACES last May,they did not see the information regarding some of the uses. They did not see any information for the Special Use Permit for a Resort Recreational Facility that seemed necessary for the overnight accommodations. They understood there were plans for a commercial kitchen but did not see that in the written description either. She wondered if the application covered all the current uses. Mr. Pratte stated that the facility was set up to be an Educational Facility and not a Resort Recreational Facility. He believed that the uses mentioned by Ms.Kim had been considered. Anything related to the project was related to supporting educational efforts. Mr. Lane stated that every event required an educational component. Mr. Hanagan stated that staff believed that the majority of the uses were educational and the educational facility definition was the most appropriate. Mr. Pratte read through the list of uses in the traffic report. They considered special events and how the site would be impacted by traffic. Chairman Ryan asked if there were any events in the letter that would not fall under the special use permit. Mr.Hanagan stated that staff found the best fit for the facility. The facility would be titled as an educational facility and there were no specifics,what was being requested was being considered by the board. Every special use permit was unique. Commissioner Chandler-Henry asked about the sale of farm products. Mr.Hanagan stated that there was a definition of farm stand and a ranch in the Eagle County Land Use Regulations. The commissioners could approve anything as part of this special use. By saying"yes"to what was being proposed,the use would be included in the approval and the board did not need to make any special provisions. 38 10/07/2014 Commissioner Chandler-Henry suggested that in future communications,the uses be clarified. Mr. Coleman stated that the when the property was granted funding by GOCO in 1999,the purpose was for conservation and environmental education. Products that were produced and developed on the ranch fell under the definition of Cottage Industry and could be sold. Commissioner Chandler-Henry thanked the applicant for their application. She believed the area was a jewel and she was grateful for the cooperation between Pitkin County, Garfield County, and Eagle County. This was another good example of jurisdictional boundaries not dictating what might happen on a parcel. The property and its connection to the open space along the Crown was a benefit. The food production was an important piece as well. Chairman Ryan spoke about environmental sustainability. Educating the next generation, conservation, and local food production was something the county should be proud of and support. Chairman Ryan closed public comment. Commissioner Chandler-Henry moved to approve file no. ZS-4907 / Special Use Permit for the Rock Bottom Ranch with the conditions. Chairman Ryan seconded the motion.
